Sidewalks~ Driveways and Curbs SR-80-2
Introduction
This report is requesting the City Council to hold a Publ1C Hearing for the
assessment of costs to ~epair damaged sidewalks~ driveways and curbs within
the C1ty of Santa Monica and to adopt the attached Resolution confirming
the assessment of costs thereof.
Background
On February 26~ 1980~ the City Council set a Public Hearing for March 25~ 1980~
on the assessment of costs to repair damaged sidewalks, driveways and curbs
with1n the City of Santa Monica. Indiv1dual letters stating the cost of this
improvement were mailed to each property owner on March lO~ 1980. Attached
1S the staff report of February 7~ 1980~ and the Resolution No. 5505 (ceS)
setting the date of the Public Hearing (Item 6-B-14).
Recommendation
It is recommended that the Council
1. Open the public hearing;
2. Close the publ1C hea~ing and overrule any objections; and
3. Adopt the attached resolution confirming the assessment charges.

SIDEWALKS, DRIVEWAYS AND CURBS
\\HEREAS. the Street Superlntendent of the Clty of Santa Monlca.
pursuant to Sectlon 5600 to 5630 of the Streets and Highways Code, commenced
proceedlngs to cause the repalr of damaged sldewalks, drlveways and curbs
ln the Clty of Santa Monlca, and
WHEREAS, sixty (60) days after said order was served, the work had
not been completed by the owners or persons 1n possesslon of the affected
propertles, and the Superintendent of Streets caused the work to be done; and
WHEREAS, the Superlntendent of Streets dld file wlth the Clty CounCll
of the Clty of Santa Monlca hlS reports of such work, and a hearlng thereon
was called by Resolutlon No. 5505 (C.C.S ), and
WHEREAS, the Clty Council conducted a notlced hearing to conslder
any protests or objections to the Reports of the Work.
NOW, THEREFORE, THE CITY COU~CIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOllOWS:
SECTION 1. That the Report of Work of the Superlntendent of
Streets heretofore fl1ed and above descrlbed, be and the same is hereby
conflrrred.
SECTION 2. That all of sald protests and obJectlons of every
klnd and nature to the repalrs or to the assessments and all appeals therefrom
to sald City Counell be and the same hereby are overruled and denled.
SECTION 3. That the cost of the repalrs, as set forth in said
Report, shall be assessed agalnst the propertles herein described, which
propertles front upon the lmprovement so constructed.

SECTION 4. That if such assessment 15 not paid with1n the t1me
per~ltted by law the same shall const1tute a spec1al assessment and llen
agalnst the propertles thereln descrlbed, In the amount set forth In sald
Report, WhlCh lien shall contlnue untll the assessment and all interest
thereon 1S pald.
SECTION 5. That lf the assessment 1S not pald wlth1n the tlme
perm1tted, the City Clerk shall dellver a Notlce of Lien. siqned by the
Superintendent of Streets, as provlded In Sectlon 5626 of the Streets and
Hlghways Code of the State of Callfornia, to the County Assessor and Tax
Collector, who, ln accordance wlth appllcable law, shall collect sald
assessment, toqether with all other taxes relating to such property.
SECTION 6. That the Clty Clerk shall certify to the adoption of
thlS Resolutlon.
