Introductlon
Th1S report recommends the formatlon of an assessment district to construct
concrete gutters on Eleventh Street from Santa Monlca Boulevard to 01ymp1c
Boulevard. It also requests the Council to set a public hearlng for July 14.

Background
Many of the streets 1n Santa Monica were constructed without concrete gutters
dur1ng the period from 1920 to 1950. The asphalt pavlng at the gutter llne
has severely eroded and is a cont1nuous maintenance problem on these streets.
Since 1965 the City has constructed concrete gutters on most streets
as a part of the resurfacing program. The most recent streets where
this was done are Broadway and Colorado from Ocean to Lincoln, and Main Street
from P1CO to Hollister.
Because of the large number of streets which require improvements and because
the amount of repair work which can be done uS1ng gas tax funds has been severely
eroded by inflation. the staff believes lt 1S necessary to assess tne costs of
the gutters to property owners, and to retaln the POllCY of the City paying
for the resurfacing with gas tax funds. It should be noted that the staff has
been requiring concrete gutters to be 1nstalled by developers since 1978 as a
condit1on of approval.
The Improvement Act of 1911 provides methods whereby all improvements includ-
ing resurfacing, street lights, street trees, curbs. sidewalks. gutters,

sewers, and other improvements may be assessed to abutting property owners.
The estlmated assessments wlll be $8.50 per foot or $ 425 for a typical
lot on Eleventh Street ( 50 ft. frontage) based on recent blds by
private contractors.
Recommendat ion
It 1S recommended the Council adopt t~e Resolutlon of Intentlon settlng a
Public Hearing for July 14, 1981.

A RESOLUTION OF THE CfTY COUNCIL OF THE
CITY OF SANTA MONICA INSTRUCTING THE
SUPERINTENDENT OF STREETS TO GIVE NOTfCE
TO CONSTRUCT GUTTERS TO PROPERTY OWNERS
ALONG ELEVENTH STREET FROM SANTA MONICA
BOULEVARD TO OLYMPIC BOULEVARD, ALL WITHIN
THE CITY OF SANTA MONICA
WHEREAS, there is a need to construct concrete gutters along Eleventh
Street from Santa Monica Boulevard to Olympic Boulevard, all within the City
of Santa Monica; and
WHEREAS, in accordance with Section 587Q et seq. of the Streets and
Highways Code procedures exist to notlfy property owners of their duty to
construct or cause to be constructed
the concrete gutters and to permit
the Superintendent of Streets to construct the concrete gutters if not con-
structed or caused to be constructed by the property ownerS; and
WHEREAS, the City Council of the City of Santa Monica on ltS own motion
may order the construction of the concrete gutters;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE
AS FOLLOWS:
SECTION 1. Pursuant to Section 5875 of toe Streets and Highways Code,
the City Council of the City of Santa Monlca orders the construction of con-
crete gutters along Eleventh Street from Santa Monica Boulevard to Olympic
B.ou1evard.
SECTION 2. Pursuant to Section 5876 of the Streets and Highways Code.
tne Superlntendent of Streets shall notify, fn the manner required by law,
the owners of property along Eleventh Street from Santa Monica Boulevard to
Olympic Boulevard to construct or cause to be constructed concrete gutters.

The notice shall contain the lnformation required oy Section 5879 of the
Streets and Highways Code and shall also specify the day, hour and place,
as set forth in Section 3 of this Resolution, where the City Council of the
City of Santa Monica will hear and pass upon objections or protests, if any,
which may be raised by any property owner or other interested persons.
SECTION 3. That pursuant to Section 5878.1 of the Streets and Highways
Code, the City Council of the City of Santa Monica does hereby order and
declare that on the 14th day of July, 1981, at 7:30 P.M., in the Council
Chambers of Clty Hall. it w111 bear and pass upon oejections o~ p~otests,
lf any, which may be ralsed by any property owner or other interested person.
SECTION 4. The City Clerk shall certify to the adoption of this resolu-
tion and thenceforth and thereafter the same shall be in full force and effect.
