Background On Apr~l 11, ~985 the Californ~a Depar~ment of Health Serv~ces re~~ased ~ts evalua'tion of pa~en~aa~ r~sks to h~tman hea~~h from consuming f~.sh in 5a?~ta Mor~ica Eay - Palos Uerdes area (attached), The area of przmary ^onc~rn ~.s th~ o~ear~ area rang~~g from Gerald Desmand Bridge and Cabrillo Pzer in the south to Veni~e Pzer zn the nor~h, a~d particularly 'the area around the White Point Outfal~ off of the Palas V~rdes Penznsu~a. That is an official statement. As private citizens we are very unhappy wi.th the ~ery erude and pr~mitive way that City Manager Jahn Jali}.l is attempting to cover up for the Mayor and Gity Counci}. by sh~fting the name on these signs to the tirder of the State Health Depart- ment ar to the L.A. Cotanty Health Departr~ent. Itz 198~ by ac~ of U.S. Congress amending EPA law, it mandated that the City of San- ta Monica be ttle monxtoring agency or the iead agency for the westside Bay area. Clearly responsibil~tiy is tihe salely the City of Santa Manic~'s. The City Council ahd the Mayar ha~e in fact dragged their feet since 19$0. It should be noted that zn the ~etter the Mayor wrote me dated Apr~l i5, 1985, she admitted that in fact in the pas~ we ha~e had discussions about the Santa Man~- ea Bay. Actual~y going back ta 1980 when I first mentioned the - 3 - ~ ` ~ * ~ at risk factor of carcinogenicty ta young fema].es, pregnant fe- mal.es and young males and females under age 18. For every tirne I have tried to bring this issue up~ the City Council has in fact shUt off debate. This ha~ been done both by both fact~.ans o~t the Cauncil~ the SMRR {he said "Smear") grovp and the Ail Santa Moni- ca Coalition. Further it should be noted that for every minute at every Council session, the Evening Ovtlook has had a reporter but has in fact done nothing. I wauld tend to questian their credibility as a newspaper because af this. On the Hyper~on plant~ Madam Mayar, it is the ~zerra C].ub that has filed a law- suit against Chevron U.S.A, a~d it does strikE me as a bit odd and quite frankly rather peculiar that Mayor Reed was on the Metropolitan Quality Water Management District and knew about it as far back as 197b when the EPA began testing the Santa Monica Bay. And it is in fact the Sierra Club'S Legal Counsel Debbie Reams Csp??) that lzas filed and pursued the lawsuit~ and quite frankly w~uld appear that the City af Santa Mlonica wil]. be next. Further, we feel the that City Council, but especially Mayor Reed zs indictable at the Federal level for ~ultiple en~iron~nenta~ health quality law violations, mtach the same as Rita Leville (sp??) and Ann Gorsage (sp?), far which she could get ~ossibly up ~4 30 months ir~ federal prison. Cm Edwards: Excuse me, Mr. Hall, what is your saurce of a, that is your own hanciwriting, what is the saurce of that repart? Did yau get that ou~ of a S~erra Club newslet'ter or something? I want ~o know what the City is covering up, and I want to know what data you - have to back it up. Wayne Hail: Well, Councilmember Epstein, if you look at the official records with the City Clerk, akay, there is a~ entiire fo~der of data on f~ie that I have been submitting for the past three years. - ~ - ' .- . ~ ~ Cm Epstein: ~ell me what the City is covering up? Wayne E~all: Scholl, the General Sertr wrote that report on the did testing at the Arain no PCB's or DDT, but yet past 4 years it shows up Very ciearly~ in 198D, Mr. Stan ices Director, was on the Commission tnat Pico-Kentor (sp??) Drain Basin. They Basin and at the surf line and they find by tne State's awn reparts, for like the in the testing of the samples. Cm Epstein: So what these charges are about are storm drains? Wayne Hall: Well, ob~iously there is ~he credibility factor there samewhere. Wayne Hall: We~l, they do nat indica~e in ~heir reports ather than at the outfall areas where they ha~e done testing so far. Right now, State Ass~mblyman Tom Hayden is at- tempting to get the money in the State Assembly to do that testing. Cm Conn: Madam Mayor, point of proeedure. But I think this is getting to somewhat of an excess, an~ I think if Mr. HaZ~ is going ~o eQntinue to come up and tialk aba~tt indictable offenses about,cover-ups then I would prefer that he say these statements under oatih, ~eaause I think that nothing degrades go~ernmeRt or tne reputation of indYVi.dua2s in gQVern- ment more than the impliaatian that there is somehow wrflrrgdoa,ng and that t~e public trust has been placed in that persan is being abused, ar~d I don't think public officials have to take ~hat. Larry ~,acambe, as our water quality chairman, has been follok*ing this issue and could provide you with the specifics of Sierra Club general policy on ocean dumping and toxics problems as it relates to the Clean Water Ac~.
