Refuse Rate Increase" dated !'-lay 20, 1980
Subsequent to the preparatlon of the report referred to above, staff has
developed more lnformatlon that should be considered in the declsion to
combine street cleanlng service wlth the refuse col1ectlon and dlsposal
enterprlse.
Rate Structure Alternatives
There are several approaches that may be considered in establishlng a revlsed
rate schedule to include street cleaning serVlces.
1. Increase the existing refuse rate structure approximately 25 percent
to cover increased refuse related costs as well as street cleaning
co s ts .
2. Design a separate billing system that wlll charge each property
owner thelr share of the street cleaning costs based on the amount
of street curb frontage for each property.
3. Increase the fines for violations of parking restriction during
5 treet sweepi ng .
Analysis of Rate Structure Alternatives
Increaslng the eXlsting rate structure for refuse services to include street
cleaning costs (as proposed in the orlginal report) has several advantages.
1. Administrative costs af lmplementlng the new fees would be
neg11gible as all that would be required is a few simple coding
changes in the existing computer program.
2. A separate b1l11ng system would not need to be designed and the changes
could be lmplemented much more quickly. The revenue and expendlture
projections have been all made assuming July 1 implementatlon.

The disadvantages are:
1. Some lnequities will eXlst in the amount of serVlce actually
received by a property and the amount charged.
2. Cltlzens would not be able to ldentify a separate street cleaning
charge as the fee for refuse and street cleaning would be
comblned.
Using a separate rate structure for street cleanlng based on the curb front-
age for each property has been proposed and has the following advantages:
1. Charges for street cleaning services wlll be more closely related
to the quantity of service recelved by the property owner.
2. There wlll be a clear distinction as to the fees paid for refuse
services and street cleaning services.
The major disadvantage of th1S fee approach is the cost and tlme involved in
determining the approprlate rate (based on curb frontage) for each of approx-
1mately 15,000 propertles ln the Clty. Preparat10n of such a billing system
may cost $15,000 - $20,000 and take several months to develop. Another
dlsadvantage lS that lnequlties may occur in this system relatlng to the
amount charged compared to the amount of street refuse generated.
An ent1rely dlfferent approach 1S to cons1der 1ncreaslng flnes for park1ng
vlo1ations of the "No Parking during street sweepingl' ordlnance.
Currently
approxlmately 8,000 vlo1atlons per month for street sweeplng are issued. Of
these b,OOO, approximately 4,500 are ultimately collected. This produces
$270,000 annually. An increase ln the current flne of $5.00 to $10.00 per
vlolatlon would probably generate at least an addltional $200,000. This
would result 10 a total revenue of $470,000 which would be sufficient to

cover the cost of street cleaning as well as the enforcement of parking vlola-
tions. The staff does not recommend mak1ng changes in the flnes, nor comblnlng
enforcement w1th provlding sanitatlon services. Currently the fines provIde
suff1cient revenue to pay for enforcement plus adm1nistration and overhead.
Decislon Alternatives
The rate lncrease may be implemented using any of the rate structures described
above Staff 1S prepared to immedlately Implement a 25 percent increase in the
eXlstln9 refuse rates as shown in Exhiblt A of the original report. The other
alternatives for recovering costs for street cleanlng will requlre staff research
and cannot be lmplemented immedIately.
Recommendatlon
Staff recommends that CouncIl approve Alternative No.1 descrlbed in the
orIginal report. ThlS alternative provides for comblnlng the street sweeping
program wlth the refuse enterprise. A 25 percent lncrease in refuse rates will
be required to cover increased costs.
If it is Council IS desire to use a separate billlng structure for street cleaning
services, it is recommended that the refuse rate increase as shown in Exhlblt A
be adopted lmmediately to provide the necessary operating revenue along w1th
lnstructlons to Staff to return to CouncIl wIth a rate structure proposal based
on actual curb frontage or some other basis. This proposal would be submitted
to Council within six months.
Attached is a proposed ordlnance in both regular and emergency form repealing
Sectlons 5233A and 5233B of the SMMC. Also attached are two verSlons of a
resolution provid1ng for revised fees for refuse collectlon and disposal serVlces.

MJ ORDINANCE OF THE CITY OF SANTA f-10NICA At.1ENDING
SECTION 5233A OF CHAPTER 2, ARTICLE V, OF THE SANTA
MONICA MUNICIPAL CODE IN ORDER TO INCREASE THE AMOUNT
OF FEES CHARGED FOR GENERAL CITY REFUSE COLLECTION.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN
SECTION 1. Sectlon 5233A of Chapter 2, Artlcle 5, is amended
to read as follows'

Any provlsions of the Santa Mon1ca Munlclpal Code,
or appendlces thereto lnconsistent herewlth, to the extent of such lnconSlS-
tenc1es and no further. are hereby repealed or mod1fied to that extent
necessary to effect the provislons of thlS ordinance.
SECTION 3.
If any section. subsection, sentence, clause or
phrase of thlS ordlnance 1S for any reason held to be lnvalld or unconst;-
tutlonal by a dec1s1on of any court of competent Jurlsdlction. such declslon
shall not affect the valldlty of the remainlng portions of the ordinance.
The City Council hereby declares that lt would have passed this ordirance
and each and every sectlon, subsectlon, sentence, clause or Dhrase not
declared lnvalld or unconstitutional without regard to whether any portlon
of the ordinance would be subsequently declared inva11d or unconstltutlonal
SECTION 4.
The Mayor shall Slgn and the City Clerk shall attest
to the passage of thlS ord1nance. The C1ty Clerk shall cause the same to
be publlshed once 1n the offlc1al newspaper within flfteen (15) days after
lts adootlon. The ordinance shall become effectlve after thlrty (30)
days from 1ts adoption.
