The ordinance Nas lntroduced by the City Council at its specla1 meeting of September 10, 1979. It reduces the slng1e event nOlse exposure limit (SENBL) for alrcraft uSlng the Santa ~1onlca Alrport to 85 decibels~ establlshes preSQ~ptlons for nOlse level violations, prohlblts training operations by high perfornance alrcraft, and establishes rulemaklng procedures. ~he report also tranSMlts a negatlve declaratlon of envlronmenta1 impact for Councll review and adoption. BACKGROU~lD On SepteQber lO~ 1979, the City Councll held a publlc ~eeting to conslder proposed changes to the regulations governlng the operatlon of aircraft at the Santa Honica Airport. A large n~ber of people attended the neetinq; numerous people were heard In support of and In op~osltion to changes in the law, partlcular1y the reduction of the SENEL. A presentation was made by staff and by Dr. Karl Kryter, a psycho-acoustlclan. At the conclusion of the publlC hearing, the Cauncll 9c... SEP 2 5 1979 e e lntroduced the ordinance pro?osed by the City Attorney, and lowered the SEN=L limltat~on =or alLcraft uSlng the alrport fro~ 100 to 85. ThlS noise level, in the op1nlon of experts consulted bv the C1ty, 15 the level that wlll achleve a cO;1I"1uni ty nOlse exposure le,rel (CNEL) of 55, Wh1Ch 15 the level reconnended by the Environmental Protection Agency. The staff report submltted to the Clty CauDell at the September 10, 1979, Reetlnq is attached hereto, toqether wlth the proposed ordlnance. The ordinance, 1f adopted, will becone effectlve 30 days after lts adoption. An Inltial Study has indlcated that a Negative Declaratlon and not an EIR lS appraprlate. The Cauncll should reVlev.- and adopt thlS rlegat1ve Declaration at thlS meeting. A publ1C hearing lS deslrable, but not required. If the negatlve declaration 18 adopted lt must be posted for 30 days prlor to the effectlve date af the ordlnance. If there is substantlal controversy over the Negatlve Dec1aratlon, a sub- sequent publlc hearlng should be held. In any event, the ordinance may be adopted at this neeting with the understanding that lmp1ementatlon ~ay be delayed if the negatlve declarat10n 1S subsequently found to be lnadequate. ALTERNATIVES The Councll may adopt the Negative Declaration or require that an EIR be prepared. If the Councll adopts the ~egatlve Declarat10n it may adopt the proposed ordinance, modlfy it, or reJect It.
