SR-8-E . .~-~ Santa Monica, Ca11fornia CA:RMM:rmd897jhpca City Council Meeting 5-23-89 STAFF REPORT TO: Mayor and City Council FROM: city Attorney SUBJECT: Ordinance Amending Santa Monica Municipal Code Sections 3393A, 3393B, 3393C, 3393D, 3393E, and 3393F and Repealing Municipal Code section 3393G Increasing Parking Meter Rates and Authorizing Parking Meters to Be Placed on Various city Streets At its meeting on May 9, 1989, the city council directed the City Attorney to prepare an ordinance amending applicable provisions of the Municipal Code to increase parking meter rates and establ ish parking meter zones for additional streets. In response to this direction, the accompanying ordinance has been prepared and is presented to the City Council for its consideration. Currently, Municipal Code sections 3393A through 3393G establish seven parking meter zones in the city. These sections have been revised to create six parking meter zones establishing the rate structure approved by the City Council at its meeting on May 9, 1989. Santa Monica Municipal Code Seetlon 339 3A is amended to read as follows: SECTION 339 3A. parking Meter Zone "A.II ( a) The following named and descrlbed streets or portlons of streets Wl.thln the city shall constitute Zone "A:" (I) All of Montana Avenue from~ 7th street to 17th street and all side streets intersecting Montana Avenue from that intersection to a point where commercially zoned parcels end. (2) Twenty-Sixth street from Georgina Avenue to San Vicente Boulavard. - 1 - . . (3) All streets lYlng wlthin the area bounded by Ocean Avenue, Lincoln Boulevard, Californla Avenue, and pico Boulevard, including both sides of the boundary streets, except that Ocean Avenue, Main street, the City Hall Parking Lot, and Pico Boulevard between Third street and Ocean Avenue shall be excluded from such area. (4) All streets within the City not specifically included in any other Zone. (5) All streets lying within the area bounded by wilshire Boulevard, Santa Monica Boulevard, Lincoln Boulevard, and the eastern City limits, including both sldes of the boundary streets. (6) All side streets intersecting Wilshire Boulevard or Santa Monica Boulevard from that intersection poi~t to a point where commercially zoned parcels end. (7) Ocean Park Boulevard betvleen 25th Street and Centinela Avenue and all streets intersecting Ocean Park Boulevard from that 1ntersection to a point where commercially zoned parcels end. - 2 - . . (8) Both sides of 28th Street and 31st street south of Ocean Park Boulevard. (9) Fourth street between Callfornia and Montana Avenue. (b) parking a vehicle in a designated space ln Zone "A" shall be lawful for 60 minutes for each fifty cents ($.50) in coin, and for an additional 60 minutes for each fifty cents ($.50) in coin deposlted thereafter. (e) Parklng meters shall be operated in Zone "A" at such times as posted by the Parking and Traffic Engineer and established by the City Council by resolution. SECTION 2. Santa Monica Municipal Code Section 33933 1.5 amended to read as follows: SECTION 3393B. Parking Meter Zone etB." (a) The fallowing named and described streets or portions of streets within the C.lty shall constitute Zone "B:11 (1) All streets lYlng w.lthin the area bounded by Broadway from Lincoln Boulevard to the eastern City limits and by pico Boulevard from Lincoln Boulevard - 3 - . . to the eastern CIty limits, Including both sides of the boundary streets and all side streets ~ntersecting Broadway and pico Boulevard from that intersection to a pOInt where commercially zoned parcels end r except that Lincoln Boulevard shall be excluded from such area. (2) All of Lincoln Boulevard from Pleo Boulevard to the southern City limits and all side streets intersecting Lincoln Boulevard from that intersection to a point where commercially zoned parcels end. (b) Parking a vehicle in a deSIgnated space in Zone "B" shall be lawful for 60 minutes for each thirty-five cents ($.35) in coin, and for an add~tlonal sixty (60) minutes for each thIrty-five cents ($.35) in COIn deposIted thereafter. (c) Parking meters shall be operated in Zone "B" at such times as posted by the Park1ng and Traffic Engineer and established by the city council by resolution. Parking Meter Zone "C.;" (a) The following named and described streets or portions af streets within the City shall constitute Zone "C:" (1) All af Ocean Avenue and all streets west thereof. (2) All streets lying withln the area bounded by Pico Boulevard, Third street, southerly City I1mits and Barnard Way, ~ncludlng both sides of the boundary streets. (3) Main street between pico and Colorado Boulevards. (4) The city Hall Parking Lot. (b) Parking a vehicle in a deslgnated space in Zone "Cn shall be lawful for 60 IDlnutes upon the deposit of seventy-five cents ($.75) in coin, and for an ~dd1tional sixty (60) minutes for each seventy- five cents ($ . 75) in co in deposited thereafter. (a) All parking lots owned or operated by the City of Santa Monica shall constitute Zone "D," excepting: ( 1) Those parking lots owned by the Parking Authority of the City of Santa Monica. (2) The city Hall Parking Lot. (3) Those parking structures included in the area bounded by wilshire Boulevard, Fourth Streetl BroadwaYI and Second street. (b) Parking a vehicle in a designated space in Zone "DII shall be lawful for sixty (60) minutes upon the deposit of fifty cents ($.50) in COln, and for an additional sixty (60) minutes for each fifty cents ($.50) in coin deposlted thereafter. (c) Parklng meters shall be operated 1.n Zone "0" at such times as posted by the Parklng and Trafflc Englneer and establlshed by the City Counell by resolution. - 6 - . . SECTION 5. Parking Meter Zone "E.n (a) All parking structures owned or operated by the City of Santa Monica located l.n the area bounded by WilshJ.re Boulevard, Fourth Street, Broadway, and Second street shall constitute Zone "E.II (b) Parking a vehicle 1n a designated space in Zone "E" shall be lawful for 60 minutes upon the deposit of twenty-five cents ($.25) in co~n, and for an addltJ.onal 60 mlnutes for each twenty-five cents ($.25) in coin deposlted thereafter. (c) Parking meters shall be operated in Zone "E" at such times as posted by the Parking and Traffic Engineer and established by the City council by resolutlon. SECTION 6. Santa Monica Municipal Code Section 3 393F ~s amended to read as follows: - 7 - . . Any provision of the Santa Monica Municipal Code or appendlces thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, ar~ h~reby repealed or mod~f~ed to that extent necessary to affect the provislons of this Ord~nance. SECTION 9. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitut~onal by a decision of any court of any competent Jurisdiction, such decision shall not affect the validlty of the rernaln1.ng portions of this ordinance. The City Councll hereby - 8 - . . declares that it would have passed thlS Ordinance, and each and every section, subsectlon, sentence, clause, or phrase not declared lnvalld or unconstltutional without regard to whether any portion of the Ordinance would be subsequently declared lnvalld or unconstltutlonal. SECTION 10. The Mayor shall sign and the Clty Clerk shall attest to the passage of this Ordinance. The city Clerk shall cause the same to be published once In the official newspaper wlthin 15 days after ltS adoption. ThlS Ordinance shall beCOMe effective after 30 days from its adoption.
