SR-6-E (6) . , . tfoz- CJO'S GS:SES:JM:mh Council Meeting: 12/09/86 Santa Monica, California (p-E DEt 9 1986 TO: Mayor and City Council FROM: city Staff SUBJECT: Recommendation to Adopt Resolution Endorsing the Reconstruction of the Santa Monica pier with the Assistance of the Wildlife Conservation Board's Public Fishing Pier Program Introduction This report requests that Council adopt the attached Resolution (Attachment A) endorsing the reconstruction of the Santa Monica Pier with the assistance of the wildlife Conservation Board's Public Fishing pier Program. Background The Wildlife Conservation Board (WCB) is a branch of the state Department of Fish and Game which promotes the enhancement of wildlife habitat and the development of facilities for public hunting and fishing. The City of Santa Monica first initiated discussions with the weB in 1982 at the time of the formation of the Pier Task Force. The WeB indicated an interest in cooperating with the City to develop a project to improve fishing opportunities on the Pier. The Department of Fish and Game conducted an evaluation of the fishing conditions at the pier and made a favorable determination regarding WCB involvement in improving fishing access. Following the 1983 winter storms, staff's discussions with the weB focused on funding assistance for the reconstruction of the ,,-E - 1 - DEe ~ 9 1186 . Pier. The WCB indicated support for rebuilding the 420' extension of the Municipal Pier, which was primarily used for fishing. The WCB indicated a commitment of the maximum project funding of $500,000. Wildlife Conservation Board Public Fishing pier Program The WCB Public Fishing Pier Program typically funds the construction or reconstruction of part or all of a public fishing pier. The WCB allocates funds ($500,000 maximum per project) on a matching basis with the local agency. As part of the grant, the WCB requires that the local agency operate and maintain the project for a period of twenty-five years. As indicated above, the WCB is interested in assisting with the reconstruction of the Municipal Pier. Based on the results of the earlier Fish and Game evaluation, they are not interested in the Newcomb pier reconstruction since the fishing conditions were found to be more favorable at the end of the Municipal Pier. The actual reconstruction of the Municipal pier is estimated at $3.6 million which far exceeds the $500,000 contribution of the WCB. Therefore, the weB grant would be for a portion of the reconstructed Municipal pier which would be designated on a square foot basis as the "WCB Fishing Pier." This specific area would then be subject to the construction and lease agreements. Under the terms of the grant, the City would be required to operate and maintain the designated portion as a public fishing and recreational facility for a period of twenty-five years. The City would not be required to maintain and repair this portion in - 2 - the event of occurrences beyond the City's control or "Acts of God." The city could lease a concession on this area provided that revenues generated be dedicated to the operation and maintenance of the project area. Staff is reconnnendinq that the Council adopt a resolution of intent endorsing the city's participation in the WCB Public Fishing Pier Program at this time so that the WCB may take formal action to allocate the funds for the santa Monica Pier. The WCB has a total of $3 million available for fishing piers statewide. Given the competition for these limited resources, it is in the best interest of the City to affirm its connnitment to the project at this time. pier Restoration Corporation staff has reviewed the resolution of intent and concurs that it is consistent with restoration plans for the Pier. The construction and operating agreements would be executed following completion of the final design of the Municipal pier and city authorization to proceed with construction. Based on the current phasing of the reconstruction project, reconstruction of the Municipal Pier could begin in fall, 1987. Fiscal/Budget Impact The reconnnended action has no budget or fiscal impact at this time. Council Meeting: 12/09/86 Santa Monica, California RESOLUTION NUMBER 7343(CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ENDORSING THE RECONSTRUCTION OF THE SANTA MONICA PIER WITH THE ASSISTANCE OF THE WILDLIFE CONSERVATION BOARD'S PUBLIC FISHING PIER PROGRAM. WHEREAS, the city of Santa Monica desires to reconstruct the Santa Monica pier in cooperation with the state of California under the Wildlife Conservation Board's Public Fishing pier Program~ and WHEREAS, the reconstruction of the Santa Monica pier for the purpose of sport fishing and other recreation is in the public interest, and would benefit the people of this area as well as the state generally. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The city of Santa Monica goes on record in favor of the reconstruction of a portion of the Santa Monica Pier on a matching basis with the State of California, by and through the wildlife Conservation Board, Department of Fish and Game. SECTION 2. The City of Santa Monica agrees that in the event of such development it will enter into a twenty-five (25) year lease and operation agreement with the state for the designated portion, and the city Manager is hereby authorized to - 1 - . . . sign such an agreement or other documents required in connection , with this project. SECTION 3. The City of Santa Monica agrees to cooperate fully with the Wildlife Conservation Board of the state Department of Fish and Game in such a cooperative project as described and will forward a copy of this resolution to said Wildlife Conservation Board.
