SubJect: Proposed Concrete Gutter Construction On Second Street and
Fourth Street Between Colorado and Broadway (G-80-3)
Introduction
This report requests that City Council hold a publ ic hearing for construc-
tlon of concrete gutters on Second Street and Fourth Street between Colorado
and Broadway and to adopt the attached resolution under the provisions of
Chapter 27 of the Improvement Act of 1911.
Background
The City Counc11 at its meeting on March 25, 1980. adopted Resolution of
Intention No. 5542 for this gutter construction (Item 6-T). This
resolution set a public hearing for April 22. 1980. Notices were posted
along Second Street and Fourth Street. Written notices were mailed to the
property owners abutting the proposed project. designating the time and date
of the hearing and the approximate cost to each owner.
The City wl11 invite bids and award the contract for the construction to the
lowest responsible bidder. The estimated cost to the property owner is
$5.00 per front foot.
The property owners may do the construction work themselves. Those property
owners who wlsh to perform their OWn work must commence the work withln 60
days from the date of adoption of the resolution ordering the work. If the
work is done by any property owner. there will be no assessment to that
property.

Recommendation
It is recommended that the Clty Council:
1. Hold the public hearing in accordance with the Resolution
of Intention No. 5542 (CCS).
2. Close the public hearing; and
3. Adopt the attached resolution ordering the work.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DECLARING ITS INTENTION TO CONSTRUCT GUTTERS
ALONG SECOND STREET AND FOURTH STREET FROM COLORADO
AVENUE TO BROADWAY. ALL WITHIN THE CITY OF SANTA MONICA
WHEREAS. the City Council of the City of Santa Monica is empowered
by Section 5870 et seq. of the Streets and Highways Code of the State of
Callfornla to construct gutters at various locations w;thln the City of
Santa Monica;
NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA ~DNICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires and it is the inten-
tlon of the C1ty Ccunell of the City of Santa ~onica to order the followlng
work to be done, to wit:
The construction of concrete gutters along Second Street
and Fourth Street from Colorado Avenue to Broadway. all
in the City of Santa Monlca.
The estimated assessment cost of the improvement is $5.00 per front foot.
SECTION 2. That said proposed work or improvement in the oplnion
of the Clty Council of the City of Santa Monica is of more than local or
o~dinary public benefit. and said Council hereby proposes that the dlstrlct
1n the City of Santa Monica to be benefited by sald work or lmprovement and
to be assessed to pay the cost and expense thereof, includes all of the
property abutting Second Street a~d Fourth Street from Colorado Avenue to
Broadway.
SECTION 3. Notice hereby is given pursuant to said Section 5870
et seq. that on April 22, 1980, at the hour of 7.30 p.m. In the CounCl1
Chambers in the City Hall of sald Clty of Santa Monica, situated at

1685 Main St. in said City, any and all persons having any objections to
the proposed work or improvement shall file a written protest wlth the
City Clerk and may appear before the Clty Council and show cause why the
said proposed work or improvement should not be carried out in accordance
with said Resolution of Intention.
SECTION 4. The Superintendent of Streets lmmedlately shall
cause to be conspicuously posted along the line of sald contewplated
improvement notice of the passage of thlS Resolution of Intention in the
manner and form prescribed by 7aw.
The City Clerk hereby is directed to mail notice, in the manner
and form prescrlbed by law, of the adoption of this resolution to all
persons ownlng real proDerty in the hereinbefore descrlbed assessment
distrlct, whose names and addresses appear on the last ecualized assessment
roll for City taxes or an known to the City Clerk.
SECTION 5. The City Clerk shall certify to the adoption of this
resolution and thenceforth and thereafter the same shall be in full force
and effect.

At a regular meeting held on March 25, 1980, the City
Council adopted Resolution No. 5542(CCS) declarIng the
Intent to construct concrete gutters on Second Street
and Fourth Street from Colorado Avenue to Broadwav In
the CIty of Santa ~Ionica. (Gutter Construction DIstrIct
#G-sn-31.
The estimated assessment cost of the gutter constructIon of
$5.00 TIer front foot will be assessed to the distrIct bene-
fIting" fron the improvement. ThIS includes all of the
property abutting Second Street and Fourth Street from
Colorado Avenue to Broadway.
In order for any and all persons objecting to the proposed
gutter construction to have the opportunity to address the
CIty CounCIl, a public hearing has been set for April 22,
1980, at 7.30 P.M. to be held in the Council Chambers,
City Hall, 1685 ~ain Street, Santa Monica, California. A
copy of ResolutIon No. 5542[CCS) is attached for your
information.
This letter and resolution are beIng mailed to all property

MONICA ORDERING THE CONSTRUCTION OF CONCRETE GUTTERS ON
SECOND STREET AND FOURTH STREET BETWEEN COLORADO AVENUE
AND BROADHAY.
WHEREAS, the City Counc11 of the City of Santa Monica, on the
25th day of March, 1980, passed and adopted its Resolution of Intention,
being Resolution No. 5542 (City Council Series), to order the work described
therein to be done, which in accordance with said Resolutlon of Intention
duly and legally not1ces were posted along the line of the proposed project
and wr1tten notices of said improvement have been given 1n the manner requlred
by law and any and all written objections and protests to the work or the

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES

gutters described in said Resolutlon of Intention to be done along Second
Street and Fourth Street between Co1orado and Broadway within the City of
Santa Monica. That all of said protests and object1ons of every kind and
nature to the proposed work or to the extent of the district to be assessed
be and the same hereby are overruled and denied.
SECTION 2. That Street Superintendent hereby lS directed to commence
the construct1on of concrete gutters above described after a 50-day period
wherever the property owners have not started the gutter construction
themselves.
