Introduction
The City Council set a Public Hearing for the assessment of costs
to repair damaged sidewalks, driveways and curbs at various areas
within the City. It is recommended the Council adopt the attached
Resolution confirming the assessment of costs.
Background
On January 27, 1981, the City Council set a public hearing for
February 24, 1981, on the assessment of costs to repair damaged

sidewalks, driveways and curbs within the City of Santa Monica.
Individual letters stating the cost of this improvement were
mail ed to each property owner on Februar:J 11, 198!. Attached is
Resolution No. 6190 (CCS) setting the date of the Public Hearing
(Item 6-0).
Recommendation
It is recommended the City Council:
1. Open the Public Hearing;
2. Close the Public Hearing and overrule any protests; and
3. Adopt the Resolution confirming the assessments.

SUBJECT: Setting December 8, 1981, as the Date for
Public Hearing on the Assessment of Costs
to Repair Damaged Sidewalks, Driveways,
and Curbs (SR-81-21)
Introduction
This report requests the City Council set a public hearing for the
assessment of the costs to repair damaged sidewalks, driveways and
curbs.
B~ckground
On Octo ber 9, 1979, the Ci ty Counc il approved a sidewalk repair
program which provided for property owner participation in the
cost of repairing damaged sidewalks (Item 11-C). Property owner
participation was set at 50% of the cost of the repairs; the City
will pay the remaining 50% of the cost of the repair without
regard to the reason for the damage.
Certain repair work has been completed and the property owners'
share of the costs will now be due. A public hearing must be held
pursuant to provisions of Division 7, Chapter 22, Sections 5600 to
5630, of the Streets and Highways Code for the State of
California. A resolution setting the public hearing for December
8, 1981 is attached.

A RESOLUTION OF THE CITY COUNCIL OF
THE C!TY OF SANTA MON ICA SETTI NG A
HEARING DATE FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING
REPAIR OF SIDEWALKS, DRIVEWAYS AND
CURBS. (SR-81-21)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets
wi 11 file a report of repair pursuant to Section 5617 of
the Streets and Highways Code of the State of
Cal ifornia. relating to the construction of certain
i mprov emen ts to sidewalks and driveways all within the
City of Santa Monica.
SECTION 2. That pursuant to Section 5600 et
seq. of said code. the City Counc il does hereby order
and declare that on the 8th day of December, 1981, at
7:30 P.M., in the Council Chambers of the City Hall. it
will hear and pass upon the report by the Superintendent
of Streets of the cost of repair, together with any
objections or protests, if any. which may be raised by
any property owner liable to be assessed for the cost of
such repair and any other interested persons.
SECTI ON 3. That all protests or objections
must be in writing and filed with the City Clerk on or
before the time set for hearing of protests and
objections.

SECTION 4. The Superintendent of Streets is
hereby di rected to mail notices, in the manner and form
prescribed by 1 a'll, of the cost of repair and of the
adoption of this resolution to all persons owning real
property affected by the sidewalk assessment repair
program, whose names and addresses appear on the last
equalized assessment roll for the City taxes or as known
to the City Clerk.
SECTION 5. The City Clerk shall certi fy to
the adoption of this resolution and thenceforth and
thereafter the same shall be in full force and effect.
