AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SECTION 6623A
OF THE SANTA MONICA MUNICIPAL CODE RELATING
TO CABLE TELEVISION UTILITY USERS TAX
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN
AS FOLLa'lS:
SECTION 1. Sect~on 6623A of the Santa Monica Munlclpal
Code 15 amended to read as follows:
SECTION 6623A. Cable Telev~sion.
(a) Commencing on January 1, 1984,
there is hereby ~mposed a tax upon every
person ln the Clty of Santa Monica using
in the Clty a cable televis~on service.
The tax lmposed by this Section shall be
five per cent (5%) of the charges made for
such cable televislon servlce and shall be
paid by the person paying for such cable
teleV1S1on serVlce.
(b) For purposes of thlS Section,
cable television service shall mean a
televlS10n slgnal dellvered by cable for a
fee or charge.

SECTION 2. Any prov~s~on of the Santa Mon~ca Mun~c~pal
Code or append~ces thereto incons~stent w~th the provis~ons of
th~s ord~nance, to the extent of such inconsistencies and no
further, are hereby repealed or mod~f~ed to that extent
necessary to affect the provlsions of th1S ord1nance.
SECTION
3.
If any sect~on,
subsection,
sentence,
clause,
or phrase of th~s ordinance is for any reason held to
be lnvalld or unconstltutional by a decislon of any court of
any c~petent Jurlsdlction, such deciSlon shall not affect the
valldity of the remaining portions of the ordinance. The C~ty
Counc~l hereby declares that it would have passed this
ordinance and each and every section, subsect~on, sentence,
clause or phrase not declared lnvalld or unconstitutlonal
wlthout regard to whether any portion of the ordinance would
be subsequently declared ~nvalld or unconstltutional.
SECTION 4.
The Hayor shall s1gn and the Clty Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause the same to be publ~shed once in the offic~al
newspaper w~thin 15 days after ~ts adoption. The ornlnance
shall becOMe effectlve after 30 days from ~ts adoption.
