They are promulgated by the Alrport Dlrector under the authorlty of Sectlon 3 of Ordlnance 1137. Type Ban These rules and regulatlons requlre that types of alrcraft estlmated to be unable to operate at or below the allowable 85 SENEL Ilffilt upon takeoff at Santa Monlca Alrport, with a nOlse abatement power cutback followlng takeoff under average weather condltlons at Santa ~onlca Alrport and at mlnlmUffi operatlng gross welght, be "llsted" by type and prohlblted from uSlng the Alrport except In an emergency. SENEL Llffiltatlon The rules and regulat10ns also requlre that a 11St of alrcraft WhlCh would be llkely to exceed an 85 SENEL, wlth a nOlse abatement power cutback followlng takeoff under average weather condltlons at Santa Monlca Alrport, and at greater than mlnlmum operat1ng gross welght, be 11sted on an advlsory Ilst along w1th the expected SENEL values of the alrcraft at varlOUS welghts up to the maXlmum gross takeoff welght. Such a~rcraft would not be type banned but would be subJect to the SENEL llmltatlon, as measured at the meter. Unrated alrcraft and those WhlCh would not be expected to exceed an 85 SENEL even at maXlmum gross welght would also be subJect to the 85 SENEL as measured at the meter. Weather Effects on SENEL These rules and regulatlons provlde that tables showlng the effects of varlOUS weather condltlons at Santa Monlca Alrport upon alrcraft performance and nOlse be publlshed by the Alrport Dlrector. These tables wlll be advlsory only and wlll show the effects to be expected upon takeoff nOlse as a result of teMperature, wlnd, and hUffildlty condltlons that dev~ate from the annual averages for those varlables at Santa Monlca Alrport. Modlficatlons of Alrcraft Ratlngs These rules and regulatlons further provlde for a means by WhlCh a partlcular unrated alrcraft may be evaluated and a partlcular banned alrcraft may be exempted and removed from the llst. Exceptlons For NOlse Abatement Purposes These rules and regulatlons permlt, wlth prlor approval from the Alrport Dlrector, alrcraft takeoffs ln excess of 85 SENEL If the fllghts are speclflcally for nOlse abatement lnstructlon or ratlng of alrcraft. -2- Effect The ~ntended effect of these rules and regulat10ns ~s to reduce the Commun1ty N01se Equlvalence Level (CNEL) 1n the area around the A~rport from 1tS current level of approx~mately 65 CNEL to a level not greater than 55 CNEL. Th1S reduced level 1S recommended by the U. S. Env~ronmental Protect1on Agency as requlslte for the protectlon of publ1C health and welfare wlth an adequate marg~n of safety. Effect1ve Date These rules and regulat10ns w1ll not go lnto effect upon adopt1on, but wlll become effective on the earl1est date upon WhlCh they may be legally enforced. Federal. The NOlse Control Act of 1972 (42 V.S.C. Seetlon 4901) states the federal POllCY regardlng the control of nOlse. 14 C.F.R. Sectlon 36 sets nOlse emlSSlon crlterla for alrcraft certlflcatlon by the Federal AVlatlon Admlnlstratlon. Part 36, Appendlces C and F (14 C.F.R. Sectlon 36) establlsh the method of measurement for nOlse certlflcatl0n. The mathematlcal formulae used thereln are adopted, wlth modlflcatlons, for use In these rules and regulatlons. As requlred by Sectlon 5(a) (2) of the NOlse Control Act 1972, the EnvlronMental Protectlon Agency prepared the publlcatlon entltled, "Inforrnatlon on Levels of Envlronmental NOlse Requlslte to Protect PubllC Health and Welfare Wlth an Adequate !1argln of Safety," (Rep. 550/9-74-004 (Harch 1973)), WhlCh recommends a CNEL of 55. 2. State. Callfornla Department of Aeronautlcs NOlse Standards (21 Cal.Ad. Code Sectlon 5000-5080.5 (1977)), partlcularly SectloD 5012, prescrlbes a current nOlse llIDlt of 70 CNEL w1th a mandated maX1ffium level of 65 CNEL by 1986. The standard lS based on a "tYPlcal" cornmulllty and does not preclude the establlshrnent of a lower level based upon the part1cular needs of the eornmunlty. (See Seetlon 5005) -4- TEXT 1. PURPOSE. These rules and regulatlons are promulgated ln the lnterest of publlC health and safety, aVlatlon1 and the promotlon of nOlse abatement conslstent wlth and subJect to all appllcable federal, state, and munlclpal laws. They lnterpret and lmplement certaln sectlons of Ordlnance 1137. The underlYlng purpose of these rules and regulatlons lS to control the alrcraft nOlse lmpact around the Alrport so that It does not exceed an annuallzed CNEL of 55 from alrcraft nOlse In resldentlal areas, thereby, lU some part, harrnonlzlng Alrport uses wlth the resldentlal character of the Alrport enVlronment. -5- 2. DEf'INITIOXS. A. For the purposes of these rules and regulat1ons, the def1n1t1on of each term, except as spec1f1cally prov1ded here1n, 15 the same as that conta1ned ln the Federal Aviat10n Regulat1ons, T1tle 14, Code of Federal Regulat1ons, here1nafter referred to as FAR, or contalned ln other appl1cable federal, state, and mun1cipal laws. (1) The term "operator" shall mean pllot-1n- command of an a1rcraft or Cert1f1ed Fl1ght Instructor, wh1le ln actual control of an alrcraft or engaged In fl1ght 1nstruct1on. (2) The terms "est1mated nOlse w1ll exceed" and "would be llkely to exceed" as contalned In Sectlon 3, Subsectlon 9 and 9(a), respectlvely, of the Ordinance 1137, are 1nterpreted to mean, estlmated to be unable to operate at or below the allowable SENEL Ilffi1t upon takeoff at Santa Monlca A1rport. (3) The tenn "m1nlmUffi operatlng gross we1ght," as used here1n, shall mean the Standard Empty We1ght plus 400 pounds for propel1er alrcraft and 800 pounds for Jet alrcraft, or max1mum gross takeoff welght as spec1f1ed by the alrcraft manufacturer, whlchever 1S smaller. (4) The term "Standard Empty Welght," as used hereln, shall mean the we1ght of the alrcraft, plus unusable fuel, operatlng fluids, and fuel all. -6- 3. CATEGORIZATION OF AIRCRAFT BY SENEL. A. CALCULATED SENEL RATINGS OF AIRCRAFT. (1) The Alrport Dlrector shall provlde a Ilst of the calculated SENEL values expected, followlng takeoff, at Santa Monlca Alrport nOlse monltor statlons for any and all alrcraft expected and/or requestlng to use Santa Monlca Alrport. These calculatlons wlll be made ror alrcraft, when operatlng at IDlnlmum gross operatlng welght and when operatlng at welghts progresslvely lncreased 1n 400 pound lncrements, or other appro- pr1ate lncrements, for a glven alrcraft, up to the maXlmum gross takeoff welght for the alrcraft as speclfled by ltS manufacturer. These calculatlons shall contemplate for takeoff operatlons the average annual w1nd speed and d1rectlon, hum1d1ty and temperature condltlons, angles of cllmb, and power cut back for nOlse abatement purposes, If appllcable, to a power and at an altltude WhlCh lS safe, based upon the FAA's standards, or If none eX1st, upon any other reasonably appllcable standard. -7- (2) ThlS llSt shall be prepared by the A~rport Dlrector USlng reasonable technlcal procedures and lnformat~onl w~th the asslstance of those governmental offlclals of the state and federal government, lncludlng the FAA, WhlCh provlde such asslstance. ThlS 11St may be extended and/or modlfled on the basls of publlcatlons to be lssued by the FAA or other rellable sources. ThlS Ilst lS to be prepared from lnformatlon used wlth the FAA Integrated NOlse Model (verslon 1) or FAA approved modlflcatlons thereto for Jet alrcraft and from formulae for propeller drlven alrcraft, If avallable. The Alrport Director shall make a copy of the 11Stl procedures and formulae avallable, upon request, to any lnterested person. (3) The Alrport Dlrector shall prepare tables showlng the effects to be expected on SENEL's, followlng takeoff for certaln types of alr- craft under temperature, wlnd, and humldlty condltlons that dlffer from the average annual values for those condltlons at Santa Monlca Alrport. The range of the table of condltlons wlll cover those to be expected at Santa Monlca Alrport. (4) The owner or operator of any alrcraft model WhlCh lS llsted In Sectlon 3(A) of these rules and regulatlons may show the lnappll- -8- cablllty of the typ~ ratlng to h1S part1cular alrcraft by establ1shlng to the sat1sfact1on of the Alrport D1rector: (a) that sufflclent mod1flcatlons have been made to the alrcraft so as to render the est1mates conta1ned there1n, 1naccurrate, or (b) that the formulae used there1n, are lnappllcable to the spec1f1c model 1nvolved. If the Alrport Dlrector agrees that th1S ratlng lS not appl1cable for the reason(s) stated hereln, the part1cular alrcraft shall be treated as not appear1ng on the banned 11st. The owner or operator of each such a1rcraft shall not1fy the A1rport Dlrector, supply new lnformatlon, and conduct new tests, at any t1me at Wh1Ch a further modlf1cat1on 18 made to the alrcraft WhlCh may affect lts claSS1flcatlon. (5) Any lnterested person may request the A1rport D1rector to estlrnate the proJected SENEL for a part1cular unrated a1rcraft. The request for these SENEL ratlngs shall 1nclude the followlng speclflcatlons, or thelr equlvalents: For Propeller Drlven Alrcraft (Sea Level Operatlon) 1. The Alrport Dlrector, by separate publlcatlon, shall 11St alrcraft types whose estlmated nOlse wlll exceed or WhlCh would be llkely to exceed a SENEL of 85 as measured at Santa Monlca Alrport, when operated at mlnlmum operatlng gross welght. These alrcraft are prohlblted from USlng the Alrport, except In an emergency. C. OTHER AIRCRAFT SUBJECT TO SENEL LIMITATION. The Airport Dlrector shall publlsh an advlsory 11St of alrcraft WhlCh would not be llkely to exceed 85 SENEL at the Santa Monlca Alrport NOlse Monltor Statlons when operatlng at mlnlmum gross operatlng welght under the condltlons descrlbed ln Sectlon 3(A). Such alrcraft would not be type banned alrcraft but would be subJect to the SENEL llmltatlon, as measured at the meter. The Alrport Dlrector will publlSh SENEL values for these alrcraft when operatlng wlth welghts from mlnlmUffi to maXlffium gross takeoff welghts as descrlhed In Sectlon 3(A) (1). D. UNRATED AIRCRAFT. The owner or operator of an alrcraft for whlch expected SENEL on takeoff from Santa Monlca Alrport has not been calculated by the Alrport Dlrector shall be subJect to the SENEL llffiltatlon of 85. E. EXCEPTION FOR NOISE ABATEMENT PURPOSES. If an "unllsted alrcraft" measures an 87 dBA or above at t~e monitor slte, a warnlng wll1 be glven for a flrst vlolatlon. Warnings: For all alrcraft nOlse events measured between an 85 dBA and a 87 dBA SENEL, a warning wlll be lssued and a permanent record shall be kept. E. R. ~36 sets nOlse emisslon crlterla for aircraft certlflcat~on by the rederal AVlatlon Adm1nistratlon. Part 36, Appendlces C & F (14 C. F. R. S36) establlsh the ~ethod of measurement for nOlse certlflcation. The mathematlcal formulae used thereln are adopted, wlth modiflcations, for use In these rules and regulations. As requlred by Sectlon 5 (a) (2) of the NOlse Control Act 1972~ the Envlronmental Protectlon Agency prepared the publicatlon entltled, I1Informatlon on Levels of Envlronmenta1 NOlse Requlsite to Protect PubllC Health and Welfare l1;'l th an Adequate ~1argln of Safety, 11 {Rep. 550/9-74-004 (March 1973)), whlch recommends a CNEL of 55. 2. STATE: Ca11fornla Department of Aeronautics Noise Standards (21 Cal. Ad. Code 5~5000-5080.5 (1977)), partlcularly Sect10n 5012 prescr1bes a current noise 11ffilt of 70 CNEL wlth a mandated maX1MUM level of 65 CNEL by 1986. The standard lS based on a "tYPlcal" commun1ty and does not preclude the establlshment of a lower level based upon the partlcular needs of the communlty. (See Sectlon 5005) 3. SAUTA ~10NICA 11UNICIPAL CODE: Santa ltlonlca flunlclpal Code S;lOl05B (2) (e), amended by Sectlon 3 of Ordlnance 1l37, deflnes "Slngle Event NOlse -ll- Exposure Level" (SENEL) and sets the threshold n01se level at 63 NL. Sectlon 4 (A) (3) of these proposed rules and regulat~ons prov1de that the noise level be calculated from a point 10 dBA below the maXlmum dBA (dBili~) for the reported event when the dB~l of the event lS greater than 10 dBA above 63 NL. Santa Honica Municlpal Code 510105B (8), amended by Sectlon 3 of Ordlnance 1137, prov1des that the QaXlmum permlsslble SE~.JLL shall be 85 declbels. Sectlon 4 (A) (2) of these proposed rules and regulatlons provides a tolerance of 2 dBA for varlablllty of alrcraft nOlse measurement and does not prescrlbe prosecutlon below a measured SENEL of 87 dBA. Santa Honlca ~luniclpal Code ~10105B (9) and (9) (a), amended by Sectlon 3 of Ordlnance 1137, contalns the terms "estlP1ated nOlse wlll exceed" and "would be llkely to exceed," respectlvely. Sectlon 2 (A) (2) of these proposed rules and regulatlons lnterprets these terms to mean, estlmated to be unable to operate at or below the allowable SENEL Ilmlt upon take-off at Santa Monlca A1rport. Pursuant to Ordlnance 1l37, thlS classlflcatlon of alrcraft are prohlb1ted from operat1ng at Santa Monlca A1rport, except In an emergency. -12- Santa Monlea Munlclpal Code Sl0105B (9) (a), amended by Sectlon 3 of Ordlnance 1137, authorlzes the promulgation of a 11St of alrcraft WhlCh would be llkely to exceed the llmlt set at the monltor slte or sltes. Sectlons 3 (A; (I) and (2) of these proposed rules and regulatlons lmplement the preparatlon of the Ilst, and add a sectlon WhlCh permlts the operator or owner to SUbQlt eVldence to show that hlS partlcular aircraft should not be on the Ilst. Santa Iillnlca Munlclpal Code ~10105B (10) (a) I amended by Sectlon 3 of Ordinance 1137, concluslvely presumes an intent to vlolate by Ilsted alrcraft WhlCh, when measured, exceed the SENEL Ilmlt. Sectlon 4 of these proposed rules and regulatlons does not change th~s. Santa Monlca ~uniclpal Code 510105B (10) (b) I amended by Section 3 of Ordlnance 1137, sets forth a rebuttable pre- sumptlon of lntent to violate or crlmlnal neg1lgence when alrcraft exceed the maximum permissible nOlse level, even though, based upon Santa Monlca Munlclpal Code SlOl05B (9) (a) and (b), they would not be expected to do so. Sectlon 3 (B) of these proposed rules and regulatlons provldes a means by WhlCh a partlcular "unllsted alrcraft" can be rated. Sectlon 4 (C) of these proposed rules and regulatlons set forth the treatment of such a vlolatlon; for the flrst -13- v101ation a warnlng is glven, for a second and subsequent violatlon, there ~ay be prosecutlon.
