SUBJECT: Public Hearing on Assessment of Costs to Repair Damaged
Sidewalks, Driveways and Curbs (SR-80-5)
Introduction
This report requests the City Council to hold a Public Hearing for the assess-
ment of costs to repair damaged sidewalks, driveways and curbs within the City
of Santa Monica and to adopt the attached Resolution confirming the assessment
of costs.
?ackground
On May 13, 1980, the Clty Council set a PubllC Hearing for July 8, 1980, on
the assessment of costs to repair damaged sidewalks, driveways and curbs within
the City (Item 6-D-15). Individual letters stating the cost of this improve-
ment were mailed to each property owner on June 20, 1980.

RecoPlmendation
It is recommended the Council:
1. Open the Public Hearlng
2. Close the Public Hearlng and overrule any protests; and
3. Adopt the Resolution confirming the assessment costs.

TO CITY COUNCIL
REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS, AND/OR
REMOVAL OF OBSTRUCTIONS. PERFORMED UNDER PROVISIONS OF
DIVISION 7, CHAPTER 22, SECTIONS 5600 TO 5630, INCLUSIVE,
OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA.
(SR-80-5)
Pursuant to the provisions of D1vision 7, Chapter 22. Sect10ns
5600 to 5630, 1nc1usive, of the Streets and Highways Code of the State of
California, the followlng work was caused to be done by the Street Superintendent:
The removal and replacement of 1,509 square feet of pee
concrete on sidewalks;
The removal and replacement of 496 square feet of pee concrete
on driveways; and
The removal and replacement of 43 lineal feet of Type A curb.
The total cost of the work was $6,941.00, based on the following charges:
Removal and replacement of:
pee sidewalk. . . . . . . . . . . . . $3.00 / sq. ft.
pee dr1veway . . . . . . . . . . . . . $4.00 / sq. ft.
Type A curb . . . . . . . . . . . . . $10.00 / sq. ft.
The total proposed assessment is $3,470.50. or 50 percent of the total cost.
The other 50 percent of the cost is be1ng paid by the eity.
Reference is made to the attached sheets for a description of the
real property in front of Wh1Ch the work has been done. the proposed assessment
against each property, and a description of the work done 1n front of each
property.

Dear Property Owner:
You are hereby notlfled that the Clty Council of the Clty of Santa Monlca~
on the 8th day of July~ 1980~ at the hour of 7:30 p.m.~ ln the Councll
ChaMbers ln the Santa Monlca Clty Hall. 1685 Main Street~ will hear and
pass upon a report by the Street Superlntendent of the cost of the removal
and placement of PCC sldewalk as required by the Clty Council under
Divislon 7, Chapter 22, Sectlons 5600 and 5630 lncluslve, of the Streets
and Hlghways Code of the State of Ca11fornla.
The total cost of the work at the above named locatlon 1S 5
The proposed assessment lS S . WhlCh is one half the total cost
of the work, and may be assessed by the Clty Councll agalnst sald property
upon conflrmatlon of the Street Superlntendent1s report.
The above assess~ent is due and payable wlthin 30 days after its conflrmatlon
on July 8, 1980, by the Council, or no later than August 7, 1980. If the
assessment is not pald by that date, the C1ty has the rlght to flle a lien
agalnst the property in the a~ount of the assessment plus an adMinlstratlve
fee. The City will provlde assistance for low-to-moderate lncome persons.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS, DRIVE-
vJAYS AND CURBS (SR-80-5)
WHEREAS, the Street Superintendent of the City of Santa Monica,
pursuant to Sect10n 5600 to 5630 of the Streets and Highways Code, commenced
proceed1ngs to cause the repair of damaged sldewalks, dr1veways and curbs in
the C1ty of Santa Monica, and ,
WHEREAS, sixty days after said order was served, the work had
not been completed by the owners or persons 1n possession of the affected
properties, and the Superintendent of Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets did file with the City
Council of the City of Santa Mon1ca h1S reports of such work, and a hearing
thereon was called by Resolution No. 5590 (CCS); and
WHEREAS, the City Council conducted a not1ced hearing to consider
any protests or object1ons to the Reports of the Work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOllOWS:
SECTION 1. That the Report of Work of the Superintendent of
Streets heretofore filed and above described, be and the same 15 hereby confirmed.
SECTION 2. That all of said protests and obJections of every
kind and nature to the repairs or to the assessments and all appeals therefrom
to said City Council be and the same hereby are overruled and den1ed.

SECTION 3. That the cost of the repairs, as set forth in said
Report, shall be assessed agalnst the properties herein described, which
properties front upon the improvement so constructed.
SECTION 4. That if such assessment is not paid within the
time permitted by law the same shall constitute a special assessment and
llen against the properties thereln described, in the amount set forth in
said Report, WhlCh lien shall continue untl1 the assessment and all interest
thereon is pa1d.
SECTION 5. That if the assessment is not paid within the time
permitted, the City Clerk shall deliver a Notice of Lien, signed by the
Superintendent of Streets, as provided in Section 5626 of the Streets and
Highways Code of the State of Californ1a. to the County Assessor and Tax
Collector, who, 1n accordance with applicable law, shall collect sa1d assess-
ment, together w1l1 all other taxes relatlng to such property.
SECTION 6. That the City Clerk shall certify to the adoption
of this Resolution.
