Background
The attached ordlnance lncorporates the reconrnended
lnCreases In the charge per month for on-site refuse collectlon.
The attached ordlnance lncreases the charge per
month from $2~50 to $5~40 for t~lce weekly collectlons,-and
fron $7~50 to $18.00 per month for dally collectlons~

JIunlc~oal Code 15 hereby amended and shall read as follows:
"Sectlon 5228D. REllTAL OF
RECEl?TACLES FROH CITY. Notwithstandlng
the provlslons of Sectlons 5228, 5228A,
5228B, and 5228C, upon appllcatlon by
the owner, manager or authorized agent
of the owner of a~y place of bU51ness,
multlple dwelling, or apartment house
and upon the payment of the fees herelnafter
prescribed, the Dlrector of Publ1C Works
may provlde a metal bln or blDS, lnsofar
as such receptacles are avallable at the

Sectlon 5233D of thlS Chapter. Non-paYillent
shall terilll~ate the obllgatlon of the
Clty to prov1de or to cont1~ue to prov1de
such serVlces or receptacles.
All receptacles
so furn1shed s~all be and re~aln the property
of the C1ty.
The owner, manager, or authorlzed
agent of the owner of the premlses descrlbed 1n
the appllcation shall be responslble for any
damage to the receptacle other than normal wear
and tear.
SECTION 2.
Any provlslons of the Santa Monlca
MunlClpal Code, or append~ces thereto 1Dconslstent herew~th,
to the extent of such 1nconslstencles and no further, are

hereby repealed or mod~fied to that extent necessary to
effect the prov~5~ons of thlS ord~nance.
SECTION 3.
If any sectlon, subsectlon, sentence,
clause or phrase of thlS ordlnance 1S for any reason held to
be inval1d or unconstitutlonal by a declSlon of any court of
co~?etent Jurlsdlctlon, such ceclslon shall not affect the
valldlty of the remalnlng portlons of the ordlnance. The
Clty Council hereby declares that It would have passed thlS
orClnance and each and every seetloD, subsectlon, sentence,
clause or nhrase not declared lDvalld or unconstltutlonal
wlthout regard to whether any port~on of the ordlnance would
be subsequently declared lnvalld or unconstltutlonal.
SECTIO~ 4.
'I'he L-iayor shall slgn and the City
Clerk shall attest to the passage of this ordl~ance. The
Clty Clerk shall cause the saQe to be published once In the
offlcial newspaper wlthln flfteen (15) days after lts adoptlon.
The ordlnance shall become effectlve after thlrty (30) days
from its adoptlon.

INTfWDUCTlON
This report tr~nsmits background information to support a request that the
t-esponsibi1ity for drivev;ay size, location, and general layout be b~ansferred
fro~ the Street Superintendent to the Traffic Engineer and that certain changes
be made in the Santa Konica Municipal Code to facilitate enforce~ent and to
update and modernize the Code in this area.

Historically in the City of Santa ~onica, the responsibility and authority
for approving driveway construction, location, size, and general layout has
been that of the Street Superin~cndent, while the Traffic E~gineer has had the
responsibility for parking layouts and traffic flow. This mea~s that
different a('eas of t~e same function are approved by diffet'ent people \'Iith~
perp3.p5, different v;e1,.'s. These requh'e,nents are set forth in the j-!unicijJal _
Code and thus cannot be c~ang2d adQinistratively.
TI12(e are many situatiol1s \'1here the I:unicipal Coce pt'ovision does not apply
to s itua ti ons actually encountered in the fi e 1 d ~ or if app 1 i cab 1 e, does not
produce an adequate remedy for the situation. It is believed that in the
b~st interests of service to the citizens, th-e total responsibility and
authDrity should be placed in one City official.
