TO: Mayor and city council FROM: city staff 001-1J{) 2- SUBJECT: Cable Television Franchise Status Introduction This item recommends that the City Council schedule consideration of award of a cable television franchise to Century Southwest Cable Television, Inc. for February 23, 1988. Background On December 8, 1987 the City Council authorized Staff to continue negotiations with Century Southwest Cable Television, Inc. and voted to take no action against Century to enforce either the expiration or termination of the franchise until February l5, 1988. Negotiations have proceeded to a point where Staff feels a proposal is imminent regarding award of a non-exclusive cable television franchise to Century. However, due to the signiflcant amount of pUblic interest in this issue, staff feels it is lmportant to allow sufficient time for the public to be notified of the meeting and the content of the proposal. Therefore, cons~deration of the ltem on February 23 is recommended. Assuming posltive Council action on the 23rd, staff would proceed with ..... prepara...lon of the franchise ordinance and settlement - 1 - b-L FE8 0 q 1gea agreement which would be returned to council within approximately 90 days for public hearing and further Council consideration. Recommendation It is recommended that the city Council: 1) Schedule consideration of a proposed non-exclusive cable television franchise and settlement agreement with century Southwest Cable Television, Inc. for the February 23, 1988 city council meetlng. 2) Take no action against century to enforce either the expiration or termination of the franchise until March 9, 1988 pending extension of the existing waiver by Century and the City that the delay will not waive any rlghts of either party.
