Introduction
The City Council set a Public Hearing for the assessment of costs
to repair damaged sidewa1ks, drIveways and curbs at various areas
with i nth e City. It is recommended the Council adopt the attached
Resolution confirming the assessment of costs.
Background
On June 9, 1981, the City Council set a public hearing for July
14, 1981, on the assessment of costs to repair damaged sidewalks,
driveways and curbs within the City of Santa Monica. Individual
letters stating the cost of this improvement were mailed to each
property owner on July 3, 1981. Attached is Resolution No. 6274
(CGSl setting the date of the Public Hearing (Item 6-cl.
Recommendation
It is recommended the City Council:
1. Open the Public Hearing;
2. Close the Public Hearing and overrule any protests; and
3. Adopt the Resolution confirming the assessments.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING A
HEARING DATE FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE
SUPERINTENOENT OF STREETS REGAROING
REPAIR OF SIDEWALKS, DRIVEWAYS AND
CURBS. I SR-80-17)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets
wi 11 file a report of repair pursuant to Section 5617 of
the Streets and Highways Code of the State of
Cal Hornia, relating to the construction of certain
improvements to sidewalks and driveways all within the
City of Santa Monica.
SECTION 2. That pursuant to Section 5600 et
seq. of said code, the City Council does hereby order
and declare that on the 14th day of July, 1981, at 7:30
P.M. , in the Council Chambers of the City Hall, it will
hear and pass upon the report by the Superintendent of
Streets of the cost of repair, together with any
objections or protes ts, if any, which may be ra ~ed by
any property owner liable to be assessed for the cost of
such repair and any other interested persons.
SECTION 3. That all protests or objections
must be in writlng and filed with the City Clerk on or
before the time set for hearing of protests and
objections.

SECTION 4. The Superintendent of Streets is
hereby directed to mail notices, in the manner and form
prescribed by law. of the cost of repair and of the
adoption of this resolution to all persons owning real
property affected by the sidewalk assessment repair
program, whose names and addresses appear on the last
equalized assessment roll for the City taxes or as known
to the City Clerk.
SECTION 5. The City Clerk shall cer'ti 1'y to
the adoption of this resolution and thenceforth and
thereafter the same shall be in full force and effect.

STREET SUPERINTENDENT'S REPORT
TO CITY COUNCIL
REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS,
AND/OR REMOVAL OF OBSTRUCTIONS. PERFORMED
UNDER PROVISIONS OF DIVISION 7. CHAPTER 22,
SECTIONS 5600 TO 5630, OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
(SR-80-171
Pursuant to the provisions of Division 7, Chapter 22,
Sections 5600 to 5630, of the Streets and Highways Code of the
State of California, the following work was caused to be done by
the Street Superintendent:
The removal and replacement of
565 square feet of PC concrete
on sidewalks;
The removal and replacement of
106 square feet of PC concrete
on driveways;
The total cost of the work was $2,119.00, based
on the following charges:
Removal and replacement of:
PCC sidewal k . . $3.00/sq.ft.
PCC driveway . . . $4.00/sq.ft.
The total proposed assessment for sidewalks damaged by tree roots
is $1,559.50 or 50 percent of the total cost. The other 50
percent of the cost is being paid by the City.
Reference is made to the attached sheets for a
description of the real property in front of which the work has
been done. the proposed assessment against each property, and a
description of the work done in front of each property.

WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repair of
damaged. sidewal:<s, driveways and curbs in the C, ty of Santa
Monica; and
WHEREAS, s T X ty days after said order was served, the
work had not bee~ completed by the owners or persons in ;Jossesslon
of the affected properties, and the Superintendent of Streets
caused the wor( to be done; and
',o/HEREAS, the Superlntendent of Streets gave the ~otice
required by Section 5616 of the Streets and Highways Code; and

and

protests as required by Section 5618 of the Streets and Highways
Code;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF S~NTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION l. That the report of the Superintende~t of
Streets heretofo re filed and above-described be and the same is
hereby confirmed.
SECn ON 2. That all protests and objections of every
klnd and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
S ECTI ON 3. That the cost of the repairs, as set forth
in the report of the Superintendent of Streets, shall be assessed
against the properties therein descri bed, which properties front
upon the sidewalk UPOry which the repairs were made.
SECTION 4. That if such assess~ent is not paid within
the time permitted by 1 aw, the same shall constitute a special
assessment against and lien on the properties therein descr1bed,
in the amount set forth in the report of the Superintendent of
Streets, which llen shall conti nue unt; 1 the assessment and all
interest thereon 1S paid or until it is discharged of record.
SECTION 5. Ti1at if the asssessme~t is not paid with1n
the time permitted by law, the Super1nte~de~t of Streets, i n
accordance with Section 5628 of the Streets and Highways Code,
shall deliver a Notice of Lien, prepared in the manner required by
Secti 0 n 5626 of the Streets and Highways Code, to the County
Aud i tor '101M 0 s hall collect the assessment together with all other
taxes against the property.

SECTION 6. That the City Clerk shall cert1fy to the
adoption of this resolution and thenceforth and thereaf:er the
