SUBJECT: Recommendation to Adopt Sewer Connection Fees
Introduction
This
report
presents
information and makes a series of
recom~endations regarding the design and construction of a new
relief sewer for the Colorado Street sewer.
Background
In 1971 a report regarding recommendations for various types of
public works improvements was submitted to and approved by the
City Council. Priority Number 13 for the sewer improvements (of
18 projects) was a replacement sewer for the Colorado Street
sewe r.
The sewage flow to Hyperion from Santa Monica has decreased
within the past 7-8 years from 11.3 in 1973 to 10.3 million
gallons per day presently. This fact together with a decreasing
populationt led staff to believe the subject sewer was not a
critical
problem.
It was known the sewer operated under
surcharge
1n
rainy weathert but it was not known until
approximately 3 months aqo that it was operating at capacity
during the AM peak on many week days.
When this fact became
known, it was believed the sewer was partially clogged at one or
more points.

Monitoring of the sewer by television was performed in January.
This showed that while the sewer was not clogged, there were a
rather large number Of deficiencies including several sags in the
line, about 10% cracked pipes, and a number of displaced joints.
In the opinion of staff, the problem appears to be due to both
the deterioration of the 51 year old sewer and to increased flow
from some existing contributors.
Solutions to the Problem
The staff has recommended a consulting engineer be immediately
engaged to design a new relief sewer.
A preliminary design
showing specific alternate routes and design capacity criteria
will be submitted to the City Council for approval prior to
beginning final plans. The preliminary estimate of cost is $1.3
million and the estimated time for the project is as follows:

Funding of the Relief Sewer
There are many ways available to fund the sewer. The staff
recommends a portion of the sewer be funded by the available
monies in the Sewer Fund since the sewer serves a large portion
of the communlty at large. The user fee of $.21/100 cubic feet
of water used generates monies for this fund. Approximately
S500,000 of the $1.4 million balance in the Sewer Fund is
available for this work. The remainder of the cost should, in

the opinion of the staff, be funded by a new sewer connection
fee. Connection fees for new construction shown below would be
sufficient to generate the remaining portion of the $1.3 million
project cost and to generate funds for future major capltal
projects.

The above fees are similar to those of Los Angeles. Davis,
Glendale, Beverly Hills, Pasadena, and other cities also have
connection fees.
To receive building permits and proceed during the sewer design
and construction period, the owners will be required to provide
the City with an affidavit guaranteeing they will discharge to
the City sewer only during non-peak hours should the new relief
sewer not be ready for use by the time sewer hook-up is needed.
This method is used quite commonly in other communities which
have sewer problems. Other methods of partially a1leviating the
current peak flow situations includes requesting large users to
voluntarily discharge during off-peak hours.

Resolution setting sewer connection fees.

AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA ADDING
SECTION 7137 TO THE SANTA MONICA
MUNICIPAL CODE ESTABLISHING SEWER
CONNECTION FEES.
WHEREAS~ the deterioration of the Colorado Street sewer
has shown the immediate need for maintenance of and improvements
to the sewer system in Santa Monicat and
WHEREASt in 1978 the Sewer Use Fee was lowered in an
effort to keep water and sewer bills as low as possiblet and
WHEREASt there is a need to establish a means of funding
the maintenance and capital improvements required in the sewer
system in Santa Monica,
THE
CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAINS AS
FOLLOWS:

SECTION 1. Section 7137 of the Santa Monica Municipal
Code is hereby added in its entirety to read as follows:

SEWER CONNECTION FEE.
Prior to issuance of an occupancy permitt
a sewer connection permit shall be issued
by the Department of General Services
upon the payment by the applicant to the

addition
to

inspection
fee stipulated in Section
7142, a a sewer connection fee which fee
shall be established and may from time to

time be amended or revised by resolution
of the City Council. The Director of
General Services shall have the right to
collect such fee prior to issuance of a
building permit and to amend or waive any
charges set by resolution of the City
Council if in his judgement he deems the
water flow will be other than average.
SECTION 2. Any provision of the Santa Monica Municipal
Code or appendices thereto inconsistent herewith. to the extent of
such inconsistencies and no further, are hereby repealed or
modified to that extent necessary to effect the provisions of this
ordinance.
SECTION 3. If any provision of this ordinance is held
to be unconstitutional by any court of competent jurisdiction, it
is the intent of the City Council that such portion of such
ordinance be severable from the remainder and the remainder be
given full force and effect.
SECTION 4.
The Mayor shall,.sign and the City Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause the same to be published 6nce in the official
newspaper within 15 days after its adoption. The ordinance shall
become effective after 30 days after its adoption.

peace, health and welfare of the citizens;
THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAINS AS
FOLLOWS:
SECTION 1. SectIon 7137 is added to the Santa Monica
Munlcipal Code, to read as follows:
SectIon 7137. SEWER CONNECTION FEE.
(a) The owner or developer of a building in the City shall
pay a sewer connection fee to the City. This fee shall be
pald to the Department of General Services before the issuance
of the next permit or certificate required in the course of
development or occupancy of the building. No City
permit or certificate of occupancy shall be issued in
connectIon with a building until the Department of General

Services cert~fies that payment of the prescribed fee
has been received.
(b) The fee shall be established and from time to time be
amended or rev~5eu by ~esolution of the City Council. The
DIrector of General Services may increase the fee for any
buildlng if in his or her judgment the sewage flow will
be greater than average.
(c) If the use of property subject to this section is changed
so that Its sewage flow warrants the payment of a higher fee,
as shown on the City Council Resolution setting the fee, the
owner or developer of the property shall pay an addltional
fee, as determined by the Director of General Services.

(d) This fee shall be supplementary to all other permit and
fee requIrements of this Chapter.
SECTION
2.
This ordinance is declared to be an
emergency measure adopted pursuant to the provisions of Section
615 of the Santa Monica City Charter and is necessary for
preserving the public peace, health and safety. The urgency for
its adoption is set forth in the findings above.
SECTION 3. Any provision of the Santa Monica Municipal
Code or appendices thereto inconsistent herewith. to the extent of
such inconsistencies and no further, are hereby repealed or
modified to that extent necessary to effect the provis1ons of this
ordinance.
