A.. r- 1-1!1 jUl 26198'8 CA:RMM:emd015/hpw City Council Meeting 7-26-88 Santa Monica, California SUPPLEMENTAL STAFF REPORT TO: Mayor and city council FROM: City Attorney Ordinance Adding Chapter 2B to Article VII of the Santa Monica Municipal Code Restricting the Amount of Wastewater Permitted to be Discharged into the Santa Monica Sewer System and Declaring the Presence of an Emergency SUBJECT: Section 7191 has been added to the proposed emergency ordinance restricting the amount of wastewater permitted to be discharged into the Santa Monica sewer system. This new section regulates the transfer, expiration, and extension of City permits and approvals. This Section has been added to deal with three problems. First, it is designed to prevent a market being created in the trading or sale of sewer allocation permits. It does this by making the permits nontransferable. Second, this Section establ ishes expiration dates for the sewer allocation permits. By creating expiration dates for the permits, projects will not tie up sewer capacity if they are unable to go forward. Permits will expire within 90 days after they are issued unless the project obtains a building permit entitling it to commence construction. In addition, the permit will expire whenever the building permit expires if construction does not commence. - 1 - A.o ~" ~-~ JUL 26 1988 Lastly, this section recognizes that there may be instances when city approvals or permits will expire while a project waits for a sewer allocation permit. So as to avoid this result, this Section makes clear that these other city approvals or permits shall be extended by the period of time that a project is on any sewer allocation permit waiting list.
