This report will present a brief description of the present litter removal ordinance and enforcement procedures and will recommend that an additional section be added to the code that will provide for emergency litter removal. Background Section 2800F of the Municipal Code (copy attached) provides that the owners of private property within the City shall maintain the property in a litter free condition. Section 7800F also provides an enforcement procedure whereby: (1) The D1rector of General Services notifies the property owner of the litter violation. (2) The property owner is requested to remove the litter w1thin ten days from the date of the receipt of the notice. (3) If the litter is not removed w1thin the ten-day period, City forces will be directed to perform the litter cleanup with the cost of this work being charged to the property owner. This procedure is workable and when enforced is effective in abating litter accumulat10ns on private property. " JAN 9 '979 ~ . . ~ . To: Mayor and City Counc11 -2- December 22, 1978 However, there are occasions when for the reasons of human safety a litter problem should be abated immediately. Examples of such conditions might be where old furniture or appliances have been discarded 1n such a manner as to present a traffic hazard to either vehicles or pedestrians or a hazard to children, or where the litter is composed of hazardous or noxious substances. It 1S proposed that a section be added to the Code that would prov1de for emergency litter removal. Such a sectlon (draft attached) would define what constitutes an emergency situation and after designation by the City Manager would allow City employees to immediately remove the dangerous or hazardous litter accumulation and bill the property owners, if appropriate. Recommendation Staff recommends that the City Council authorlze the City Attorney to prepare Ordinance amendments that will provide for emergency removal of litter from private property by Clty forces. Emergency Litter Removal Notwithstanding any other provision of this Chapter with reference to the removal of litter from private property~ whenever the Clty Manager determines that an accumulation of litter is dangerous to human life and such condition constitutes an immediate hazard or danger~ he shall~ without observing the provisions of this Chapter with reference to removal p~ocedures, immediately and forthwith effect the remova1 of such litter. Where such condltion exists, and the removal is immediately required, the City Manager shall comply with the provisions of Section 7800H which refers to charging costs of such removal work to the property owner.
