These revisions will update the Code to reflect necessary operational changes already implemented. Background Sections 5200 through 5233 of the Santa Monica Municipal Code address the city's requirements for refuse collection and disposal. Changes in the City'S refuse operation and heightened awareness of recycling and the effects of toxic substances have made many of these code sections obsolete. The fallowing are among the needed changes. -The Santa Monica Municipal Code Sections 5228 A and B make the distinction between wet garbage and dry refuse, even though the city no longer collects these materials separately. -Code Section 5229 currently makes no reference to the City' 5 recycling program and does not state that recyclable materials separated for collection by the City may not be scavenged. -Updated references to prohibit toxic materials in the waste stream should be added to the Code. - 1 - L--;j :1101988 . . -' . - e .' ATTACHMENT A: RECOMMENDED CODE REVISIONS SECTION 5200A: substitute "rubbish" for "class A rubbish" and "class B rubbish." SECTION 5200H: Add "Hazardous wastell shall mean any substance included and defined as "hazardous waste" in Title 22 of the California Administrative Code. (See section 5301 of the Toxic Chemical Disclosure Law for a more complete definition.) SECTIONS 52000 AND 5200E: Combine definitions for "class A rubbish" and "class B rubbish" and use the term "rubbish" to name this category. SECTION 5227, COLLECTION OF REFUSE: Amend this section by adding this second paragraph: Hazardous waste generated by any business in any amount or by any household in excess of 5 gallons or 50 pounds shall not be deposited in any container for refuse, dry commercial garbage, rubbish, building rubbish, or industrial waste. Hazardous waste shall be properly disposed of according to the regulations specified in Title 22 of the California Administrative Code and by the State Department of Health Services. SECTION 5227A, TYPES OF REFUSE SERVICE: Amend this section to read: The Director of General services is authorized to establish refuse collection routes and collect refuse on such days of the - 1 - e . week and at such hours of the day as deemed most advisable to serve the best interest of the City. Delete reference to class A and B rubbish. SECTION 5227B, FREQUENCY OF COLLECTION FOR TYPE A AND TYPE B REFUSE SERVICE: Change section title to "Frequency of Refuse Collection." Amend section to read: The Director of General Services is authorized to establish frequency of refuse collection based on need. Frequency of collection may be twice weekly or daily, except after holidays. SECTION 5227C, POINTS OF COLLECTION OF REFUSE: sentence: Class B rubbish not in a container shall be placed on the parkway, and shall neither extend into the street nor be placed on any portion of a parkway used as a sidewalk. Delete this SECTION 52270, COLLECTION OF REFUSE IN CENTRAL BUSINESS DISTRICT: Section 3611A of the Santa Monica Code, item 2, should be included here. SECTION 5228, REFUSE CONTAINERS: Amend paragraph one to read: A rubbish container shall be a substantial circular receptacle not exceeding 45 gallons in capacity. It shall be equipped with a fitted lit to prevent refuse from scattering, and the lid shall be equipped with a handle. A container shall be made of metal or plastic and shall be water tight in construction and shall be equipped with handles sufficient in strength to support the - 2 - . . weight of the container and contents. Dry commercial garbage may be placed in a container. Paper bags, cardboard boxes or wooden crates are not acceptable refuse containers and will not be collected. Delete reference to class A or class B rubbish. SECTION 5228A, SEPARATION OF REFUSE: Delete this section. SECTION 5228B, PREPARATION OF REFUSE FOR COLLECTION: Amend section to read: Garbage, carpet sweeping, cut hair, vacuum cleaner dirt and sawdust shall be wrapped securely in paper. Garbage produced from businesses shall be placed in containers for collection and shall not contain poisonous, infectious or hazardous chemicals. Palm fronds need not be placed in containers. Tree limbs, brush, bush, tree trimmings, broken furniture, carpet and padding shall be no more than 4 feet in length and be securely tied in bundles not to exceed 40 pounds in weight. Wooden boxes, wooden crates and paper cartons shall be broken and tied in bundles not to exceed 40 pounds in weight or placed in a substantial container. Ashes shall be thoroughly wet before being placed into any container. Rubbish not in a container placed on the parkway or alley, shall not extend into the street nor be placed on any portion of the sidewalk, may be subject to a special collection charge. Delete reference to class A and class B rubbish. - 3 - e . SECTION 5228C, ALLOWABLE AMOUNTS OF REFUSE PLACED FOR COLLECTION: Amend this section to read: The combined weight of anyone container, except city furnished bins, and its contents shall not exceed 40 pounds. The amount of rubbish placed for collection shall not exceed 4 cubic yards per collection. No separate refuse item not in a container and eligible for collection shall exceed 40 pounds. SECTION 5228E, HANDADORY EQUIPMENT: "class A rubbish. tl Substitute "rubbishtl for SECTION 5229, INTERFERENCE WITH COLLECTIONS: Add this second paragraph: All recyclable materials which include but are not limited to glass, cans, newspapers and motor oil left at the curb for collection by City crews on designated recycling collection days, shall be the property of the city of Santa Monica. No person, firm or corporation shall remove recyclable materials or containers placed at the curb on said collection days. No person, firm or corporation shall remove recyclables from specially designated recycling containers placed in central locations for the deposit of cans, glass and newspapers, or other recyclable materials. SECTION 5231, USE OF CITY REFUSE TRANSFER STATION: Substitute "rubbish" for "class A rubbishtl and "class B rubbish." (attrefus) - 4 -
