SUBJECT: Transmittal of PlannIng CommIssIon RecommendatIons on
Land Use Element Portion of Proposed Ordinance
EstablIshing In-LIeu Fees
INTRODUCTION
On November 26, 1985, the CIty CouncIl requested that the
PlannIng CommlSSlon reView and comment on a proposed ordInance
establishing an In-lieu fee optIon for small multI-famIly
resIdentIal proJects and ImplementIng the parks and hOUSIng
In-lieu fee prOVISIons of the Land Use and Clrculatlon Elements.
The Clty CounCIl requested that comments be prOVIded to them by
the January 14, 1986, Councl1 meetIng.
ThIS memorandum transmits the Commlsslon's comments on the Land
Use and CIrculation Elements portIon of the draft ordInance. The
CommlSSlon IS In the process of formulatIng its recommendatIons
on the HOUSIng Element portIon of the ordInance, and WIll forward
Its comments on that sectIon of the ordinance at a later date.
BACKGROUND
After receIVIng the CounCIl's request for comments on the
proposed ordinance, the PlannIng CommISSIon formed a subcommIttee

conslstlng of Commlssloners Israel, Klrchner, and Perlman. On
January 6, 1986 the full Plannlng CommlSSlon dlscussed and
approved the subcommlttee1s recommendatlon to adopt the Land Use
and Clrculation Elements sectlon of the proposed ordInance wIth
the follOWIng amendments:
1. Add the following at the end of subsectlon 2(a):
n...or by providIng eqUIvalent off-SIte Incluslonary hous~ng
and open space subject to reVIew and approval by the PlannIng
Commisslon, wlth appeal permItted to the City Council.1I
2. RewrIte subsectlon 2(f) 1n ltS entirety to read as follows:
IIEach payment made pursuant to thIS Sectlon shall be
deposlted In a Reserve Account to be used exclUSIvely to
develop low and moderate Income hOUSIng or for new park
acqUISItIon and development, ~n such proportion as the CIty
Council shall dIrect follOWIng reVlew and recommendatlon by
the Plann1ng Comm1SS1on, WIth prImary emphasis on low and
moderate lncome houslng.1I
The Commlsslon felt these amendments would add flexiblllty to the
proposed ordlnance.
FINANCIAL/BUDGET IMPACT
The recommendatlons of thIS report have no fInanclal/budget
lmpacts.
