Mayor and City Councll FROM: Clty Attorney SUBJECT Ordlnance Establishlng Supplemental Procedures for In5tltutlng ReSldentlal Street Llghting Improvements At its meetlng on August 4, 1981 the Clty Cauncll lntroduced for flrst readlng an ardlnance estab11shlng supplemental procedures for lnstltutlng resldentlal street llghtlng lmprovements. At 1 ts meetlng on January 17, 1984 the Clty Councll dlrected the Clty Attorney to return the ordlnance to the Clty Cauncll for flrst readlng. Background materlals on the ordlnance are contalned ln Attachments 1 and 2. RECOMMENDATION It 15 respectfully recommended that the accompanYlng ordlnance be lntroducted for flrst readlng. CA:R~M;rm7160 Councll Meetlng 2-28-84 Santa Monlca, Callfornla ORDINANCE NUMBER (Clty Councll Serles) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING SUPPLEMENTAL PROCEDURES FOR INSTITUTING RESIDENTIAL STREET LIGHTING IMPROVEMENTS WHEREAS, there eXlsts ln many multlfamily nelghborhoods In the C1ty of Santa Monlca the need for street llghtlng; and WHEREAS, tenants in these nelghborhoods deslre the Clty Councll of the City of Santa Monlca to provlde street llghtlng in these nelghborhoods; and WHEREAS, the Clty of Santa Monlca 1S unable to provide street llghtlng wlthout utlllzlng the procedures of the Improvement Act of 1911 WhlCh flnances the costs of street lightlng lmprovement through assessments agalnst real property benefltted by the assessments; and WHEREAS, the Callfornla Constltution provldes that If a ma]Orlty of property owners In any assessment area protests the lnstitutlon of proceedlngs under the Improvement Act of 1911 such proceedings must termlnate, unless upon a four-flfths vote the Clty Councll of the Clty of Santa Monlca determlnes that public necesslty and convenlence reqUlre the contlnuatlon of such proceedlngs; and 1 . . WHEREAS, a maJor~ty of property owners ln multlfamlly nelghborhoods are 11kely to protest the instltut~on of such proceedlngs because they may not l~ve In the assessment area to be benefltted or because they bell.eve that prov~sl.ons of the Santa Monlca Rent Control Charter Amendment wlll preclude sharlng the costs of such assessment with tenants; and WHEREAS, the Cl.ty Counc~l of the Clty of Santa Monlca deslres to establish supplemental procedures for lnstltut~ng street 11ghting lmprovements under the Improvement Act of 1911 that wlll ev~dence the support of tenants for such proceedlngs and the wllllngness of such tenants to share part of the costs of street Ilghtlng wlth thelr landlords; and WHEREAS, the Clty Counell of the City of Santa Monlca urges the Santa l>-1onlca Rent Control Board to provlde a general rent adJustment that wll1 perml.t landlords to pass on to tenants part of the costs of such street llghtlng assessments 1n assessment areas lnstituted under thlS ordlnance, NOW, THEREFORE, THE CITY COUNCIL OF THE CI TY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Sectlon 7160 1 S ad ded to the Santa MonlC a Munlcl.pal Code to read as follows Sectlon 7160. Instltutlon of Resldentlal Street Llghtl.ng Improve- ment Proceedlngs by Tenant Petltlon. Whenever the tenants of a ma]Orlty of rental unlts in any area petltlon the City CQunell to lnstitute proceedl.ngs for reSldentlal 2 . . street llghting lmprovement, the Clty Counell shall lnstltute proceedlngs under the Improvement Act of 1911 to provlde resldentlal street llghtlng to such area. The pet1tlon shall be on the form approved by the D1rector of General Services. SECTION 2. Any provlslon of the Santa Monlca Munlcipal Code or appendlces thereto lnconsistent with the provi Slons of thlS ordlnance, to the extent of such 1nconslstencles and no further, lS hereby repealed or modlfled to that extent necessary to affect the provlslons of thls ordlnance. SECTION 3. If any seetlon, subsection, sentence, clause, or phrase of thlS ordlnance is for any reason held to be invalid or unconstltutlonal by a dec1slon of any court of competent ]urlsdlctlon, such decision shall not affect the valldlty of the remalnlng portlons of the ordlnance. The Clty Councll hereby declares that it would have passed thlS ordlnanee and each and every sectlon, subsectlon, sentence, clause, or phra se not declared lnvalld or unconstltutlonal wlthout regard to whether any portlon of the ordlnance would be subsequently declared lnvalld or unconstltutlonal. 3 . . SECTION 4. The Mayor shall slgn and the C~ty Clerk shall attest to the passage of thls ordlnance. The C~ ty Clerk shall cause the same to be publ~shed once 1n the off1cJ.al newspaper w1th1n fJ.fteen (15) days after its adoption.
