SUBJECT: Property Tax Transfer Resolution for AnnexatIon No. B
to the City of Santa MonIca and Detachment from the
CIty of Los Angeles of a 34 Acre Parcel of the Santa
MonIca Airport
IntroductIon
ThlS report recommends the CIty CouncIl adopt a resolutIon to
approve and accept a negotiated exchange of property tax revenue
resultlng from annexatIon to the CIty of Santa MonIca and
detachment from the City of Los Angeles of a 34 acre parcel in
the northeast corner of the Santa MonIca AIrport. The parcel is
owned In fee by the CIty of Santa MonIca.

An applIcatIon for annexation of the 34 acre IILA parcelll at Santa
Monica AIrport was flIed wlth the Local Agency FormatIon
CommiSSIon on February 24, 1986. PrIor to recBIvIng a
CertIfIcate of Filing, the Clty of Santa Monica and the CIty of
Los Angeles must adopt a tax resolutIon pursuant to SectIon
99(bl (6) of the CalIfornIa Revenue and Taxation Code, WhICh
states:

"Notwithstanding any other provision of
law, the executive offlcer shall not
issue a certificate of filing pursuant
to Sections 35152, 54791, or 56198 of
the Government Code until such local
agencies included in the property tax
revenue exchange negotiation: within
the 30 day negotiation period: present
resolutions adopted by each such county
and City whereby each such county and
City agrees to accept the exchange of
property tax revenues. "
The attached resolution: to be adopted jointly by the City
councils of the Cities of Santa Monica and Los Angeles: involves
no transfer of property tax revenue to or from either City as a
result of the annexat1on. Th1S 1S because once the parcel
becomes a part of the City of Santa Monica it is tax exempt.
Moreover. because the parcel is part of the Santa Monica Airport,
muniCipal services to the area such as roads, fire fighting,
publiC safety: water and sewage have always been provided by the
City of Santa Monica

Tax ~nformat10n prov1ded to us by the County aud~tor's off~ce
shows that the City of Santa Mon~ca paId $8505.39 1n propel'ty tax
on the parcel In fIscal year 1984-85. The CIty of Los Angeles
recelved .332 as their fract~on of the total or approx1mately
$2824 1n annual tax revenue As a result of the annexat1on, the
C1ty of Los Angeles will no longer rece1ve revenue from the
parcel and w~ll no longer be responslble for the prov1s10n of
munic1pal serV1ces.
Although there w111 be no tax transfer per se. the Resolution 1S
necessary to spec~fy the tax status of the property followIng Its
annexatIon. The Resolutlon also calls for a renegot1ation of the
property tax exchange should the property no longer be tax
exempt; that 1S. if the property 1S sold or ground leased to a
private party. The property cannot be sold as long as the City's
agreement w1th the Federal AV1atlon AdminIstratIon is in effect,
or at least untll 2015.
Future Actlon
FollOWIng rece1pt of e1ght certlf1ed coples of the Joint
resolutIon adopted by the CIty of Santa Monica. the Local Agency
FormatIon Commlsslon w111 forward the Resolut1on to the City of
Los Angeles for council act1on. Once the resolution has been
adopted by both citIes. LAFCO has 30 days to determine that the
Santa Monlca application 1S complete and to issue a Cert1f1cate
of Flling. W1thin 90 days of the 1ssuance of the CertIfIcate,
LAFCO w1ll set a publ1c hearlng date. FollOWIng the hear1ng, the
City of Santa MonIca must adopt a f1nal resolution approving the
transfer.

Recommendatloons
City staff respectfully recommends that the City CouncIl:
(1) Adopt the JOlnt Resolution approv1ng and acceptlng the

from the annexation of the 34-acre parcel at Santa Monlca
Alrport.
( 2 ) Dlorect the Clty Clerk to certlofy eIght coples of the
Resolution to be forwarded to the Local Agency FormatIon
COmmloSSlon.

A JOINT RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF SANTA MONICA
AND THE CITY COUNCIL OF THE CITY OF
LOS ANGELES APPROVING AND ACCEPTING
A NEGOTIATED EXCHANGE OF PROPERTY
TAX REVENUE RESULTING FROM THE
REORGANIZATION IDENTIFIED AS
"ANNEXATION NO. 8" TO THE CITY OF
SANTA MONICA (DETACHMENT FROM THE
CITY OF LOS ANGELES)
WHEREAS, pursuant to Section 99 of the Revenue and Taxation
Code. prior to the effective date of any jurisdictional change
the governing bodies of all agencies whose service areas or
service responsibilities would be altered by such change must
determine the amount of property tax revenues to be exchanged
between the affected agencies and approve and accept the
negotiated exchange of property tax revenues by resolution; but
if the affected agency is a special district, the Board of
Supervisors must negotiate on behalf of the district; and
WHEREAS, the City of Santa Monica and the City of Los
Angeles are the only affected agencies; and

WHEREAS. Council of the Monica and
the City Council of the Clty of Los Angeles have determlned that
the amount of property tax revenue to be exchanged between their
respective agencies as a result of the reorganization identified
as "Annexation No. 81t to the City of Santa Monica (Detachment
from the City of Los Angeles), is as set forth below.
NOWt THEREFORE, BE IT RESOLVED AS FOLLOWS:
1- The negotiated exchange of property tax revenues between
the City of Santa Monica and the City of Los Angeles resulting
from the reorganization of territorYt identified as "Annexation
No. 8" to the City of Santa Monica (Detachment from the City of
Los Angeles) is approved and accepted.
2 . The subject territory is owned by the City of Santa and,
upon annexation to said City, shall be exempt from ad valorem
taxation. Therefore, there shall be no transfer of property tax
revenues to or from any affected agency as a result of this
reorganization.
3 . Upon annexation of the subject territory to the City of
Santa Monica, in the event the territory shall cease to be tax
exempt, this resolution for property tax exchange shall be

renegot:lated. The prOV:lS10nS of Sect:lon 99 of the Revenue and
Taxation Code shall not have any appllcation to such
renegotlstlon.
The foregoing resolution was adopted by the City Council of
the Clty of Santa Monica and the Clty Counell of the Clty of Los
Angeles.
