Ordinance to Require Business to Rent Refuse Bins
Introduction
ThlS report requests City Councll direct the City Attorney to prepare an
ordinance WhlCh authorizes the Dlrector of Gene~al Servlces to require a
business to use a refuse bln lf conditions warrant bins.
Background
t1uniclpal Code Sectlon 5233 D2 does not prov1de any authorlty to requlre the
use of a refuse bln. Under Municlpal Code Sectlon 5228E, the Director of
General Servlces may reqUlre apartment houses with eleven or more units to
have blns. Other buslnesses are not subject to the mandato~y equlpment
reqUlrement and may use the types of refuse contalners descnbed in nunicipal
Code Sectlon 5228.
Presently, the C1ty lS experiencing a long-standlng problem with one par-
ticular business which does not use blns. The garbage 15 not ma1ntained
properly and creates a public nUlsance and eyesore on the parkway for the
resldential nelghborhood abuttlng the business. This problem is not unique
to thlS one buslness, but in most instances the City is able to negotlate
a solution to the problem. However, there are circumstances when the
bUSlnesses refuse to cooperate with the City. Staff belleves that the
Dlrector of General Services should be glven the authority to require
businesses to use trash blns lf, in hlS opinlon, the businesses are not
maintalning thelr garbage in a safe and clean manner.
