Dlscharge Shut-Off Systems for all
BUlldlngs wlth Refuse Collectlon Chutes
Introductlon
ThlS report transmlts the attached ordlnance for
second reading and adoptlon.
Background
The Clty Council requested the Clty Attorney to
draft the attached ordinance at ltS meetlng of November 22,
1977. The attached ordinance was gIven a first readlng
and publlC hearlng was held thereon on December 13, 1977.
The attached ordlnance requlres all owners of multlp1e
resldentlal dwelllngs contalnlng In excess of ten unlts
to discontlnue the use of garbage cans and to utIllze
rubblsh blns provlded by the City. The ordlnance further
requlres that all bUl1dlngs equlpped wlth refuse collectlon
chutes also provlde dlscharge shut-off systems for such
chutes. In the case of new bUlldlngs, such shut-off
systems must be provlded at the tine of constructlon;
In the case of eXlstlng bUlldlngs, such shut-off systems

must be prov1ded W1th1n SlX months from the effect1ve
date of the attached ordlnance.
In the event that the
shut-off system 15 not so provIded, the C1ty may refuse
to collect rubb1sh from the slte.
with regard to both of the requlrements of the
attached ord1nance, hardshlp cases may be processed
through the Llcense ReVlew Board WhlCh, If lt flnds a
hardshlp to eX1st, may walve the requlrements of the
ordInance 1n 1nd1vidual cases.

RecommendatIon
It 1S respectfulJy recommended that the Clty
council introduce the attached ord1nance for second readIng
and adopt the same.
