SUBJECT: Ordinance to Prohibit Use of Railroad Rights of
Way for Other Than Transportation Purposes
On July 22, 1986, the city Council directed the City
Attorney to prepare an emergency ordinance to prohibit the use of
transportation rights of way in the City for other than
transportation purposes for a period of not more than one year.
In response to this direction, the accompanying ordinance has
been prepared and is presented for City Council consideration.
The accompanying ordinance amends section 3 of Ordinance
Number 1321 (CCS) to implement this provision.
(Ordinance Number
1321 (CCS) establishes development review procedures pending
adoption of the revised zoning ordinance.) As amended, Section
3 (b) of Ordinance Number 1321 (CCS) would provide that any
development in the Santa Monica Branch Line of the Southern
Pacific transportation right of way must be for transportation
purposes.
Section 3 (b) of Ordinance Number 1321 (CCS) shall
expire by its terms one year from the date of adoption.
