SUBJECT: Proposed Concrete Gutter Construction on Eleventh Street
Between Santa Monica Boulevard and Olympic Boulevard
Introduction
This report requests Clty Council hold a public hearing for
construction of concrete gutters on Eleventh Street between Santa
Monica Boulevard and Olympic Boulevard and to adopt the attached
resolution ordering the work under the provisions of Chapter 27 of
the Improvement Act of 1911.
Background
The City Council at its meeting on June 9, 1981, adopted
Resolution No. 6275 (CCS) setting a public hearing for July 14,
1981 on the gutter construction.
Written notices were mailed to
the property owners abutting the proposed project, designatlng the
time and date of the public hearing, on July 2, 1981. Notices
were posted along Eleventh Street as required on July 6, 1981.
The City will invite bids and award the contract for the
construction to the lowest responsible bidder. The estimated cost
to the property owner is $8.50 per front foot. As an alternative,
the property owner may do the construction work himself. Those
property owners who wish to perform their own work must commence
the work within 60 days from the date of adoption of the
resolution ordering the work. If the work is done by a property
owner, there will be no assessment to that property.

Recommendation
It is recommended City Council:
1. Open the public hearing;
2. Close the public hearing and overrule any protests; and
3. Adopt the resolution ordering the work.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA ORDERING THE CONSTRUCTION OF
CONCRETE GUTTERS ON ELEVENTH STREET BETWEEN
SANTA MONICA BOULEVARD AND OLYMPIC BOULEVARD,
ALL WITHIN THE CITY OF SANTA MONICA.
W~EREAS. the City Council of the City of Santa ~onica, on the
9th day of June, adopted Resolution No. 6275 eCCS} setting a publiC hearing:
WHEREAS. written notices of said improvement have been given in
the manner required by law, and
WHEREAS. any and all written objections and protests to the work
or the extent of the district to be assessed were heard and considered by
the City Council;
NOW, THEREFORE, THE CI~Y COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLO~~:
SECTION 1. Thnt thE punlic convenience and necessity require
the construction of concrete gutters along Eleventh Street bet\~en Santa
Monica 30ulevard and Olympic Boulevard, all Wlthin the City of Santa Monica.
SECTION 2. That all protests and Objections of every Klnd and
nature to the construction of concrete gutters on Eleventh Street between
Santa Monica BDulevard and Qlympic Boulevard, all ~~thin tne City of Santa
Monica, be and the same are hereny overruled and denied.
SECTION 3. That pursuant to Streets and 81ghways Code Section
5880, the Street SJperintendent is directed to commence the construction of
concrete gutters above described if the construction is not commenced and
prosecuted to completion with due diligence by any property owner as required
by Streets and Highways Code Section 5879.
