SUBJECT: Setting October 27, 1981. as the Date for
Public Hearing on the Assessment of Costs
to Repair Oamaged Sidewalks, Driveways,
and Curbs (SR-80-20)
Introduction
This report requests the City Councll set a public hearing for the
assessment of the costs to repair damaged sidewalks, driveways and
curbs.
Background
On October 9, 1979, the City Council approved a sidewalk repa i r
program which provlded for property owner participation in the
cost of repairing damaged sidewalks (J tern 11- C ) . Property owner
participation was set at 50% of the cost of the repairs; the City
will pay the remainlng 50% of the cost of the repair without
regard to the reason for the damage.
Certaln repair work has been completed and the property owners'
share of the costs will now be due. A public hearing must be held
pursuant to provlsions of Division 7, Chapter 22, Sections 5600 to
5630, of the Streets and Highways Code for the State of
California. A resolution setting the public hearing for October
27, 1981 is attached.

Recommendation
It is recommended the City Council adopt the attached resolution
setting a public hearing for October 27, 1981, on the assessment
of costs of the subject sidewalk repairs.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING A
HEARING DATE FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE
SUPERI NTEflDEtH OF STREETS REGARDING
REPAIR OF SIDEWALKS, DRIVEWAYS AND
CURBS. (SR-80-20)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets
will file a report of repair pursuant to Section 5617 of
the Streets and Hlghways Code of the State of
California, relating to the construction of certain
improve"lents to sldewalks and dnveways all .....lt~lln the
Clty of Santa ~onlca.
SECTII)~l 2. That pursuant to Section 5600 et
seq. of said code, the Ci ty Councll does hereby order
and declare that on the 27th day of October, 1981, at
7:30 P. r~. , in the Council Chambers of the Ci ty Hall, lt
wi 11 hear and pass upon the report by the Superintendent
of Str eets of the cost of repair, together with any
obJections or protests, i f any, WhlCh may be raised by
any property owner liable to be assessed for the cost of
such repair and any other interested persons.
SECTI ON 3. That all protests or objections
must be ln writlng and filed with the City Clerk on or
before the tlme set for hearing of protests and
objectlons.

SECT IO~l 4. The Superintendent of Streets is
hereby di rected to mail notices, in the manner and form
prescribed by 1 aw, of the cost of repair and of the
adoption of thlS resolution to all persons owning real
property affected by the sidewalk assessment repair
program, whose names and addresses appear on the last
equalized assessment roll for the City taxes or as known
to the City Clerk.
SECTION 5. The City Cl erk shall certify to
the adoption of this resolution and thenceforth and
thereafter the same shall be in full force and effect.
