Introduction
This report requests the City Coune,l hold a Public Hearlng for the
assessment of eosts to repair damaged sl.dewalks, drlveways and curbs within
the Clty of Santa Monica and to adopt the attached Resolution confirming the
assessment of costs thereof.
Background
On Aprll 8, 1980, the City Councll set a Public Hearing for May 13, 1980,
on the assessment of costs to repalr damaged sidewalks, driveways and curbs
within the City of Santa Monica. Indlvidual letters stating the cost of thlS
lmprovement were mailed to each property owner on April 28~ 1980. Attached
is the Resolution No. 5547 (C.C.S.) setting the date of the Public Hearing
(Item 6-E).
Recomnendation
It ;s recommended that the Council:
1. Open the Public Hearing;
2. Close the PubllC Hearing and overrule any protests; and
3. Adopt the Resolution confirmlng the assessment costs.

TO CITY COUNCIL
REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYSt CURBSt AND/OR
REMOVAL OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF
DIVISION 7, CHAPTER 22, SECTIONS 5600 TO 5630, INCLUSIVE,
OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA.
(SR-80-4 )
Pursuant to the provisions of Division 7, Chapter 22, Sectlons
5600 to 5630, inclusive, of the Streets and Highways Code of the State of
Callfornia, the fOllowing work was caused to be done by the Street Superintendent:
The removal and replacement of 1,017 square feet of pec concrete
on sidewalks;
The removal and replacement of 377 square feet of PCC concrete on
driveways; and
The removal and replacement of 44 lineal feet of Type A curb.
The total cost of the work was $5,005.00, based on the following charges:
Removal and replacement of:
pee sidewalk. . . . . . . . . $3.00 / sq. ft.
PCC driveway . . . . . . . . . $4.00 / sq. ft.
Type A curb . . . . . . . . . $10.00 / sq. ft.
The total proposed assessment is 52,502.50, or 50 percent of the total cost.
The other 50 percent of the cost is belng paid by the City.
Reference is made to the attached sheets for a description of the
real property in front of which the work has been done, the proposed assessment

THE CITY COUNCIL OF THE CITY OF SANTA ~ONICA DOES HEREBY RESOLVE
AS FOLLOHS:
SECTION 1. That the Superlntendent of Streets will file a report
of work pursuant to Dlvlslon 7, Chapter 22, Sectlons 5600 and 5630 of the
Streets and Highways Code of the State of Californla, relating to the
construction of certaln lmprovements to sidewalks and drlveways.

SECTION 2. That pursuant to Section 5600 et seq. of said code
the City Counei1 does hereby order and declare that on the 13th day of t'lay,
1930, in_the Co~ncil C~a~bers of the City Hall, It wl1l hear and RPss upon
any and all objections or protests to the report of work of the Superlntendent

SECTION 3. That all protests or objectlons must be in wrlting and

Subject: Removal and Replacement of pce Sidewalk
Dear Property Owner:
You are hereby notified that the City Council of the Clty of Santa Monica,
on the 13th day of May, 1980, at the hour of 7:30 p.m., in the Councll
Chambers ln the Santa Monica City Hall, 1685 Main Street, will hear and
pass upon a report by the Street Superlntendent of the cost of the removal
and replacement of pce sidewalk as required by the City Council under
Division 7, Chapter 22, Sectlons 5600 to 5630 incluslve, of the Streets
and Highways Code of the State of Callfornia.
The total cost of the work at the above named location is $ .
The proposed assessment 1S $ , which 1S one half the total cost
of the work, and may be assessed by the City Council against said property
upon confirmatlon of the Street Superlntendent's report.
The above assessment is due and payable within 30 days after lts confirmation
on May 13, 1980, by the Council, or no later than June 12, 1980. If the
assessment is not paid by that date, the City has the right to file a lien
against the property in the amount of the assessment plus an administrative
fee. The Clty will provide assistance for low-to-moderate inco~e persons.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA CONFIRMING THE REPORT OF THE SUPER-
INTENDENT OF STREETS REGARDING REPAIRS TO DAr~GED
SIDEHALKS, DRIVCJAYS AND CURBS (SR-80-4 )
WHEREAS, the Street Superintendent of the City of Santa Monlca,
pursuant to Section 5600 to 5630 of the Streets and Highways Code, commenced
proceedlrgs to cause the repair of damaged s;dewalks~ driveways and curbs ;n
the City of Santa Monica~ and
WHEREAS, sixty (60) days after said order was served~ the work had
not been completed by the owners or persons in possession of the affected
properties, and the Superlntendent of Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets did file with the City
Councll of the Clty of Santa Monlca his reports of such work, and a hearing
thereon was called by Resolutlon No. 5547 (C,CoSo); and
WHEREAS, the City Council conducted a noticed hearing to conslder
any protests or objectlons to the Reports of the Work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Report of Work of the Superintendent of
Streets heretofore filed and above described, be and the same is hereby
conflrmed.
SECTION 2. That all of said protests and objections of every
kind and nature to the repalrs or to the assessments and all appeals therefrom
to said City Council be and the same hereby are overruled and denied.

SECTION 3. That the cost of the repairs~ as set forth 1n said
Report, shall be assessed against the properties herein described, which
propert1es front upon the improvement so constructed.
SECTION 4. That if such assessment 1S not paid with1n the
time permitted by law the same shall constitute a spec1al assessment and
lien aga1nst the properties therin described~ in the amount set forth
1n said Report, which lien shall continue until the assessment and all
1nterest thereon lS paid.
SECTION 5. That if the assess~ent 1S not paid with1n the
time permitted~ the City Clerk shall deliver a Not1ce of Lien, signed by
the Super1ntendent of Streets~ as provided in Sect10n 5626 of the Streets
and H1ghways Code of the State of Californla, to the County Assessor and
Tax Collector, who, in accordance with applicable law~ shall collect sald
assessment, together with all other taxes relating to such property.
SECTION 6. That the Clty Clerk shall cert1fy to the adoption
of this Resolution.
