Background The Clty may provlde yellow loading zones adJacent to commercial establishments if the following criteria eXist: 1) Sufficient loading activity exists to warrant reducing curb parking by lnstalling the more restrictive loading zone. 2) Curb availabillty for loading is insufficient due to heavy area parking demand. 3) Off-street or alley loading 1S not permitted. A loading zone 1S installed and maintained by the City at no charge to the requestor. Parking;s prohibited in a loading zone on a 24 hour basis. Usually deliveries are made between 7:00 a.m. and 6:00 p.m. on weekdays with a few on Saturdays. Thus, the loading zones are not being used from 6:00 p.m. to 7:00 a.m. In addition, the City's revenue from a potent1al on-street parklng meter location 1S lost. Section 21458(b) states that yellow zones ind1cate stopping only for loading and unloading of passengers or freight for such tlme as may be specified by local ordinance. The proposed $100 fee per 25-foot sect10n of yellow loading zone marking will cover the cost of installation and maintenance and offset some of the revenue lost from a parking meter space. Recommendation Clty Staff recommends the Clty Council direct the City Attorney to prepare an ordlnance establlshing a fee for loading zones and modify the existlng ordi- nance to prohlbit parking from 7:00 a.m. to 6=00 p.m., Monday through Saturday. (CITY COUNCIL SERIES) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING TO SECTION 3365A OF CHAPTER 3 OF ARTICLE III OF THE SANTA MONICA MUNICIPAL CODE REGARDING YELLOW LOADING ZONES. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN: SECTION 1. Sectlon 3365A is hereby added to Chapter 3 of Article III of the Santa Monica Municipal Code and shall read as follows: "(A) If factors listed in Section 3365 are satisfactorily shown to exist, the parklng and Trafflc Engineer may establish a yellow loading zone, but such zone shall be established only upon receipt of an initial fee of $100 per 25 lineal feet of curb, or portion thereof, from the requestor(s). Thereafter, the Parking and Traffic Englneer shall cause an annual bill to be mailed on July 1 to the requestor(s). Such blll shall be in the amount of $100 per lineal feet of curb, or portion thereof, to be maintained as a loadlng zone. If the annual fee 1S not received 1n the Office of the Parklng and Trafflc Eng1neer by August 15, the Park1ng and Traffic Engineer shall cause the yellow loading zone curb marklngs and any appurtenant signs to be remove d v II -1- e e SECTION 2. If any section~ subsection~ sentence~ clause or phrase of thlS ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decislon shall not affect the validity of the remainlng portlons of the ordinance. The Clty Council hereby declares that it would have passed this ordlnance and each and every section, subsection, sentence, clause or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordlnance would be subsequently declared lnvalid or unconstitutlonal. SECTION 3. The Mayor shall sign and the Clty Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper within fifteen (I5) days after its adoption. The ordinance shall become effectlve after thlrty (30) days from the date of lts adoption. -2-
