Backaround
Interests and easements have typically been for public
improvements such as easements for sidewalk purposes and
dedications for street widening.
These requirements are
typically generated by the General Services Department
Engineering staff as conditions of approval during plan check
of new multi-family and commercial construction.
Currently, staff attaches a generic certificate of acceptance
to each deed or easement which refers to the City Charter as
the authority which indicates that the City Manager has
signatory rights.
Although this process has been correct in

form, the City Attorney's office believes that acceptance
authority for such deeds and easements should be formally
vested in the City Manager.
To achieve this, the City
Council must adopt a resolution in which the Council
specifically authorizes the City Manager to sign all deeds
and easements conveyed to the City for public improvements.

There is no budget/financial impact resulting form this
recommendation.
Recommendation
It is recommended that the City Council adopt the attached
resolution formally authorizing the City Manager to accept
grants or deeds to the City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA AUTHORIZING THE CITY MANAGER TO
ACCEPT GRANTS OR DEEDS TO THE CITY FOR PUBLIC IMPROVEMENTS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1.
The City council of the City of Santa Monica
hereby authorizes the City Manager to accept those interests in
real property, including easements, made to the City of Santa
Monlca, and consents to the recordations thereof by the City Clerk
of the City of Santa Monica.
SECTION 2. The City Council of the City of Santa Monica, ln
granting this authority, is proceeding in accordance with Sectlon
27281 of the Business and Professions Code.
SECTION 3.
All such interests and easements are strictly
those for public improvements such as easements for sidewalk
purposes and dedications for street widening.
SECTION 4. The City Clerk shall certify the adoption of this
ReSOlution, and thenceforth and thereafter the same shall be in
full force and effect.
