This ordinance was lntrodueed by the City Counell at the February 26t 1980 meeting (Item 8-E) and contlnued to the March 4 meeting. The report also transmits a resolutlon setting parklng meter rates in Clty- owned and operatlon lots. Background On January 22, 1980t the Parklng Authorlty recommended to the City Council that staff be directed to amend the parking meter ordinance ralsing the parking meter rates in Zone E to 25c per hour. In addltlont the Counell dlrected staff to amend the ordlnance to lnclude in Zone D the western portion of Lincoln Boule- vard between Mlchlgan Avenue and Pica Boulevard. Staff took this opportunlty to update the entire parking meter ordlnance by modernlzlng the language and by raising the rates ln Zone B to 10~ an hour to meet current lnflatlon. In order to accomplish thlS, on March 4t 1980, the City Councll accepted this ordinance (IteM 8-E) for flrst readlng. At that tlme the resolutlon was attached for Council review. If the proposed ordlnance 15 adoptedt staff will need funds from parking meter revenue for the replacement and purchase of parking meterS. Staff wlll be able to convert the existing 200 Zone B meters at a cost of $4,000, ~-y APR 8 1980 ~ ......a:=....__ . . To: Mayor and Clty Councll -2- March 24, 1980 but wlll be requlred to buy 115 new parking meters for Zone E at a cost of $7,800. Recommendation It is respectfully recommended that the City Council adopt both the ordlnance amending Chapter 3A of Article III and the resolution setting parking meter rates In Clty-Owned and operated lots. It 1S further recommended that $4,000 be appropriated from the Parking Meter Revenue Accounts for the replacement of 200 parking meters in Parklng Meter Zone B and that $7,800 be approprlated for the purchase of 115 parklng meters in Zone E. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN: SECTION 1. Chapter 3A of Artic~~ III of the Santa Monica Municipal Code is hereby replaced and shall read in its entirety as follows: Chapter 3A -- Parking Meters SECTION 3387. All of the provlslons of this Code concernlng the parklng of vehlcles and the regulatior of the parking of vehicles by the use of parklng meters are expressly enacted under the Constltutlon of the State. Article XI, Sectio~ 11, together with provisions of the Vehicle Code of the State. as amended. The provlslons set forth ln the Vehlcle Code shall govern whenever thlS Code fails to set forth any speclflc provisions. SECTION 3388. Deflnltions. For the purpose of thlS Chapter, certaln words and phrases are defined and certaln provisions shall be con~true~ as herein set forth unless it is apparent frOM the context that a different meaning is intended. SECTION 3388A. COln. The vJOrd "coin" shall mean any lawful C01n or co~b1natlon of coins of the United States of America as deslgnated by the legend on the parking meter. SECTION 33888. Hollday. SECTION 3388C. Operator. The I'ford "operatorll shall mean and include every 1nd1viduall who shall operate a vehlcle as the owner, or as the agent, employee or permittee of the owner, or who 1S 1n actual physical control of a vehicle. SECTION 3388D. Parking Meter. The words "Parklng Meter" shall mean any mecha~ical device or meter ereGted for the regulation of parking ~ by authority of this Chapter. SECTION 3389. Authority of the Parking and Traffic Englneer. SECTION 3389A. Deslgnat10n of Park1ng Spaces. The Parklng and Traffic Engineer is authorized and empowered to ~ark off individual parking spaces in all Zones. Said parking spaces shall be designated by lines painted or durably marked on the surface of the street or on the curb. SECTION 3389B. Installation of Park1ng Meters. The Parking and Traffic Englneer is authorized and empowered to install parklng meters upon the curb or sidewalk or other location provided lmmed1ately adjacent to designated parklng spaces, as he deems necessary. Each device shall display a slgnal showing legal parking upon the deposlt of appropriate coin and upon exp1ration of the lawful time limit shall 1ndicate by a proper visible slgnal that the lawful parking -2- e e period has expired. No parklng meter shall be capable of registering permitted parklng time in excess of the time limit established by the Parking and Trafflc Engineer. SECTION 3389C. Maintenance of Parklng Meters. The Parklng and Traffic Eng1neer shall be responsible for the maintenance and operation of the parking meters. SECTION 3389D. Reservation of Powers. Nothing in this chapter shall be construed as prohib1ting the Parking and Traffic Engineer from providing for pedestrian crosswalks, bus stops, and taxicab stands and other matters of similar nature~ including the loadlng and unloading of trucks, vans, and other commercial vehicles, nor as proh1bltlng said Park1ng and Traffic Engineer from establ1shing maXl~um parking time limits pursuant to powers granted in Chapter 3 of thlS article. - SECTION 3390. Operat1on of Parklng Meters. When any vehlcle shall be parked In any metered parking space. the operator immedlate1y shall deposit the requ1red coin in the manner prescribed on the parking meter unless the parking meter lndicates an unexplred portion remalns of the period for which coins had been deposited previously, or in a period of emergency determined by an officer of the Fire or Police Department, or 1n compllance w1th the directions of a police officer or traffic control sign or signal. In no event shall it be lawful to park a vehicle in a designated metered park1ng space in excess of the maxi~um parking time 11mit set by the Parking and Traffic Englneer. -3- e e SECTION 3391. Enforcement. It shall be the duty of the Police Department to enforce the provis1ons of thlS Chapter. SECTION 3392. Funds Derived from Parking Meters. SECTION 3392A. Collect1on. The Director of Flnance shall be authorized to make regular collections of the money_geposited in the parking meters and to dellver the money to the C1ty Trea~urer who shall count and deposit the funds. SECTION 33928. Use of Funds. The COlns deposited in park1ng meters shall be used to defray the expense of proper regu1atlon of trafflC UDon the publ1C streets of the City; to provide for the cost of supervision, regula~lon and control of the park1ng of vehicles 1n parking meter zones; and to cover the cost of purchase. superv1sion, protection, inspection, instal1atlon. operation, maintenance, control and use of parklng meters and may be used for such other purposes as are proper. ~ , SECTION 3393. Parking Meter Zones. The City shall be dlvided into the followlng parklng meter zones and each zone shall be subject to the rules and regulatlons establlshed for that zone, as set forth below: SECTION 3393A. Parklng Meter Zore 11AII. (1) The following na~ed and described streets or portions of streets w1thin the City shan constitute Zone IIAII. namely: (a) All of Ocean Avenue and all streets southwesterly thereof, includlng the mun1cipal pier, and excludlng the area bounded by PieD Boulevard -4- e e to the South City limits, Neilson Way to Ocean Avenue-Barnard Way, lnc1usive; (b) All streets lying within the area bounded by Ocean Avenue, llncoln Boulevard, California Avenue and Colorado Avenue, including both sides of the boundary streets with the exceptlon of Lincoln Boulevard which shall not be included in this Zone; (c) All of Wilshire Boulevard to the easterly city limlts from llncoln Boulevard. (2) Parking a veh1c1e in a designated space in Zone lIAn shall be lawful for 60 minutes upon the deposit of 10 cents in coin, and for an additlonal 60 minutes for each 10 cents in coin deposited thereafter. (3) Parking meters shall be operated in Zone "A" every day between the hours of 9:00 a.m. and 6:00 p.m. SECTION 3393B. Park1ng ~1eter Zone "811. (1) The fol1ow1ng named and descrlbed streets. or ..... portions of streets within the City shall constitute Zone "B", namely: (a) All streets or portions of streets in the area bounded by Broadway, Twentieth Street~ Virginia Avenue~ and the Easterly city limits, 1ncludlng both sldes of the boundary streets. (b) All of Colorado Avenue fro~ Lincoln Boulevard to Twentleth Street. (2) Parking a vehicle ln a des1gnated space In Zone liB" shall be lawful for 60 minutes upon the deposit of 10 cents ln CQ1n, and for an add1tlonal 60 ~inutes for each 10 cents 1n coin deposited thereafter. (3) Parking meters may be operated in Zone "B" twenty-four hours per day or less, as posted by the Park1ng and Traffic Engineer. -5- e e SECTION 3393C. Parklng Meter Zone IIC". (1) All streets within the City not specifically described ln thlS sectlon shall constitute ZOlle nC". (2) Parklng a vehicle 1n a designated space in Zone "C" shall be lawful for 60 minutes upon the deposit of 5 cents in COln and for an addit10nal 60 mlnutes for each 5 cents in C01n deposited thereafter. (3) Parklng meters shall be operated in Zone "C" every day between the hours of 9:06 a.m. and 6:00 p.m. except Sundays and holidays. -- SECTION 33930. Park1ng Meter Zone "0". (1) The following named and described streets or ~ portlons of streets of the City shall constitute Zone 110"; namely (a) P1CO Boulevard to the South City Llmits, Neilson Way to Ocean Avenue - Barnard Way inclusive. (B) All of the westerly portion of Lincoln Boulevard from Michigan Avenue to Pico Boulevard. (2) Parking a vehicle in a des1gnated space 1n Zone "0" shall be lawful for 60 minutes upon the deposit of 25 cents in coin, and for an add1tlonal 60 minutes for each 25 cents 1n coin deposited thereafter. (3) Parking ~1eters shall be operated in Zone "0" every day between the hours of 9:00 a.m. and 6:00 p.m. -, SECTION 3393E. Park1 ng Meter Zone "E". (1) The fo11owing named and descr1bed streets or portlons of streets lying withl n the City shall constitute Zone "Ell; namely all streets lYlng within the area bounded by Pico Boulevard, Third Street, Southerly city lim1ts ar]d Nellson Way, exclusive of the boundary streets. -6- e e (2) Parking a veh1cle in a designated space 1n Zone liE" shall be lawful for 60 minutes upon the depos1t of 25 cents in coin, and for an additlona1 60 minutes for each 25 cents 1n C01n deposited thereafter. (3) Parking meters ~ay be operated in Zone "E" 24 hours per day or less, as posted by the Parking and Traffic Engineer. SECTION 3394. Violations It shall be unlawful and a v1olation of the provisions of this chapter for any person: ~ SECTION 3394A. To cause, allow, permit or suffer any vehicle registered in the name of, or operated by such person to be parked over- t1we, or beyond the period of legal parking time estab11shed for any park1ng meter zone as herein described, or to deposit i~any park1ng meter any coin for the purpose of parklng beyond the maximum legal parking time for the particular parking meter zone. SECTION 3394B. To permit any vehicle to remain or be placed 1n any parking space adjacent to any parking meter while said meter is displaY1ng a signal indicating that the vehicle occupying such parking space has already been par~ed beyond the perlod prescr1bed for such parking space. SECTION 3394C. To park any vehicle across any line or marking of a parklng weter space or in such position that the vehicle shall not be entirely wlthin the area designated by such lines or markings. SECTION 3394D. To deface. injure. tamper wlth, open or wllful1y break, destroy, or impare the usefulness of any parklng meter installed under the provislons of this chapter. SECTION 3394E. To deposit or cause to be deposlted in any parking meter any slugs, devlce or metal substance, or other substitute for lawful coins. -7- ~ e tit SECTION 3395. Norw1t~standing any other prOV1S10n of this Code to the contrary, violation of Sectlons 3202, 3205, 3206, 3208t 3326, 3326A, 3326B, 3326C, 33260, 3337, 3345. 3372, 3374A 3375A or 33758 of this Code shall be punishable by the following fines: 1. If court appearance is made or bail posted within the time set forth in the not1ce of cltation of the violation, not less than Ten Dollars ($10.00); and 2. If no appearance lS made nor required bail posted as set ~ forth 1n Subsection 1 above, after notice 1S given pursuant to Sect10n 41103 of the California Ve~icle Code and a warrant of arrest is issued, ~ not less than Fifty Dollars ($50.00) shall be assessed. SECTION 3395A. Notwlthstandlng any other pro~s;Dn of this Code to the contrary, violat1on of Section 3210 of thlS Code shall be punishable by the following fines: 1. If court appearance lS made or ball posted withln the time set forth in the notice of citatlon of the violatlon, not less than Twenty-five Dollars ($25.00); and 2. If no appearance is made nor required ball posted as set forth In Subsection 1 above. after notice 15 given pursuant to Sectlon 41103 of the California Vehicle Code and a warrant of arrest ~s issued. not less than One Hundred Dollars ($100.00) s~a11 be assessed. ~ SECTION 3395B. Notwithstanding any other provision of this Code to the contrary, violation of Sections 3201. 3364, 3365. 3366, 3371. 3373. 3374, 3375, 3394, 3394A. 3394B, or 3394C of this Code shall be punlshable by the follo~lng fines: -8- .. e It .. 1. SECTION 2. Any provision of the Santa Monica Munlcipal Code or ~ appendices thereto inconsistent therewlth, to the extent of such inconsis- tencies and no further, are hereby repealed or modified to that extent ~ necessary to affect the provis1ons of this ordinance. SECTION 3. If any sectlon, subsectlon, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutlonal by a decision of any court of any competent jurlsdlctlon, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause or phrase not declared inval1d or unconstitut1onal without regard to whether any portion of the ordinance would be subsequently declared invalld or unconstitutlona1. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this ordlnance. The Clty Clerk shall cause the same to be published once in the official newspaper within flfteen (15) days after its ~doptlon. Background On March 4, 1980. a proposed ordinance replacing the present Chapter 3A of Artlc1e III of the Munlclpa1 Code was introduced at the Clty Councll Meeting. The ord1nance will appear on the April 8 City Counc1l Agenda for second read1ng and adoption. If the ordlnance 1s_adopted, it will be necessary for the Park1ng Authorlty to adopt the attached resolution In order to malnta1n the current parking meter rates in the various Parking Authority operated lots. The reso- lution w11l take effect on the effectlve date of the ordinance. ~ Recommendation It is recommended that the Parklng Authorlty adopt the attached resolutlon to take effect on the effectlve date of the Ordlnance. (Parking Authorlty Serles) A RESOLUTIO~ OF THE PARKING AUTHORITY OF THE CITY OF SANTA ~\maCA SETTING PARKING METER RATES IN OFF-STREET PARKING FACILITIES WHEREAS, the Parking Authorlty of the City of Santa Monlca is empowered by Sectlon 22519 of the Vehlcle Code of the State of Cal1fornia to regulate off-street park1ng, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. Par41ng Meter rates for all parking lots operated by the Parklng Authorlty shall be 20 cents in COln for one hour and an additional one hour for each 20 cents in C01n deposlted thereafter! provlded that C01ns shall not be deposlted so that the parklng tlme exceeds 12 hours. SECTION Z. The City Clerk shall certlfy to the adoptlon of this resolution and thenceforth and thereafter the same shall be in full force and effect.
