SUBJECT: Ordinance Amending Municipal Code Section 9110A
to Permit Certain parking structures in R-4 District
On June 24, 1986, the City Council directed the City
Attorney to prepare an ordinance to permit certain parking
structures in the R-4 Multiple Family Residential District. (The
Planning commission had previously conducted a public hearing and
recommended approval of the proposed text amendment.) In
response to this direction, the accompanying ordinance has been
prepared and is presented for city Council consideration.
The ordinance amends Santa Monica Municipal Code Section
9110A by adding a new sUbdivision (6).
The new subdivision
permits off-site parking structures in the R-4 Multiple
Residential District in conjunction with the municipal pier or
hotel developments subject to approval of a conditional use
permit. Hotel related parking structures must be located within
300 feet from the site occupied by the hotel.
Public notice of the city Council's consideration of this
ordinance has been given in the manner required by Municipal Code
Section 9149C(2) .

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA AMENDING SECTION 9110A OF THE SANTA
MONICA MUNICIPAL CODE TO PERMIT OFF-SITE PARKING
STRUCTURES IN CONJUNCTION WITH THE MUNICIPAL PIER
OR HOTEL DEVELOPMENTS IN THE R-4 DISTRICT
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1. section 9110A of the Santa Monica Municipal Code
is amended to read as follows:
Section 9110A.
Uses Permitted.
The
following uses are permitted in the "R-4 II
MUltiple Residential District:
1. All uses permitted in the "R-l",
IIR-2-RII, "R-211 and IR-3" Districts.
2. Apartment hotels.
3 .
Hotels,
in
which
incidental
business may be conducted only as a service
for persons living therein, provided there is
no entrance to such place of business except
from inside of the building and that no sign
advertising such business shall be visible
from outside the building.

4. Clubs
.
or lodges,
private and
non-profit, chartered as such by the state,
excepting those the chief activity of which
is service customarily carried on as a
business.
5. Nursery schools or child care, not
exceeding 10 children, under six years of
age.
6.
Notwithstanding
any
other
provisions of this Article, off-site parking
structures in conjunction with the municipal
pier and any hotel may be permitted subject
to the approval of a conditional use permit.
Hotel parking structures may be permitted
only if the structure begins not more than
300 feet from the exterior boundary of the
site occupied by the hotel.
SECTION 2.
Any provisions of the Santa Monica Municipal
Code or appendices thereto inconsistent vlith the provisions of
this ordinance, to the extent of such inconsistencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of this ordinance.
SECTION 3. If any section, subsection, sentence, clause, or
phrase of this ordinance is for any reason held to be invalid or
unconsti tutional by a decision of any court of any competent
jurisdiction, such decision shall not affect the validity of the

The city council hereby
declares that it would have passed this ordinance and each and
every section, subsection, sentence, clause of phrase not
declared invalid or unconstitutional without regard to whether
any portion of the ordinance would be subsequently declared
invalid Dr unconstitutional.
SECTION 4.
The mayor shall sign and the city Clerk shall
attest to the passage of this ordinance.
The city Clerk shall
cause the same to published once in the official newspaper within
15 days after its adoption. The ordinance shall become effective
after 30 days from its adoption.
