SR-506-001-04 . 50?~N-OU' 6 - L /' JUN 1 2 1990 Santa Monica, California GS:SES:SM Council Meeting: June 12, 1990 TO: Mayor and City Council FROM: City Staff SUBJECT: Recommendation to Authorize the City Manager to Negotiate and Execute a Public Works Mutual Aid Agreement with the County of Los Angeles and other Cities and Counties in Southern California INTRODUCTION This report requests that City Council authorize the City Manager to negotiate and execute a Public Works Mutual Aid Agreement with the County of Los Angeles which will serve as an inter-agency resource for public works assistance in the event of a catastrophic disaster such as a major earthquake or flood. DISCUSSION The County of Los Angeles Department of Public Works has developed a Public Works Mutual Aid Agreement in conjunction with the State Region I Office of Emergency Services and various other public works agencies. The purpose of the agreement is to create procedures before a major disaster strikes which allow cities and counties to request and/or provide assistance to other signatories at the time of a disaster. The agreement is intended to be used 1 6-1.. JUN 1 ~ j9~Q . . only in major disasters when the available resources of anyone county or city are not adequate to cope with the disaster and outside public works resources are required. Orange County and the County of Los Angeles were the initial signatories to the agreement with four other counties. Thirty-five Southern California cities have also signed. The agreement will not obligate the City of Santa Monica to provide services to other agencies unless it wishes to do so. The basic provisions of the agreement state that the rendering of mutual aid by any party is strictly voluntary so that the resources of the assisting party are not unreasonably depleted by providing the aid. It does establish procedures for the City to receive critical assistance in a disaster if needed. Formal mutual aid agreements already exist for fire service, law enforcement, and coroner agencies throughout the State. Unlike these agreements, however, the Public Works Mutual Aid Agreement contains provisions for financial reimbursement because a reciprocal service is less likely to occur within a reasonable period of time. The agreement states that the requesting party will pay all direct, indirect, administrative, and contracted costs incurred by the assisting party "based upon standard rates applicable to assisting party's internal operations." Payment must be made within 60 days after receipt of invoice. In a major disaster, however, most of these costs are likely to be reimbursed by the State and federal government. 2 . . BUDGET/FISCAL IMPACT There is no fiscal impact at this time. RECOMMENDATION It is requested that City Council adopt the attached resolution which authorizes the City Manager to negotiate and execute the Public Works Mutual Aid Agreement with the County of Los Angeles and other cities and counties as they become signatories to the Agreement. RESOLUTION NO. 8040(CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE APPROVAL OF THE PUBLIC WORKS MUTUAL AID AGREEMENT WITH THE COUNTIES OF LOS ANGELES AND ORANGE AND OTHER CITIES AND COUNTIES AS THEY MAY BECOME SIGNATORY TO THE PUBLIC WORKS MUTUAL AID AGREEMENT WHEREAS, the City of Santa Monica is aware of the great need for disaster training and emergency preparedness; and WHEREAS, the Counties of Los Angeles and Orange have signed a Public Works Mutual Aid Agreement to be implemented on an as needed basis during any catastrophic disaster; and WHEREAS, Mutual Aid Agreements are effectively used between agencies in the Police and Fire Services; and WHEREAS, during such a major disaster, City Public Works resources will be insufficient to meet the needs of the moment; and WHEREAS, in the event of a serious disaster in a neighboring City, the City of Santa Monica may be able to extend Public Works Disaster Assistance to that affected City; and WHEREAS, there is presently no agreement in place to govern the extension of Public Works Mutual Aid during a disaster, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City of Santa Monica approves the multi- County Public Works Mutual Aid Agreement and authorizes the City 4 " . .
