Background The city receives federal funds to construct street improvements, traffic signals, and other public works improvements which require rights-of-way. A right-of-way is the legal right to property through ei ther ownership or easement on which improvements are constructed for transportation purposes. The Federal Highway Administration has initiated a policy that requires a responsible City official to submit a certification form assuring that all rights-of-way necessary to accommodate the pavement, median, borders, parkways, sidewalks, access roads, side slopes, retaining walls, etc., on a federally funded project will be acquired in accordance wi th applicable federal procedures. To insure compliance with the new requirement, Caltrans is requesting that the City Council adopt a resolution giving a responsible City official the authority to execute 6-D - 1 - JAN 2 4 1985 . . right-of-way certifications for all federally funded projects. If such a resolution is not adopted, Caltrans will not review or approve any federally funded projects. staff therefore recommends that the city Council adopt a resolution authorizing the City Engineer to execute right-of-way certifications on behalf of the City of Santa Monica. BUdget/Financial Impact There is no budget/financial impact if the City council adopts the attached resolution. If the resolution is not adopted, Caltrans will not review or approve plans for any federally funded projects and as a result the City will be ineligible for federal reimbursement of applicable project costs. Recommendation It is recommended that the City Council of the city of Santa Monica adopt the attached resolution authorizing the City Engineer to execute right-of-way certifications for federally funded projects on behalf of the City of Santa Monica. The City Engineer is hereby authorized to execute Right-Of-Way Certifications on behalf of the City of Santa Monica on federal-aid projects. - 3 - , " . . SECTION 2.
