Introduction
The City Council set a Public Hearing for the assessment of costs
to repair damaged sidewalks, driveways and curbs at various areas
within the City. It is recommended that Council adopt the
attached Resolution confirming the assessment of costs.
Background
On August 25, 1981, the City Council set a public hearing for
September 22, 1981, on the assessment of costs to repair damaged
sidewalks, driveways and curbs within the City of Santa Monica.
Indivldual letters stating the cost of this improvement were
mailed to each property owner on September 4, 1981.
Recommendation
It is recommended the City Council:
1. Open the Public Hearing;
2. Close the Public Hearing and overrule any protests; and
3. Adopt the Resolution confirming the assessments.

Dear Property Owner:
The sidewalk repair at the above descrlbed property has been
completed and the cost of the sidewalk repalr is $ Your
cost is S . which is one-half of the cost of the work done
at the location.
Pursuant to Streets and Highways Code Section 5616. thlS letter
is notification that the City Councll. pursuant to Resolution No.
6344 adopted on August 25. 1981. has scheduled a hearing to hear and
pass upon the report of the Superintendent of Streets of the cost of
the sidewalk repair. in connection with the above-described proJect,
together with any Objects and protests, if any. WhlCh may be raised
by any property owner liable to be assessed for the cost of such
sidewalk repair and any other interested persons.

Any protests or objections must be in writing and must be filed

of the sidewalk repair will be assessed against your property. and
you will De notified of the manner of payment.

TO CITY COUNCIL
REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS. CURBS.
AND/OR REMOVAL OF OBSTRUCTIONS. PERFORMED
UNDER PROVISIONS OF DIVISION 7, CHAPTER 22.
SECTIONS 5600 TO 5630. OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
(SR-80-19l
Pursuant to the provisions of Division 7, Chapter 22,
Sections 5600 to 5630, of the Streets and Highways Code of the
State of California, the following work was caused to be done by
the Street Superintendent:
The removal and replacement of
634.5 square feet of PC concrete
on sidewalks;
The removal and replacement of
3.4 lineal feet of PC concrete
curbing.
The to tal cost of the work was $1.903.50. based on the following
charges:
Removal and replacement of:
pee sidewalk . $3.00/sq.ft.
pec curb. . .$10.00/sq.ft.
The total proposed assessment for sidewalks damaged by tree roots
is $951.75 or 50 percent of the total cost. The other 50 percent
of the cost is being pald by the City.
Seventy-two square feet of pce sidewalk was replaced du e to
non-tree related damage. This repair is assessed at 100% of the
cost or $216.00. The cost was based on $3.00 per square foot for
remova 1 and replacement of the PCC sidewalk.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAl4AGE D SI DE\~ALKS, DRIVEWAYS AND CURBS
(SR-80-19)
WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repair of
damaged sldewalks, driveways and curbs in the City of Santa
;'1onica; and
WHEREAS, s 1 X ty days after said order was served, the
work had not been co~pleted by the owners or persons in possession
of the affected properties, and the Superintendent of Streets
caused the work to be done; and
\mEREAS, the Superintendent of Streets gave the not1ce
required by Sect10n 5616 of the Streets and Highways Code; and
WHEREAS, the Super1ntendent of Streets did file with the
C1ty Council of the City of Santa Monica his report of repairs and
cost as required by Section 5617 of the Streets and Highways Code;
and
WHEREAS, upon the day and hour fixed for heari ng by
Resoiution NUMber 6344 (CCS) , the C1ty Council oft he City 0 f
Santa Monica he a rd and passed upon the report of the
Superintendent of Streets together with all objections and
protests as required by Section 5618 of the Streets and Highways
Code;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS;
SECTION l. That the report of the Superintendent of
Streets heretofore filed and above-described be and the saJlle is
hereby confirmed.
SECTION 2. Tl1at all protests and objectlons of every
kind and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTIO~J 3. That the cost of the repairs, as set forth
in the report of the Superintendent of Streets, shall be assessed
against the properties therein described, which properties front
upon the sidewalk upo~ which the repairs were made.
SECTI ON 4. That if such assess~ent is not paid within
the time permltted by law, the same shall constitute a speclal
assessment agalnst and lien on the properties therein described,
1 n the amount set forth in the report of the Superintendent of
Streets, which lien shall continue untl1 the assessment and all
lnterest thereon is paid or untll it is discharged of record.
SECT I Ot~ 5. That if the asssessment is not paid within
the time permitted by law, the Superintendent of Streets, in
aCcordance with Section 5628 of the Streets and Highways Code,
s ha 11 deliver a Notice of Lien, prepared in the manner required by
Section 5626 of the Streets and Highways Code. to the County
Audltor who shall collect the assessment together with all other
taxes against the property.

SECTION 6. That the City Clerk shall certi fy to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
