SUBJECT: Recommend to Appropriate Funds and Award of Contract
for the 1990-91 Sewer Main Expansion Project on The
(Beach) Promenade
Introduction
This report recommends that the city council award a contract for
the 1990-91 Sewer Main Expansion Project on The (Beach) Promenade
from Colorado Avenue to pi co Boulevard to vicco construction
Inc. ,
the lowest responsible bidder,
in the amount of
$644,970.00.
Background
Over the past five years there has been substantial new
construction within the area which is tributary to The (Beach)
Promenade sewer line. Because of staff's concern that the sewer
line was near or at capacity, a study was undertaken by an
outside consultant to analyze the condition and monitor the flow
of the line. The study recommended that the City install a newer
and larger sewer main in order to accommodate increased flows
resul ting from the new construction.
Each of the new
construction projects has paid sewer connection fees which cover
the estimated costs of the project.

A Notice Inviting Bids was published on May 10 and 11, 1991, in
the Evening outlook, and four construction journals, and was sent
to eight WMBE associations. Plans and specifications were issued
to thirteen contractors. Bids were received and read publicly on
June 3, 1991, by the Deputy City Clerk.

The low bidder, Vicco Construction, Inc., supplied the City with
five references. All references reported that the contractor's
work was satisfactory. In addition, this firm previously
completed another City project successfully.

To finance this project, it is proposed that the $l91,22l.90 held
as ABl600 deferred revenue be appropriated to account

31-760-661-27590-8928-99120. The remaining $548,778.10 is
already available in CIP Account Numbers:
31-760-66l-27591-8928-99120, "Wastewater Main Replacement" in the
amount of $232,776.10, and 31-760-661-27590-8928-99120,
"Wastewater Main Replacementll in the amount of $316,002.00.
In January 1989, a state law (AB1600) became effective which
required that a reasonable relationship (nexus) be established
between a development proj ect and the publ ic improvement for
which the development fee was charged. Until a nexus can be
established, the development fee must be kept separate in a
deferred revenue account.
The attached table shows which development served by the sewer
line along the Beach Promenade have paid the $l91,22l.90 now held
as deferred revenue which will be used to partially fund this
proj ect. These developments have directly caused the existing
sewer line to reach capacity resulting in the need to enlarge the
line and thus the nexus for use of ABl600 funds has been
established. Maps which show that the new construction for which
these connection fees were collected are tributary to the
proposed sewer enlargement are on file in the office of the
utilities Division.
Recommendation
It is recommended that the city Council:
1. Authorize the appropriation of $191, 22l. 90 from deferred
revenue Account No. 31-000-000-00000-9870-04680 to Account
No. 31-760-661-27590-8928-99120.

Award a contract for the

Inc., the lowest responsible bidder, in the amount of
$644,970.00 and
3. Authorize the City Engineer to issue any necessary change
orders to complete additional work in conformance with the
Administrative Instruction on change orders.

Presented were the request of Councilmember Zane to discuss the
Fico Kenter storm drain signage and testing information,
continued from October 14, 1986 (S-E); the request of Carl
Byker 1 Heal the Bay, to address Council regarding pollution in
County storm drains (13-A) ~ and a report from Mayor Reed
regarding appointment to the santa Monica Bay study Committee
(14-A). .Councilmember Zane moved to hear from the public for
three minutes each and combine l3-A,with this item. Second by
Councilmember A. Katz. The motion wa~ approved.by a voice vote.
Mayor Reed moved to pull Item l4-A'at the same ~ime. The motion
was duly seconded and unanimously approved. Discussion was held.
During discussion, it was agreed to hold a study session in
regard to the matter. Members of the public Carl Byker, Angus
Alexander, and Mike Frazer spoke regarding pollution in the bay
from storm drain discharge. John Jurenka recommended a water
truck to clean the streets. Councilmember Zane moved to direct
staff to (1) pursue improved signage, including councilmember
Conn's suggestion of temporary mobile signs that could be moved
with the tide, (2) investigate the prospect of improving human
guarding, conceivably using lifeguards of the area, (3)
introduce more frequent testing for toxics several times a day
for a period of time and intermittently to get randomized, better
c0verage of taxies in the storm drain, and (4) try to find out
more about interococcis bacteria, the results of the County test
and the possibility of finding ways to do our own testing of the
bacteria to provide more accurate information on the safety of
the beach area around the storm drain. Second by H. Katz.
During discussion, and there being no objection from the second,
Councilmernber Zane accepted as friendly an amendment by Mayor
Reed to add direction to staff to report on the possibility of
painting signs on all the inlets warning that there is a fine for
improper disposal into the storm drain. The motion was approved
by the following vote:
Council vote: unanimously approved 7-0
