SUBJECT: Setting December 22, 1981. as the Date
for Public Hearing on the Assessment of
Costs to Repair Damaged Sldewalks,
Dri veway s, and Curbs ISR-81-22)
Introduction
This report requests the City Council set a public hearing for the
assessment of the costs to repair damaged sidewalks. driveways and
curbs.
Background
On October 9, 1979, the City Council approved a sidewalk repair
program which provided for property owner participation in the
cost of repairing damaged sidewalks (Item 11-C I. Property owner
partlcipation was set at 50% of the cost of the repairs; the City
wi 11 pay the remaining 50% of the cost of the repair without
regard to the reason for the damage.
Certain repair work has been completed and the property owners'
share of the costs will now be due. A public hearing must be held
pursuant to provisions of Division 7. Chapter 22, Sections 5600 to
5630, of the Streets and Highways Code for the State of
Cal Hernia. A resolution setting the public hearing for December
22. 1981 is attached.

Recommendation
It is recommended the City Council adopt the attached resolution
setti ng a public hearing for December 22, 1981, on the assessment
of costs of the subject sidewalk repairs.

A RESOLUTION OF THE CITY COUNCIL OF
THE C!TY OF SANTA MONICA SETTING A
HEARING DATE FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING
REPAIR OF SIDEWALKS, DRIVEWAYS AND
CURBS. (SR-81-22)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets
wi 11 file a report of repair pursuant to Section 5617 of
the Streets and Highways Code of the State of
California, relating to the construction of certain
improvements to sidewalks and driveways all within the
City of Santa Monica.
SECTION 2. That pursuant to Section 5600 et
seq. of said code, the City Council does hereby order
and declare that on the 22th day of December, 1981, at
7:30 P.M., in the Council Chambers of the City Hall, it
wi 11 hear and pass upon the report by the Superintendent
of Streets of the cost of repair, together with any
objections or protests, if any. which may be raised by
any property owner liable to be assessed for the cost of
such repair and any other interested persons.
SECT! ON 3. That all protests or objections
must be in writing and filed with the City Clerk on or
before the time set for head ng of protests and
obj ecti ons.

SECTION 4. The Superintendent of Streets is
hereby, directed to mail notices, in the manner and form
prescribed by law, of the cost of repair and of the
adoption of this resolution to all persons owning real
property affected by the sidewalk assessment repair
program, whose names and addresses appear on the last
equalized assessment roll for the City taxes or as known
to the City Clerk.
SECT! ON 5. The City Clerk shall certify to
the adoption of this resolution and thenceforth and
thereafter the same shall be ; n full force and effect.
