Introductlon
ThlS report transffilts a Resolutlon of Necesslty
whlch lS requlred to be adopted by a two-thlrds vote
of the Clty Councll after the publlC hearlng to be held
on February 14, 1978, and prlor to the commencement of
an emlnent domaln proceedlng regardlng the above referenced
proJect.
Background
At ltS meetlng of January 10, 1978, the City
Councll adopted a motlon, by unanlmous vote, authorlzlng
the sendlng of a Notlce of Intention to Adopt a Reso1utlon
of Necesslty and the settlng of a publlC hearlng on
February 14, 1978, at 7:30 p.m. In the Councll Chambers.

On January 23, 1978, pursuant to the Emlnent
Domaln Law, sald Notice was malled to John E. and Kathleen E.
Gllmore (Parcel No.1), Iran M. Threlfall (Parcel No. lA),
Frank D. and Frances M. Rua (Parcel Nos. 2 and 3), Sommerset
Terrace Ltd. (Parcel No.4) and Andrew J. and Effle M.
Oldfleld (Parcel No.6).
Sald partles were determlned
to have lnterests ln the real property sought to be acqu1red.
It was dlscovered thereafter that Parcel No. 4
recently changed ownershlP, and, therefore, the Notlce
was also malled to Bllly Kelst regardlng sald Parcel.
Sectlon 1245.235 of the Emlnent Domaln Law merely
requlres that the Notlce be sent to each person whose name
and address appears on the last equallzed county assessment
roll.
It should be noted that said assessment roll and
the Owhershlp Change Journals are only current as of two
to three months after documents regardlng ownershlp transfers
are recorded so lt lS posslble that lntervenlng title
transfers have occurred. But the Clty 1S not obl1gated
to search beyond the records of the County Assessor.
In accordance w1th the Em1nent Domaln Law, the
Notlce dlrected any person who wanted to appear at the
hearLng to fLle a wrLtten request with the CLty Clerk.
Sald Law dlctates that such wrltten request must be flIed
wlthLn f1fteen days after the Notlce was mall ed, and the

Clty CounCll need not give an opportunity to appear and

be heard to any person who falls to so flle a wrltten
request.
One of the next steps, under the Emlnent Domaln
Law, 15 for the City Counc1l to adopt the attached
Resolut1on of Neces51ty, by a vote to two-thlrd5 of all
the members, prlor to the commencement of an ernlnent dornaln
proceedi~g_
Although 1t 1S contemplated that all reasonable
efforts w1ll be made ln the negot1at1on process to attempt
to resolve the matter wlthout the necessity of lltlgatlon,
the procedures under the Em1nent Doma1n Law are be1ng
followed at th1S t1me as a back-up system 1n the event
such negotiat1on efforts should fall.
The annexed Resolut1on of Necess1ty makes the
f1ndlngs and determ1natlons requ1red by law and authorlzes
the C1ty Attorney to commence an eID1nent doma1n proceed1ng,
and take any other steps whlch are necessary to acqulre
the subJect real propert1es.

In 1975, the Callfornla Leglslature passed the
E~lnent Donaln Law (Sectlon 1230.010 et seq., of the
Callfor~la Code of C1Vll Procedure) WhlCh revlsed the eml~ent
dor.aln procedures under whlch publlC agencles can acqulre
prlvate property for publlC use.
The new law requlres that every agency WhlCh
lntends to condemn property nust notlfy the property owner
of such ln~entlon prlor to taklng offlclal actlon.
The proJect WhlCh requlres a portlon of your pro-
perty lD ~hlCh you have been ldentlfled, pursuant to
Sectlon 1243.235 of t~e Callfornla Code of C1Vll Procedure,
as owner(s), or havlng an lnterest thereln, 15 scheduled
for constructlon lD the near future. Although we have not
yet reached agreement, I belleve lt 15 probable the
purchase of your property, or 1nterest thereln, wlll be

Agenda Item ll-C: Presented at this time was a recommendation to
a~prove the widening of Clover Field Boulevard between Broadway and
Santa Monica Boulevard. Councilmember van den Steenhoven ~oved to
adopt the staff recommendation to widen 'Clover Field Boulevard between
Broadway and Santa Monica Boulevard, authorize City staff to prepare and
transmit notices to proper parties, and set a public hearing for discus-
sion thereto on February 14, 1978. Second by Mayor Pro Tempore Cohen.
Council Vote: Unanimously approved 7-0
Councilmember van den Steenhoven noted that his vote ~as only for setting
of a public hearing date at this point.
