Introduction
The City Co un C 11 set a Public Hearing for the assessment of costs
to repair damaged sidewalks, driveways and curbs at various areas
within the Ci ty. It is recommended that Co unc il adopt the
attached Resolution confirming the assessment of costs.
Background
On July 14, 1981, the City Co un c i 1 set a public hearing for August
11, 1981, on the assessment of costs to repair damaged sidewalks,
d r1 V eway s and curbs within the City of Santa Monica. Individual
letters stating the cost of this improvement were mailed to each
property owner on July 30, 198!. Attached is Resolution No. 6305
(CCS) setting the date of the Public Hearing (Item 6-F).
Recommendation
It is recommended the City Council:
l. Open the Pub7ic Hearing;
2. Close the Public Hearing and overrule any protests; and
3. Adopt the Resolution confirming the assessments.

(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING A
HEARING DATE FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING
REPAIR OF SIDEWALKS, DRIVEWAYS AND
CURBS. (SR-80-18)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOllOWS:
SECTION 1. That the Superintendent of Streets
wi 11 file a report of repair pursuant to Section 5617 of
the Streets and Hi ghways Code of the Sta te of
California, relating to the construction of certain
improvements to sidewalks and driveways all withi n the
City of Santa Monica.
SECTION 2. That pursuant to Section 5600 et
seq. of said code, the City Council does hereby order
and declare that on the 11th day of August, 1981, at
7:30 P. M. , in the Council Chambers of the City Hall, it
wl11 hear and pass upon the report by the Superintendent
of Streets of the cost of repalr, together with any
objections or protests, if any, which may be raised by
any property owner liable to be assessed for the cost of
such repair and any other interested persons.
SECTION 3. That all protests or objections
must be in writlng and filed wlth the City Clerk on or
before the time set for heanng of protests and
obj ecti ons.

SECTl ON 4. The Superintendent of Streets is
hereby directed to mail notices, in the manner and form
prescribed by law, of the cost of repair and of the
adoption of this resolution to all persons owning real
property affected by the sidewalk assessment repair
program, whose names and addresses appear on the last
equalized assessment roll for the City taxes or as known
to the City Clerk.
SEC Tl ON 5. The City Clerk shall certify to
the adoption of this resolution and thenceforth and
thereafter the same shall be ; n full force and effect.

Dear Property Owner:
The sidewalk repair at the above described property has been
completed and the cost of the sidewalk repair is $ . Your
cost is S , which is one-half of the cost of the work done
at the location.
Pursuant to Streets and Highways Code Section 5616, this letter
is notiflcation that the City Council, pursuant to Resolution No. 6305
adopted on July 14, 1981, has scheduled a hearing to hear and pass
upon the report of the Superintendent of Streets of the cost of the
sidewalk repair, in connection with the above-described proJect,
together with any Objects and protests, if any, which may be raised
by any property owner liable to be assessed for the cost of such
sidewalk repair and any other interested persons.
The hearlng will be held as follows:

TIME: 7:30 P.M.
Any protests or objections must be in writlng and must be filed

as provided for in Streets and Highways Code Section 5618, the cost of
the sidewalk repair will be assessed against your property, and you
will be notified of the manner of payment.
The City will provide asslstance for low-to-moderate income persons.

TO CITY COUNCIL
REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS,
AND lOR REMOVAL OF OBSTRUCTIONS, PERFORMED
UNDER PROVISIONS OF DIVISION 7, CHAPTER 22,
SECTIONS 5600 TO 5630, OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
(SR-80-18)
Pursuant to the provisions of Division 7, Chapter 22,
Sections 5600 to 5630, of the Streets and Highways Code of the
State of California, the following work was caused to be done by
the Street Superintendent:
The removal and replacement of
515 square feet of PC concrete
on sidewalks;
The removal of 17.5 square feet
of PC concrete in the parkway.
The to tal cost of the work was $1,545.00, based
on the following charges:
Removal and replacement of:
PCC sldewalk . . $3.00/sq.ft.
Removal only . . . $1.50/sq.ft.
The to ta 1 proposed assessment for sidewalks damaged by tree roots
is $772.50 or 50 percent of the total cost. The other 50 percent
of the cost is being paid by the City.
Reference is made to the attached sheets for a
description of the real property in front of which the work has
been done, the proposed assessment against each property, and a
description of the work done in front of each property.

WHEREa.S, the Street Superintendent of the City of Santa

WHEREAS, sixty days after said order was served, the
work had not been completed by the owners or ~ersons in posSeSS1O!1
of the affected propertl€S, and the Superintendent of Streets
caused the work to be done; and
'IIHEREAS, the Superintendent of Streets gave t~e notice
requTred by Section 5616 of the Streets al1d Highways Code; a.,d
WHEREA.S, the Superintel1dent of Streets did file wlth the
City Co u n c i 1 of the City of Santa Monica his report of repairs and
cost as required by Section 5617 of the Streets and Highways Code;

WHEREAS, upon the day and hour fixed for hearlng by

kind an d n at u r e to the report of t~e Super1ntendent of Streets be
and the same are hereby overruled and derded.
SECTION 3. That the cost of the repalrs, as set forth
1 n the report of the Superintendent of Streets, shall be assessed
against the properties thereln described, which propert'es front
upon the sldewa1k upon which the repalrs were made.
SECTIO~ 4. That lf such assessment is not paid wlth1n
the t 1 me permitted by 1 a w , the same shall const1tute a special
assessment against and lien on the propertles t~erein described,
in the amount set forth in the report of the Superlntendent of
Streets, which lien shall contlnue until the assessment and all
interest thereon is paid or unt1l lt 1S dlscharged of record.
SECTION 5. That if the asssessment is not paid wlthin
the time permitted by 1 aw, the Superintende"t of Streets, in
accordance with Section 5628 of the Streets and Highways Code,
shall deliver a Notlce of Lien, prepared in the manner required by
Section 5626 of the Streets and ~ighways Code, to the County
Audl tor who shall collect the assessment together with all other
taxes agalnst t~e property.
