The accompanying ordinance effectuates this direct1on. Th1s or- dinance is 1dentical to the 100 declbel SENEL limit which was adopted by the Council for a six month period in January, 1982. Section 10105B of the Santa Monica Municipal Code is hereby amended to read as follows: Section 1010SB. Aircraft Noise Restrictions for the Santa Monica Municipal Alrport. (a) Prohib1tion And Remed y fa r Repeated Violation. An aircraft taking off from or land1ng at the A~rport shall not be operated 1n violation of this section. A person who violates this section more than once may, at the discretion of the Airport Director and after belng given notice and an opportunity to be heard, be prohib1ted from using the Airport for a period not to exceed 180 days, except upon such conditions as the Alrport Director may prescribe. Each of the terms shall be specifically as used in this section shall be defined as follows: (1) Sound pressure level (SPL): The sound pressure level, in decibels (dB), of a sound is twenty times the logarithm to the base 10 of the ratio of the pressure of this sound to the reference sound pressure. The reference pressure shall be 20 micropascals (20 micronewtons per square meter, or 0.0002 nicrobar). (2) Noise level (~L): The noise level, ln decibels, is an A-weighted sound pressure level as neasured using the slow dynamic characteristics for sound level meters specified in the Amerlcan National Standard Specification for Sound Level Meters, ANSI Sl.4-1971 (or latest revision thereof.). The A-weighting characteristics modifies the frequency response of the measuring instrument to account approximately for the frequency 2 characteristics of the human ear. The reference pressure is 20 micropascals. (3) Noise Level Maximum (NLM): The maximum NL reached during an aircraft noise occurrence. This is synonymous with the unit "dBAll" as found in FAR-36, Part 36, Appendix F. (4) Noise exposure level (NEL): The noise exposure level ln decibels is the noise accumulated during a given event. More specifically, the noise exposure level 1S the level of the time-lntegrated A-weighted sound pressure for a stated time interval or event, based on a reference pressure of 20 micropascals and a reference duration of one second. (5) ?}ngle level (SENEL): event noise exposure The single event noise exposure level, 1n decibels, is the noise exposure level of a single event, such as an aircraft flyby, measured over the time lnterval between the initial and final times for which the noise levels of a slngle level. (7) A1rcraft Operator: Aircraft operator means the legal or beneficial owner of the aircraft with author1ty to control the aircraft ut11ization: except where the aircraft 1S leased, the lessee 1S the operator. Aircraft operator also means the pilot of an a1rcraft. (8) C1ty: City means the City of Santa Monica. (9) A1rport: Airport means the Santa Monica Municipal A1rport. (10) A1rcraft Model: A1rcraft Model means a verSlon of an aircraft that requires or if now nanufactured would require rules. (c) Methodology. The noise levels generaten by aircraft takeoffs or aircraft landings at the Airport are to be ~easured at one or More positions in the vicinity noise certification under FAA 4 of the Alrport. The measurements shall be in terms of the SENEL. The measured SEMEL values are to be compared with noise level limits established by this Section. An aircraft operator whose a1rcraft produces noise levels which exceed the SENEL limits shall be deemed to be in vlolation of this Section. (d) Measurement Locations. MeasureMents shall be made at ground pos1tlons on or near the center line of nominal takeoff and landing flight tracks for aircraft operating from the Airport. The nominal flight track is a line projected on the ground under the nominal flight path of the aircraft. Measurement positions shall be established by the City at a position 1500 feet from the east and 1500 feet from the west end of the runway. Additional measurement positions may be established as needed to carry out the purpose of this Section. (e) !.Eequency of Heasurement. At each established microphone location, single event noise exposure level measurements shall be made on a schedule to be established by the C1ty. 5 (f) ~9ise Monitoring System Speci- fications. The noise monitoring sys tem shall measure the single event noise exposure level of noise events exceeding the noise threshold established at each measurement posi tion and shall log the time of occurrence of each event. The performance of the noise monitoring system shall meet the requ1rements established in Noise Standards, as amended. In general the overall accuracy of the noise measurement system shall be +1.5 dBAs determ1ned in accordance with the procedures specified in Section 5080.3 of the Ca11farnia Airport N01se Standards, as amended. (g) Fleld Measurement Precautions. Specific locations of the monitoring systems shall be chosen, whenever possible, such that the noise levels contributed from sources other than aircraft shall be equal to or less than 60dB. The measurement microphone shall be placed 20 feet above the ground level or at least 10 feet from the neighboring rooftops, wh1chever is higher. To the 6 extent pract1cal, the following precautions should be followed: (1) Each monitor1ng location shall be in an open area surrounded by relatively flat terrain having no excesive sound absorption character~stics such as may be caused by thick tall grass, shrubbery or wooded areas. (2) No obstructions which would signlficantly influence the sound field from the aircraft shall exist within the con1cal space above the measurement position, the cone be~ng defined by an axis along the line of sight normal to the aircraft and by a half angle of 75 degrees from th~s axis. (3) ~~en the foregoing precautions are not pract~cal, the microphone shall be placed at least 10 feet above neighborlng buildings in a position which has a clear line-of-sight view to the path of the aircraft in flight. (h) Max~mum Allowable Single Event Noise Level (SENEL). The City shall set noise level limits for each of the established measurement positions. For the noise monltor stations specified in 7 subsection (d) above, the maximum permissible SENEL shall be 100 Decibels. SECTION 2. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this ordinance, to the extent of such inconsistencies and no furthe r , are hereby repealed or modified to that extent necessary to affect the provisions of this ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decision shall not affect the valid1ty of the remaining portions of the ordinance. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause or phrase not declared 1nvalid or unconstltutional w1thout regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of thlS ordinance. This City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. The ordinance shall become effectlve after 30 days from its adopt1on.
