Introduction
The City Council set a Public Hearing for the assessment of costs to repair
damaged sldewalks. drlveways and curbs at various areas within the Clty. It
is recommended the Coune11 adopt the attached Resolution conflrmlng the assess-
ment of costs.
Background
On July 22, 1980, the Clty Council set a Public Hearing for August 26. 1980,
on the assessment of costs to repalr damaged sidewalks. driveways and curbs
wlthln the City of Santa Monlca. Indlvidual letters statlng the cost of this
improvement were mailed to each property owner on August 11. 1980. Attached
is the Resolutlon No. 6049 (CCS) setting the date of the Public Hearing (Item 6-r1),
which was continued by Council to September 9, 1980.
Recorrmendatlon
It is recommended that the Council:
l. Open the PubllC Hearing,
2. Close the Public Hearing and overrule any protests; and
3. Adopt the Resolution conflrming the assessment costs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA SETTING A HEARING DATE FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE SUPERINTENDENT OF STREETS
REGARDING REPAIR OF SIDEWALKS, DRIVEWAYS AND CURBS.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. That the Superintendent of Streets will file a report
of work pursuant to Divislon 7, Chapter 22, Sections 5600 and 5630 of the
Streets and Hlghways Code of the State of California, relatlng to the construc-
tlon of certain improvements to sidewalks and drlveways.
SECTION 2. That pursuant to Section 5600 et seq. of sald code
the City Council does hereby order and declare that on the 26th day of August,
1980, in the Council Chambers of the City Hall, it will hear and pass upon any
and all Objections or protests to the report of work of the Superintendent of
Streets and the amount of the assessment assigned against the real property
described in sald report.
SECTION 3. That all protests or objections must be in writing and
filed with the City Clerk on or before the time set for hearing of protests and
obJections.
SECTION 4. The Street Superintendent hereby is dlrected to mall
notlces, in the manner and form prescribed by law, of the adoption of this
resolution to all persons owning real property affected by the s1dewalk assess-
ment repair program, whose names and addresses appear on the last equalized
assessment roll for the city taxes or as known to the City Clerk.
SECTION 5. The City Clerk shall certify to the adoption of this
resolution and thenceforth and thereafter the same shall be in full force and
effect. S

You are hereby notlfied that the elty Councll of the Clty of Santa Monica, on
the 26th day of August, 1980, at the hour of 7:30 p.m., In the Council Chambers
in the Santa Monlca Clty Hall, 1685 Maln Street, will hear and pass upon a
report by the Street Super1ntendent of the cost of the removal and placement of
pce sidewalk as required by the Clty Council under Divislon 7, Chapter 22,
Sections 5600 and 5630 inclusive, of the Streets and Hlghways Code of the State
of Ca" forni a.
The total cost of the work at the above named locatlon is $
The proposed assessment 15 $ , which is one half the total cost
of the work, and may be assessed by the Clty Council against sald property
upon conflrmation of the Street Superintendent's report.
The above assessment 1S due and payab1e within 30 days after its conflrmatlon on
August 26, 1980, by the Council, or no later than September 25, 1980. If the
assessment is not paid by that date, the City has the right to file a lien against
the property in the amount of the assessment plus an admlnistrative fee. The

REMOVAL OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF
DIVISION 7, CHAPTER 22, SECTIONS 5600 to 5630, INCLUSIVE,
OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF
CALIFORNIA (SR-80-6)
Pursuant to the prov1sions of Div1sion 7, Chapter 22, Sectlons
5600 to 5630, inclus1ve, of the Streets and Highways Code of the State of
Cal1fornia, the fol1owlng work was caused to be done by the Street Superlntendent:
The removal and replacement of 1,254 square feet of pee
concrete on sldewalks; and
The removal of 195 square feet of pee concrete.
The total cost of the work was 54,054.50, based on the following charges:
Removal and replacement of:
pec sidewalk. . . . . . . . . . . . . $3.00 / sq. ft.
Removal only . . . . . . . . . . . . . $1.50 / sq. ft.
The total proposed assessment is 52,027.25, or 50 percent of the total cost.
The other 50 percent of the cost lS being paid by the Clty.

the real property 1n front of which the work has been done, the proposed
assessment agalnst each property, and a descrlption of the work done 1n front
of each property.

SECTION 5. That If the assessment is not paid wlthin the time
permitted, the C1ty Clerk shall del1ver a Notice of Lien. signed by the
Superlntendent of Streets. as provided in Section 5626 of the Streets and
Highways Code of the State of California, to the County Assessor and Tax
Collector. who, 1n accordance with appllcable law, shall collect said
assessment, together with all other taxes relating to such property.
SECTION 6. That the City Clerk shall certify to the adoption
of this Resolutlon.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
. SANTA MONICA CONFIRMING THE REPORT OF THE SUPER-
INTENDENT OF STREETS REGARDING REPAIRS TO DAJmGED
SIDEWALKS, DRIVEWAYS AND CURBS (SR-80-6)
WHEREAS, the Street Superintendent of the Clty of
Santa Mon1ca, pursuant to Sectlon 5600 to 5630 of the Streets
and Hlghways Code, commenced proceed1ngs to cause the repa1r
of damaged sldewalks, driveways ana curbs in the C1ty of Santa
Monlca, and
l4HEREAS , Slzty days after sald order was served, the
work had not been completed by the o~ners or persons In possessio71
of the affected propert1es, and the Superlntendent of Streets
caused the work to be done; and ~
\'liHEREAS , the Super1ntendent of Streets did f1le with
the C1ty Counc11 of the City of Santa Monlca h1s reports of such
work, and a hearing thereon was called by Resolutlon Ko. 6049
(CCS) ; and
HHEREAS, the Clty COlli~c11 conducted a noticed hear~n9
to consider any protests or objectlons to the Reports of the Work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF S~~TA
MONICA DOES RESOLVE AS FOLLOWS:

SECTION 1. That the Report of Work of the Superintendent
of Streets heretofore flIed and above descrlbed, be and the same
is hereby confirmed.
SECTION 2. That the protest and Ob]ect1on of the owners
of the property at 2102 Mar~ne Street 1S hereby granted, and sald
owners are exempted from assessment, and that all other protests

asseSSQents and all appeals therefrom to said Clty COQicil be
and the same hereby are overruled and denled.
SECTION 3. That the cost of the repalrs I as set forth
in s aid Report I shall be assessed agalnst the properties descrlbed
thereinl which properties front upon the improvement so constructed.
SECTION 4. That if such assessment lS not paid wlthln
the tlme perrnltted by law the same shall constitute a speclal
assessment and lien agalDst the propertles therein descrlbed, In

the assessment and all lnterest thereon is paid.
