SUBJECT: Setting September 22, 1981, as the Date
for Public Hearing on the Assessment of
Costs to Repair Damaged Sidewalks,
Driveways, and Curbs (SR-80-191
Introduction
This report requests the City Council set a public hearing for the
assessment of the costs to repair damaged sidewalks, driveways and
curbs.
Background
On October 9, 1979, the Ci ty Council approved a sidewalk repair
program wh i c h provided for property owner participation in the
cost of repairing damaged sidewalks (Item 11-C). Property owner
participation was set at 50% of the cost of the repairs; the City
wi 11 pay the remaining 50% of the cost of the repair without
regard to the reason for the damage.
Certain repair work has been completed and the property owners'
share of the costs will now be due. A public hearing must be held
pursuant to provisions of Division 7, Chapter 22, Sections 5600 to
5630, of the Streets and Highways Code for the State of
Cal Hornia. A resolution setting the public hearing for September
22,1981 is attached.

HEARING DAT!:: FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE
SUPER I NTENDENT OF STREETS REGARDING
REPAIR OF SIDEWALKS, DRIVEWAYS ~ND
CURBS. (SR-80-19)
THE CITY COUNCIL OF THE CITY OF SANTA MONIC~

DOES HERESY RESOLVE AS FOLLOWS:
SECTION 1. That the Superlntendent of Streets
wlll flle a report of repalr pursuant to Section 5617 of
the Streets and Highways Code of the State of
California, relating to the construction of certaln
improvements to sidewal ks and driveways all within the
City of Santa Monica.
SECTION 2. That pursuant to Sectlon 5600 et
seq. of said code, the City Council does hereby order
and decl are that on the 22nd day of September, 1981, at
7;30 P. M. . in the Council Chambers of the Clty Hall, it
wi 11 hear and pass upon the report by the Superintendent
of Streets of the cost of repalr, together with any
objections or protests, if any, which may be ralsed by
any property owner llable to be assessed for the cost of
such repair and any other interested persons.
SECT! ON 3. That all protests or objections
must be in writing and filed with the City Clerk on or
befo re the time set for hearing of protests and
objectlons.

SECTION 4. The Superintendent of Streets is
hereby directed to mail notices, 1n the manner and form
prescribed by law, of the cost of repa1r and of the
adoption of this resal ution to all persons owning real
property affected by the sidewalk assessment repair
program, wl10se names and addresses appear on the last
equalized assessment roll for the City taxes or as known
to the C1ty Clerk.
SECTION 5. The Ci ty Cl erk shall certify to
the adoption of this resolution and thenceforth and
thereafter the same shall be in full force and effect.
