Ordinance Amending Santa Monica Municipal
Code Section 5237C to Revise Hours for
Collection of Refuse
At its meeting on February 25, 1986, the city council
introduced for first reading an ordinance amending Santa Monica
Municipal Code section 5237C to restrict refuse collection
between the hours of 10:00 p.m. and 7:00 a.m. except in the M1
and M2 Districts. The ordinance is now presented to the City
Council for adoption.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SANTA MONICA
MUNICIPAL CODE SECTION 5237C TO REVISE
HOURS FOR REFUSE COLLECTION
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Santa Monica Municipal Code Sect.lon 5237C is
amended to read as follows:
SECTION 5237C.
Refuse collection
Hours.
No person shall operate or cause
to be operated any vehicle or refuse
collection

of
collecting refuse betneen the hours of
10:00 p.m. and 7:00 a.m. of the following
day, except that l.t shall be lawful, Ln
the M-l and M-2 Districts, to collect
rubbish between the hours of 3:00 a.m. and
7:00 a.m. of each day so long as durl.ng
such times there is no collectl.on of
refuse within 500 feet f:::-om any bUlldlng
located in a District other than the !1-1
or M-2 Districts.

SECTION 2. _y provision of the sfll Monica Municipal
Code or appendices thereto inconsistent with the provisions of
thlS ordinance, to the extent of such inconsistencies and no
further, are hereby repealed or modifled to that extent necessary
to affect the provisions of this ordinance.
SECTION 3.
If any sectlonl subsectionl sentence, clause,
or phrase of this ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of any competent
jurisdictionl such decision shall not affect the validity of the
remaining portions of the ordinance.
The City Council hereby
declares that it would have passed this ordinance and each and
every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether
any portion of the ordinance would be subsequently declared
invalid or unconstitutional.
SECTION 4.
The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance.
'The city Clerk shall
cause the same to be published once in the official ne'.V'spaper
with 15 days after its adoption.
I'hls ordinance shall become
effective after 30 days from its adoption.
