INTODUCTION This report recom~ends the Parking Authority instruct the City Attorney to prepare an agreement with Webster & Perloff for Main Street ingress and egress from Parking Authorlty lot 11 and author~ze the Executive Secretary to execute the lease agreement. BACKGROUND One of the 1982-83 Flscal Year Budget goals for the Parking Authority is to upgrade, landscape, and lnstall parking meters in Parking Authority lot 11 located in the 2400 and 2500 blocks of Nellson Way. The proposed plans for lmprovements wl1l be simllar to the Neilson Way lots south of Ocean Park Boulevard. The maJor problem with Parklng Authority lot 11 1S the lim1ted access to the lot. The only entrance to the lot lS off of Hollister Avenue. Hollister Avenue is one-way eastbound. This means lf an indivldual wlshes to use the lot from Maln Street they must drive to Ocean Park Boulevard to Neilson Way to Hollister Avenue. Once an indlvldual parks they must use Hollister Avenue to go to either Main Street or ~el1son Way for there are no other openlngs. Staff believes it lS highly desireable to provide Main Street access to lot 11. The Main Street lngress and egress will make it eaSLer for people to park in lot 11 and walk to Main Street. Staff proposes the Parking Authority enter into a long term agreement with Webster & Perloff to prov~de an accessway to Ma~n Street immed~ately north of the Galley Restaurant. The Parking Authority will provide Webster & Perloff spaces for their use and the a~rr~ghts over the accessway for the term of the agreement. One way to provide the parking spaces is to gurantee Webster & Perloff 20 perm~ts per month for the term of the agreement. Th~s will reduce any potential enforcement problems. The proposed agreement w~ll not involve any transfer or appropriation of funds. The agreement will not commit the City to approve any partlcular type of development which may otherwise be in conflict wlth Clty zoning and other development standards. RECOMMENDATION It is recommended the Parking Authority ~nstruct the City Attorney to prepare an agreement w~th Webster & Perloff for Main Street ingress and egress from Parklng Authority lot 11 and authorize the Executive Secretary to execute the agreement. June 9, 1981 To: Chairman and Parklng Authority From: City Staff Subject: Parking Authorlty Lot 11 and 11A IntroductlOn This report recommends termlnation of the agreement between the Parking Authority and the ~1ain Street fl'1erchants Parking ASSOClatlOn and appropriate- 51-75,000 to landscape and install parking meters on Parking Authority Lot 11. Background In Aprl1, 1975, the Parklng Authorlty adopted an agreement (Attachment 1) where- In the Maln Street Merchants Parking Associatlon (MSPA) would be permitted to lease parking spaces in Parking Authority Lot 11A (behind the Malnsail and Galley Restaurants) on a month-to-month basis at a rate of $4.00 per space per month. The MSPA membership consists of Santa Monica Shores, Santa lbnica Cab Conpany, Bay Mercedes-Porsche, Old Venice Noodle Company, Tom's Body Shop, Mainsail, the Galley, Plckers LTD, and Shorty Harper's Auto Detall. As a condltion of this agreement, MSPA agreed to have one representative of the MSPA collect the monthly payments for the 70 spaces ($280.00 per month) from the varlOUS businesses leasing the parking spaces. This sltuation prevailed until the MSPA representatlve re- signed due to the lack of cooperation of the other MSPA members ln paying. The last check we received from any of the f1SPA members was in November, 1980. Several of their checks have been returned by the bank due to lnsufficlent funds. It is our estlmate the MSPA owes the City $2000 In back parklng fees. Staff has ob- served many of the leased spaces being used for working on automobiles by the auto body repalr shops. In addit1on, Staff has received numerous complaints about oil and debris dumped in the lot, often clogging dralnage pipes. Article 12 of the NSPA and Parklng Authority 11cense agreement states, "This agreement shall be in effect on a month-to-month basis and may be terminated by e1ther of the aforementioned parties (MSPA and/or the Parking Authority) by the glving of thirty (30) days written notice. II Staff has dellvered notices to all members of the MSPA adv1s1ng them of tonlghts meeting. Reconmendation It is recommended the Parking Authority: 1) Approve the attached resolutlon lnstructing the Executive Secretary of the Parking Authority to terminate the Main Street Parking Association License Agreement for Parking Authority Lot llA, 2) approve the attached resolution to increase the monthly parklng fees 1n Parking Lot 11 and 11A to $20.00 per month and lim1t the number of perm1ts sold to 30 percent of the lot (50 spaces of a total of 165); and 3) appropriate $125,000 from the Parking Authority Reserves to improve Parking Lot 11 and 11A by providlng landscaping and parking meters. It should be noted the Llcense Agreement specifies both Lots lOA and llA as part of the Agreement. Lot lOA has already been converted to a metered parking lot and 1S no longer part of the License Agreement. The Associatlon agL~es to pay to the Authority the surn of lour ($4.00) Dollars per nO!1th per space for a mlnlmum of one hundred flfty (150) spaces in the said Neilson Way lot. The ASSoclatlon further understands and agrees that any vehicle parked in a parklng space or area for WhlCh a legitiwate parking space has not been issued by the Authorlty is subJect to a cltation by the Santa Mon1ca Pollce Depart~ent, and tile Authority shall not be held responsible for any citatlons issued in th~s regard. 11. The Authorlty and the ASSoclatlon further understand and agree that each shall have the rlght of prior approval for any changes in the terms and condltlons under said llcense agreement, included but not limited to, any changes in the monthly rates and any change in the number of spaces requested by the Association from the Authority. l4. Each and every question with respect to the construction and interpretation of thlS license agreement; and the rlghts and liabllltles of the parties hereto, shall be governed by the laws of the State of Calif?rnia and the City of Santa Monlca. 19. The Authority and.the Association further understand and agree that thls instrument contains the sole and only agreement between them concerning the issuance of rights for parking spaces in the Neilson Way lots lOA and llA and correctly sets forth thelr rlght5 and obligatlons to each other concerning the licensing of said Nel1sop Way parking lots ~ A lO and 11. Any agree~ent or representation respect~ng t~ ~ matters covered by thlS agreement or the dutles of either the Authority or the Association ln relation thereto not expressly set forth in this instrument is null and vOld. 20. (Parklng Authority Series) A RESOLUTION OF THE PARKING AUTHORITY OF THE CITY OF SANTA ~10NICA ESTABLISHING PARKING PERHIT FEES FOR PARKING AUTHORITY LOT 11 and 11A AT $20 PER ~,10NTH. WHEREAS, the Parking Authority of the Clty of Santa Monica is empowered by Section 22419 of the Vehicle Code of the State of Callfornla to regulate off street parklng, NOW, THEREFORE, THE PARKING AUTHORITY OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. Parking Permlt fees for Parking Authority Lot 11 and llA shall be 520.00 per month per space. SECTION 2. 30 percent of the avallable parking spaces shall be avail- able for permlt parking on the southern end of the lots. SECTION 3. (Parking Authority Series) A RESOLUTION OF THE PARKING AUTHORITY OF THE CITY OF SANTA MONICA INSTRUCTING THE EXECUTIVE SECRETARY TO TERMINATE THE MAIN STREET PARKING ASSOCIATION LICENSE AGREEMENT FOR PARKING AUTHORITY LOT llA. WHEREAS, the Parklng Authorlty adopted a license agreement wlth the nain Street Parking Association (r'1SPA) to lease 70 spaces in Lot llA on a month to month to month basis; and WHEREAS, as part of the license agreement the MSPA agreed to collect . the monthly payments from the various businesses leasing the parklng spaces; and WHEREAS, the MSPA has not complied with the llcense agreement in collectlng the monthly payment; and WHEREAS, the MSPA has not pald for the leased spaces since November, 1980; and WHEREAS, the C1ty has received complalnts of oil and debrls dumped ln the lot, often clogglng drainage pipes; and WHEREAS, Artlcle 12 of the MSPA and Parking Authority License Agreement states the agreement "shall be ln effect on a month to month basis and may be termlnated by either of the aforementioned parties by the giving of thlrty (30) days written notlce. II NOW, THEREFORE~ THE PARKING AUTHORITY OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOllOWS: SECTION 1. The Execut1ve Secretary 1S instructed to termTnate the Llcense Agreement between the Parking Authorlty and the Hain Street Parking ASSOc.lation. SECTION 2.
