SUBJECT: Recommendation to Adopt Resolution in Support of the
Reconstruction of the Santa Monica Pier in Accordance
with the provisions of the State Tidelands Grant
Introduction
This report requests that the City Council adopt the attached
Resolution (Attachment A) in support of the reconstruction of the
Santa Monica pier as part of the city's fulfillment of the
provisions of the State Tidelands Grant.
Background
The tide and submerged lands over which the Santa Monica pier
extends are sovereign tide and submerged lands of the State of
California that the Legislature granted in trust to the City of
Santa Monica pursuant to Chapter 78, statutes of 1917, and
amended most recently by Chapter 1077, Statutes of 1970. In
accordance with the provisions of the Grant, the City must file a
detailed description of major capital improvements on the granted
lands with the State Lands Commission.
In addition, if the City spends general funds for trust purposes
on trust lands, the general fund may be reimbursed from trust
revenues for these expenditures only if the City makes known its
intent to reimburse the general fund at or before the time of

expenditure. The attached Resolution states such an intention on
the part of the city.
BUdget/Fiscal Impact
The recommended action has no budget or fiscal impact.
Recommendation
staff respectfully recommends that the Council adopt the attached
Resolution in support of the reconstruction of the Santa Monica
pier in accordance with the provisions of the State Tidelands
Grant.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA IN SUPPORT OF THE
RECONSTRUCTION OF THE SANTA MONICA PIER IN
ACCORDANCE WITH THE STATE TIDELANDS GRANT
WHEREAS, the City Council of the city of Santa Monica
previously adopted Resolution Number 7204 (CCS) certifying the
Final Enviromnental Impact Report on the Santa Monica pier
Reconstruction Project; and
WHEREAS, the tide and submerged lands over which the
Santa Monica pier extends have been granted in trust to the City
of Santa Monica by the State Legislature pursuant to Chapter 78,
Statutes of 1917, and amended by Chapter 1077, Statutes of 1970:
and
WHEREAS, in accordance with the provisions of the
Grant, the City must file a description of the proposed
reconstruction of the Santa Monica pier with the State Lands
cOllllIlission: and
WHEREAS, the City must make known its intent to
reimburse the General Fund if such general funds are used for
trust purposes on trust lands,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council approves the proposed
reconstruction of the Santa Monica pier in accordance with the
Final Environmental Impact Report.

SECTION 2. The City Council intends to loan certain
general funds, which are to be reimbursed, as 'are necessary to
supplement the other sources of funding for the project,
including the Federal Emergency Management Agency Disaster
Assistance, State Coastal Conservancy Reimbursable Grant, and
wildlife Conservation Board Matching Grant.
SECTION 3. The city Clerk shall certify to the
adoption of ~his Resolution, and thenceforth and thereafter the
same shall be in full force and effect.
