Background On July 25, 1978, a public hearing was held on the proposed improvement. and the objections that were made were overruled. The affected property owners are to pay all costs of the improvement. They will have 60 days after the adoption of this resolution to do the work themselves. If they do not elect to do the work, the City will advertise for bids. The Staff will recommend to the City Council that a contract be awarded to the low bldder. at which time the City must provide interim financing in the approximate amount of $34,000 to cover the contract. The property owners must then repay the City. Recommendation It is recommended that the City Council adopt the attached resolution ordering the work for the reconstruction of Tenth Court between Olympic Boulevard to 450 feet North of Olympic Boulevard. ~ ~ Prepared by: Attachment. WHEREAS. a Public Hearing was held on July 25. 1978 on said work to he done. and all objections and protests to the proposed work to be assessed were heard and considered by the City Council and were overruled; NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Santa fjonica hereby orders the work described in said Resolution of Intention to he done in Tenth Court between Olympic Boulevard and 450 feet Northwesterly of Olympic Boulevard within the City of Santa Monica. SECTION 2. Reference hereby is made to said Resolution of Intention No. 5039 for a description of the work and for further particulars. SECTION 3. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall he in full force and effect. ADOPTED and APPROVED this 8th (lay of August . 1978. . . The proof of posting and mailing was ordered flIed by Mayor Swink. Mayor Swink ordered the public hearing opened at 8:12 P.M. Messrs. Marcel George and Jerome Pearlman spoke in opposition to the proposed reconstruction. Alys Drobnick spoke in favor of the proposed reconstruction. There being no other requests to address the Council, the public hearing was ordered closed by Mayor Swink at 8:18 P.M. Mayor Pro Tempore Cohen moved to overrule the protests and authorize staff to prepare a resolu- tIon ordering the work to be accomplished for presentation at the CounCIl meeting to be held August 8, 1978.
