Before the CIty can determIne whether to approve or particIpate In the proJect, an EnvIronmental Impact Report (EIR) assessIng various development and fInancIng options must be prepared. It IS recommended that the developer recel ve reImbursement of fees related to preparatIon of the reqUIred EIR If, as a result of further CIty consIderatIon of the proJect, the City relIes on the ErR as the prInCIpal envIronmental analysis in bUIldIng the structure Itself. On September 17, 1984, the PlannIng CommIssion conducted a publIC hearing to recel ve publIC comment about a proposal submItted by Russell Barnard to undertake a JOInt venture wIth the Parking AuthorI ty to construct and operate a structure on the ParkIng Author 1 ty par king lot on Ne 11son Way between KInney and HIll Streets. The structure, as proposed, would help satisfy the parklng reqUIrements of a prlvate development on another Main street property owned by Mr. Barnard as well as provide addItIonal parklng to serve Maln Street bUSlnesses south of Ocean /1-' 8 - 1 - ;: 9 'Z ~ 1. e e Park Boulevard. Briefly, the proposal calls for constructIon of a 5-level (one below grade), 675 space parking structure on the City owned 150 metered space Parking Authority lot bounded by NeIlson Way, KInney Street, the alley between MaIn Street and the present parklng lot and HIll Street. Under the proposal, the CIty would lease the parking lot to the applIcant, issue bonds for construction and proVIde shuttle buses. FollowIng the public hearIng durIng WhICh members of the publIC vOIced concerns about nOIse, traffIc and aesthetIc Issues, the Commission Identified varIOUS Issues that needed further Investigatlon. On November 21, 1984 staff completed an Ini t ial study on the proposal which concluded that the proposed proJect had the potential to cause slgnlfIcant adverse Impacts that should be further analyzed in an EIR Including: fInanclal feaSIbIllty; documentIng parkIng need; traffIc/cIrculatIon Impacts; noise and aIr quaIl ty Impact; land use compatlblll ty; and neIghborhood impacts. PrIor to completIon of the envlronmental and fInanCial analysIs no assessment can be made by staff or the publIC of the vlabIlity of the prOject and therefore no posi t ion has been taken or:. the mer Its of the proJect. Upon completion of the report, the project would undergo the usual publIC hearIng and reVlew processes before both the PlannIng Commlsslon and City Council. In December 1984 staff selected a consultant to prepare the EIR following rev iew of proposals from five qual i fled fIrms. The cost of the EIR is approximately $30,000 and will take up to two and one-half months to complete once Mr. Barnrd deposIts a check - 2 - . e e for the full cost of the E1 R wIth the Cl ty. Before deposltlng the requIred check, however, Mr. Barnard seeks assurance that If the City utIlizes the envIronmental documents prepared on his proJ ect propos al as the pr InCl pal en v ironmental documents upon which a future proJect 1S constructed, Instead, by the CIty itself, that reImbursement will be made to him for the cost of preparing the envIronmental documents. ThIS re1mbursement proposal is clearly understood by both partIes not to constItute any IndIcatIon of conceptual approval or eventual support by the CIty of the project appllcat1on. All normal CIty processes and procedures will be adhered to In consider1ng the environmental documents and the merits of the proJect. Budget/Fiscal Impact At thIS tIme there is no budget or fiscal Impact of the recommendatIons below. Recommendation Author lze the CIty Manager to amend the standard EIR payment agreement wIth Russell Barnard to prOVIde reimbursement for the preparation cost of the EnVIronmental Impact Report prepared for the proposed Main Street parkIng structure, should that document be used in the future by the CIty as the prInCIpal envIronmental source document for constructIon of a structure.
