SUBJECT: Resolution Setting a Public Hearing for April 12, 1988,
on the Assessment of Costs to Repair Damaged Sidewalks,
Driveways, and Curbs on Various streets (SR-88-108)
Introduction
This report requests that the city Council set a public hearing
for April 12, 1988, to hear protests regarding the work and
confirm the assessments of the cost to repair damaged sidewalks,
driveways and curbs.
Background
On October 9, 1979, the City council approved a sidewalk repair
program which provided for property owner participation in the
cost of repairing damaged sidewalks. Residential property owner
participation is 50% of the cost of the repairs if the damage is
related to tree roots: the City pays the remaining 50% of the
cost of the repair.
Property owners are assessed 100% of the
cost if the damage is not related to tree roots and commercial
property owners are assessed 100% of the cost regardless of the
cause of the damage.

A hearing must be held pursuant to the provisions of Chapter 22,
sections 5600 to 5630, of the streets and Highways Code of the
state of California. A Resolution setting the public hearing for
April 12, 1988, is attached.
BUdget/Financial Impact
The financial analysis, which will indicate total revenues to be
derived from this assessment district over the next two years,
will be presented to city council at the time of public hearing.
Recommendation
It is recommended the city council adopt the attached Resolution
setting a public hearing for April 12, 1988, on the assessment of
costs of the subject sidewalk repairs.

CITY OF SANTA MONICA SETTING A HEARING
DATE FOR ANY PROTESTS OR OBJECTIONS TO
THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING REPAIR OF SIDEWALKS ,
DRIVEWAYS AND CURBS (SR-88-108)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. The Superintendent of Streets will file a
report of repair pursuant to Section 5617 of the Streets and
Highways Code of the State of California, relating to the
construction of certain improvements to sidewalks and driveways
at 637 Ashland Avenue, 302 12th Street, 1541 15th street, 1234
18th street, 1243 18th Street, 653 Ashland Avenue, 629 Palisades,
717 7th street, 627 7th Street, 423 7th street, 1133 Ocean
Avenue, all within the City of Santa Monica.
SECTION 2.
Pursuant to Section 5600 et seq. of said
Code, the city Council does hereby order and declare that on the
12th day of April, 1988, at 7:30 P.M., in the City Council
Chambers of City Hall, it will hear and pass upon the report by
the Superintendent of streets of the cost of repairs, together
with any objections or protests, if any, which may be raised by
any property owner liable to be assessed for the cost of such
repairs and any other interested persons.
SECTION 3. All protests or objections must be in writing
and filed with the City Clerk on or before the time set for the
hearing of the protests and objections.
SECTION 4 .
The Superintendent of Streets is hereby
directed to mail notices, in the manner and form prescribed by
law, of the costs of repair and of the adoption of this
Resolution to all persons owning real property affected by the
sidewalk assessment repair program, whose names and addresses
appear on the last equalized assessment roll for the city taxes
or as known to the city Clerk.
SECTION 5. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.

INTRODUCTION
This report recommends that the City council award a contract for
the FY 1987-88 Street Resurfacing Program to Sully Miller
Contract1ng Co., the lowest responsible b1dder, 1n the amount of
$651,599.10.
BACKGROUND
Each f1scal year, the City Council authorizes a City-wide street
resurfacing program which includes resurfac1ng, slurry sealing,
and curb, gutter and sidewalk construction/repair 1n various
areas of the city. The criteria used to determine which streets
are to be resurfaced during a given year are age, surface and
subsurface
condition,
complaints
received,
types
of
use
(commercial or residential), traffic volumes, or projected change
of use or volume.
The following streets are proposed to be resurfaced or slurry
sealed under the 1987-88 Street Resurfac1ng Program:

Assessments
Council has 1nit1ated proceedings to assess commerclal properties
for street resurfacing and gutter construction contiguous to
these properties.
Commercial property owners are assessed for
the full cost of gutter construction (about $9.50 per lineal
foot) and one-half the cost of resurfacing (about $7.50 per
lineal foot).
This is a cash assessment (no bonds will be issued).
Unpaid
assessments are to be placed on the property owners r 1989 tax
bill.
Assessments are expected to generate $20,000.00 in
revenue. Residential properties will not be assessed.
Bid Package
The Notice Inviting Bids was published on January 29 and 30,
1988, in the Evening Outlook and in five construction journals.
The notice was sent to four minority business associations.
Plans and specifications were issued to thirteen contractors and

subcontractors. Bids were opened and read publicly by the Deputy
City Clerk on February 24, 1988.

Introduction
This report requests that the city Council hold a public hearing for

curbs at various locations wi thin the City. It is recommended that
the city Council adopt the attached Resolution confirming the
assessment of costs.
Background
On February 9, 1988, the City council set a public hearing for March
8, 1988, on the assessment of costs to repair damaged sidewalks,
driveways and curbs within the city of Santa Monica. Notices were
sent on February 26, 1988, to property owners informing them of the
public hearing in accordance with the legal requirements of Chapter 22
of the Improvement Act of 1911.
Budget/Financial Impact
This assessment district will generate revenues to the City over the
next two years in the amount of $3,902.00. Any unpaid assessments
will be placed on the FY1988-1989 property tax bill.

WHEREAS, the Superintendent of Streets of the city of Santa
Monica, pursuant to Sections 5600-5630 of the Streets and Highways
Code, commenced proceedings to cause the repair of damaged sidewalks,
driveways and curbs in the City of Santa Monica at 602 Ashland Avenue,
623 Ashland Avenue, 626 Ashland Avenue, 2800 Lincoln Boulevard, 1218
6th Street, 220-224 Santa Monica Boulevard, 635 Ashland Avenue, 1303
Hill Street, 1226 Hill Street, 1206 Hill Street, 1347 Hill Street,
2210 La Mesa Drive, all within the City of Santa Monica; and
WHEREAS, sixty days after said order was served, the work had
not been completed by the owners or persons in possession of the
affected properties, and the Superintendent of streets caused the work
to be done; and
WHEREAS, the Superintendent of streets gave notice as required
by Section 5616 of the Streets and Highways Code; and
WHEREAS, the superintendent of streets did file with the City
council of the City of Santa Monica a report of repairs and costs as
required by section 5617 of the streets and Highways Code; and
WHEREAS, upon the day and hour fixed for hearing by Resolution
Number 7550 (CCS) , the City Council of the City of Santa Monica heard
and passed upon the report of the Superintendent of Streets together
with all objections and protests as required by Section 5618 of the
streets and Highways Code,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The report of the Superintendent
heretofore filed and above-described be, and the same
confirmed.

SECTION 4. If such assessment is not paid within the time
permitted by law, the same shall constitute a special assessment
against and lien on the properties therein described in the amount set
forth in the report of the Superintendent of Streets, which lien shall
continue until the assessment and all interest thereon is paid or
until it is discharged of record.
SECTION 5. If the assessment is not paid wi thin the time
permitted by law, the Superintendent of streets, in accordance with
section 5628 of the streets and Highways Code, shall deliver a Notice
of Lien, prepared in the manner required by section 5626 of the
streets and Highways Code, to the County Auditor who shall collect the
assessment together with all other taxes against the property.
SECTION 6. The City Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be in
full force and effect.

Pursuant to the provisions of Division 7, Chapter 22, Sections
5600 of 5630, of the streets and Highways Code of the State of
california, the following work was caused to be done by the street
Superintendent:
The removal and replacement of 1,303 square Ieet of sidewalk
at $4 per square foot~
The removal and replacement of 60 square feet of driveway at
$5 per square foot~
The removal of 120 square feet of concrete at $2 per square
foot~
The removal and replacement of 32 square feet of concrete at
$4 per square foot~
The total cost of the above work was $5,980.00.
The total proposed assessment for the above sidewalk and curb
damage is $2,990.00 or 50 percent of the total cost. The other 50
percent of the cost is being paid by the City as the above repairs
were caused by tree root damage.
The removal and replacement of 288 square feet of sidewalk at
$4 per square foot.
The total proposed assessment for sidewalks and curbs is $912.00
or 100 percent of the total cost as the damage was not related to tree
roots.
Reference is made to the attached sheets for a description of
the real property in front of which the work has been done, the
proposed assessment against each property, and a description of the
work done in front of each property.

Resurfacing for Pico Boulevard between 28th street and
East City Limits
Introduction
This report recommends that the city council hold a public
hearing to hear protests, if any, regarding the formation of an
assessment district to construct concrete gutters and resurface
pico Boulevard between 28th street and east city limits.
Background
The reconstruction of pico Boulevard between 28th street and the
east City limits was approved by the City Council in FY 1985-86
as a Federal Aid Urban capital project improvement. The project
includes the construction of concrete bus pads, gutters, curbs,
and curb ramps at various locations, and asphalt concrete
resurfacing.
The reconstruction project, estimated at $250,000, is being
financed approximately 87% by Federal Aid Urban funds and 13%
from the city's Gas Tax Fund. The Federally-funded portion of
the project will be a combination of City of Santa Monica and
County of Los Angeles FAU allocations.
staff is recommending that the city Council approve an assessment
district whereby commercial property owners benefitting from the
street resurfacing and gutter construction would be assessed a
portion of the cost in accordance with previously established

policy. Residential property owners will not be assessed. The
proposed assessments, in accordance wi th city policy, are as
follows:

districts
have
been
formed
for
the
federally-funded reconstruction of Wilshire Boulevard from Ocean
Avenue to Centinela Avenue, Colorado Avenue from 14th Street to
Cloverfield, and on commerical and industrial properties in the
City's annual street resurfacing program for the last three
years.
In accordance with the procedures set forth in the Improvement
Act of 1911 of the California streets and Highways Code, Notices
of Public Hearing were sent to property owners and posted along
Pico Boulevard fifteen days in advance (February 8, 1988) of the
public hearing.
BUdget/Financial Analysis
The project estimate is $250,000 and appropriation authority is
available

this project. The assessment district will generate revenues of

You are hereby notified that the City Counci~ of the City of
santa Monica, California, adopted Resolution No. 7545 (CCS) on
January 26, 1988, declaring its intention to resurface streets

A public hearing regarding the proposed improvement will be held
at 7:30 PM, February 23, 1988, in the Council Chambers, city
Hall, 1685 Main Street, Santa Monica, California 90401. All

Office of the City Clerk before said time, and all protests so
filed will be considered by the City Council at that time. Each
protest must contain a description of the property in which each
signer thereof is interested.
The total project cost is estimated to be approximately $250,000.

OF SANTA MONICA FINDING THE PUBLIC CONVENIENCE
AND NECESS ITY REQUIRE STREET RESURFACING AND
CONSTRUCTION OF GUTTERS IN ACCORDANCE WITH
RESOLUTION OF INTENTION NO. 7545 (CITY COUNCIL
SERIES)
WHEREAS, the City Council of the City of Santa Monica,
on the 26th day of January, 1988, passed and adopted its
Resolution of Intention, being Resolution No. 7545 (CCS),
declaring its intention to order the work described therein to be
done, which said Resolution of Intention duly and legally was
published as required by law and notice of said improvement has
been given in the manner required by law and all written
objections and protests to the proposed work or the extent of the
district to be assessed were heard and considered by the city
Council; and
WHEREAS, a public hearing has been held duly and
regularly pursuant to Resolution No. 7545 (CCS) and the laws and
Consti tution of the State of California on the proposed street
resurfacing, construction of gutters, planting of trees and
appurtenant work thereto, as described in the Resolution of
Intention No. 7545 (CCS) on pico Boulevard between 28th Street
and East City Limits; and
WHEREAS, said improvement has been considered fully,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:

, and the City Council of the City of Santa Monica hereby orders,
the work described in Resolution of Intention No. 7545(CCS) to be
done on Pico Boulevard between 28th street and East City Limits
within the city of Santa Monica.
Any and all of said protests
and objections of every kind and nature to the proposed work or
to the extent of the district to be assessed be, and the same
hereby are, overruled and denied.
SECTION 2. The City council hereby finds and determines
further that the "Special Assessment Investigation, Limitation
and Majority Protest Act of 1931" shall not apply to the making
of said improvements.
SECTION 3. The improvements shall be conducted under the
Improvement Act of 1911, contained in Division 7 of the streets
and Highways Code of the state of California,
and the
superintendent of Streets and the City Attorney presented to the
City Council the Resolution of Intention required by said
Improvement Act to initiate the proceedings for said improvement.
SECTION 4. A Notice Inviting Bids will be published for
two days in the Evening Outlook, a newspaper published and
circulated in said City.
SECTION 5. Reference hereby is made to said Resolution
of Intention No. 7545 (CCS) for a description of the work, and
the assessment district, and further particulars.

SUBJECT: Resolution Setting a Public Hearing for March 8, 1988,
on the Assessment of Costs to Repair Damaged Sidewalks,
Driveways, and CUrbs on Various Streets (SR-88-107)
Introduction
This report requests that the City Council set a public hearing
for March 8, 1988, to hear protests regarding the work and
confirm the assessments of the cost to repair damaged sidewalks,
driveways and curbs.
Background
On October 9, 1979, the city Council approved a sidewalk repair
program which provided for property owner participation in the
cost of repairing damaged sidewalks. Residential property owner
participation is 50% of the cost of the repairs if the damage is
related to tree roots; the city pays the remaining 50% of the
cost of the repair. Property owners are assessed 100% of the
cost if the damage is not related to tree roots and commercial
property owners are assessed lOOt of the cost regardless of the
cause of the damage.
Certain repair work has been completed at the following addresses
and the property owners I share of the cost is now due for the
following properties:

626 Ashland Avenue, 2800 Lincoln Boulevard, 1218 6th street,

A hearing must be held pursuant to the provisions of Chapter 22,
Sections 5600 to 5630, of the Streets and Highways Code of the

BUdget/Financial Impact
The financial analysis, which will indicate total revenues to be
derived from this assessment district over the next two years,
will be presented to City council at the time of public hearing.
Recommendation
It is recommended the City Council adopt the attached Resolution
setting a public hearing for March 8, 198B, on the assessment of
costs of the subject sidewalk repairs.

THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. The Superintendent of Streets will file a
report of repair pursuant to Section 5617 of the streets and
Highways Code of the State of California, relating to the
construction of certain improvements to sidewalks and driveways
at 602 Ashland Avenue, 623 Ashland Avenue, 626 Ashland Avenue,
2800 Lincoln Boulevard, 1218 6th street, 220-224 Santa Monica
Boulevard, 635 Ashland Avenue, l303 Hill Street, 1226 Hill
street, 1206 Hill street, 1347 Hill Street, and 2210 La Mesa
Drive, all within the City of santa Monica.
SECTION 2 .
Pursuant to section 5600 et seq. of said
Code, the City Council does hereby order and declare that on the
8th day of March, 1988, at 7: 30 P.M., in the city Council
Chambers .of City Hall, it will hear and pass upon the report by
the Superintendent of streets of the cost of repairs, together
with any objections or protests, if any, whiCh may be raised by
any property owner liable to be assessed for the cost of such
repairs and any other interested persons.

SECTION 3. All protests or objections must be in writing
and filed with the City Clerk on or before the time set for the
hearing of the protests and objections.
SECTION 4.
The superintendent of Streets is hereby
directed to mail notices, in the manner and form prescribed by
law, of the costs of repair and of the adoption of this
Resolution to all persons owning real property affected by the
sidewalk assessment repair program, whose names and addresses
appear on the last equalized assessment roll for the City taxes
or as known to the City Clerk.
SECTION 5. The City Clerk shall certify to the adoption
of this ReSOlution, and thenceforth and thereafter the same shall
be in full force and effect.

Introduction
This report requests that the City Council hold a public hearing for
the assessment of costs to repair damaged sidewalks, driveways and
curbs at various locations within the City. It is recommended that
the City Council adopt the attached Resolution confirming the
assessment of costs.
Background
On January 12, 1988, the City council set a public hearing for
February 9, 1988, on the assessment of costs to repair damaged
sidewalks, driveways and curbs within the City of Santa Monica.
Notices were sent on January 29, 1988, to property owners informing
them of the public hearing in accordance with the legal requirements
of Chapter 22 of the Improvement Act of 1911.
Budget/Financial Impact
This assessment district will generate revenues to the City over the
next two years in the amount of $5,650. Any unpaid assessments will
be placed on the FY1988-1989 property tax bill.

SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO

WHEREAS, the Superintendent of Streets of the city of Santa
Monica, pursuant to sections 5600-5630 of the Streets and Highways
Code, commenced proceedings to cause the repair of damaged sidewalks,
driveways and curbs in the City of Santa Monica at 336 14th street,
1060 Harvard street, 333 11th street, 1242 lOth Street, 1128 San
Vicente Boulevard, 832 San Vicente Boulevard, 1844 17th Street, 1523
6th Street, 1513 6th street, 1020 Chelsea Avenue and 501 Santa Monica
Boulevard, all within the City of Santa Monica; and
WHEREAS, sixty days after said order was served, the work had
not been completed by the owners or persons in possession of the
affected properties, and the Superintendent of streets caused the work
to be done; and
WHEREAS, the Superintendent of streets gave notice as required
by Section 5616 of the streets and Highways Code~ and
WHEREAS, the Superintendent of Streets did file with the City
council of the city of Santa Monica his report of repairs and costs as
required by Section 5617 of the streets and Highways Code; and
WHEREAS, upon the day and hour fixed for hearing by Resolution
Number 7536 (CCS), the City council of the City of Santa Monica heard
and passed upon the report of the Superintendent of Streets together
with all objections and protests as required by section 5618 of the
streets and Highways Code,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:

permitted by law, the same shall consti tute a special assessment
against and lien on the properties therein described in the amount set
forth in the report of the superintendent of streets, which lien shall
continue until the assessment and all interest thereon is paid or
until it is discharged of record.
SECTION 5. If the assessment is not paid wi thin the time
permitted by law, the Superintendent of streets, in accordance with
section 5628 of the Streets and Highways Code, shall deliver a Notice
of Lien, prepared in the manner required by Section 5626 of the
streets and Highways Code, to the County Auditor who shall collect the
assessment together with all other taxes against the property.
SECTION 6. The City Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be in
full force and effect.

REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS AND/OR REMOVAL
OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAPTER 22, SECTIONS 5600 TO 5630, OF THE STREETS AND HIGHWAYS
CODE OF THE STATE OF CALIFORNIA (SR-88-105)
Pursuant to the provisions of Division 7, Chapter 22, Sections
5600 of 5630, of the Streets and Highways Code of the state of
California I the following work was caused to be done by the Street
Superintendent:
The removal and replacement of 1514 square feet of sidewalk at
$4 per square foot;
The removal and replacement of 50 square feet of driveway at
$5 per square foot;
The total cost of the above work was $6,306.00.
The total proposed assessment for the above sidewalk and curb
damage is $3,153 or 50 percent of the total cost.
The other 50
percent of the cost is being paid by the City as the above repairs
were caused by tree root damage.
The removal and replacement of 165 square feet of sidewalk at
$4 per square foot.
The removal and replacement of 250 square feet of driveway at
$5 per square foot; and
The removal and replacement of 29 linear feet of curbing at
$10 per linear feet;
The removal of 148.5 square feet of concrete at $2 per square
foot;
The total proposed assessment for sidewalks and curbs is $2,497 or
100 percent of the total cost as the damage was not related to tree
roots.
Reference is made to the attached sheets for a description of
the real property in front of which the work has been done, the
proposed assessment against each property, and a description of the
work done in front of each property.

Introduction
This report requests that the City Council set a public hearing
for February 23, 1988, to hear protests regarding the work and
confirm the assessments of the cost to repair damaged sidewalks,
driveways and curbs.
Background
On October 9, 1979, the City Council approved a sidewalk repair
program which provided for property owner participation in the
cost of repairing damaged sidewalks. Residential property owner
participation is 50% of the cost of the repairs if the damage is
related to tree roots; the City pays the remaining 50% of the
cost of the repair.
Property owners are assessed 100% of the
cost if the damage is not related to tree roots and commercial
property owners are assessed 100% of the cost regardless of the
cause of the damage.

This report requests that the City council hold a public hearing
on the establishment of an assessment district for the
construction of concrete gutters and street resurfacing on
various City streets.
Background
On December 8, 1987, the City council adopted Resolution No. 7529
(CCS) setting a public hearing for January 12, 1988, to hear any
protests concerning the construction of concrete gutters and
street resurfacing on:
20th street - pico Boulevard to Olympic Boulevard
centinela Avenue - Wilshire Boulevard to Montana Avenue
Harvard street - Santa Monica Boulevard to Wilshire Boulevard
Pacific Street - Lincoln Boulevard to 6th street
Notices of the public hearing were mailed to property owners and
posted on December 28, 1987, in accordance with state law.

Consistent with present
policy for assessing commercial properties, this assessment will

be a cash assessment and no bonds will be issued. The commercial
property owners will be assessed the full cost for the
construction of the gutters. This cost is estimated at $9.50 per
lineal foot based on recent contract prices. staff proposes as
in previous years that the commercial property owners be assessed
approximately one-half the cost of the street resurfacing. It is
estimated that the assessment will be $7.50 per lineal foot.
This charge will be approximately 30-50% of the total cost of the
resurfacing depending on the width of the street. The proposed
assessment is designed so that each commercial property owner
would pay the same unit assessment cost regardless of the width
of the street on which their property fronts. For a commercial
property owner with a 50-foot lot, the total estimated assessment
would be $375.00 for resurfacing and $475.00 for gutters.
BUdget/Financial Impact
Appropriation authority for the construction of this work is in
the "streets, Traffic Control and Parking" Capital Improvement
Program category, Account Nos. 01-770-421-000-940 ($39,375),
"Curb and Gutter Repair" and 01-770-421-000-942 ($270,000),
"street Resurfacing". This project will be part of the 1987-88
street Resurfacing Project.
The assessments for gutter installation and street resurfacing
will generate approximately $20,000 in revenues which will be
deposited in Revenue Account No. 01-906-124-000-000. Cash
revenues will be received in FY 1988-89. Any unpaid assessments
will be placed on the 1988-89 tax roll.

I. Open the public hearing;
2. Close the public hearing and acknowledge any protests; and
3. Adopt the attached Resolution establishing a gutter
construction and street resurfacing district on the above
named city streets.

This letter is legal notice as required by the Improvement Act of 1911

You are hereby notified that the city Council of the City of Santa Monica,
California, adopted Resolution No. 7529(CCS) on December 8, 1987, declaring
its intention to resurface streets and construct gutters on various City
streets as listed above, declaring the work to be of more than local
ordinary public benefit, and that a portion of the expense thereof shall be
assessed upon a district. Commercial property owners will be assessed
approximately $9.50 per lineal foot for gutter construction and $7.50 per
lineal foot for street resurfacing. RESIDENTIAL PROPERTIES WILL NOT BE
ASSESSED.
A public hearing regarding the proposed improvement will be held at 7:30
P.M., January 12, 1988, in the Council Chambers, City Hall, 1685 Main
street, Santa Monica, California 90401. All protests regarding this matter
must be filed in writing in the Office of the city Clerk before said time,
and all protests so filed will be considered by the City Council at that
time. Each protest must contain a description of the property in which
each signer thereof is interested.
The total project cost is estimated to be approximately $750,000. The
amount to be assessed upon the district for this improvement is
approximately $20,000. Records available indicate you own property in the
above district. Requests for copies of the Resolution of Intention which
contain further particulars on this assessment and all questions regarding
the proposed improvement may be directed to Jean Stanley in the Office of

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA ORDERING THE CONSTRUCTION OF CONCRETE GUTTERS
AND STREET RESURFACING ON VARIOUS CITY STREETS ALL
WITHIN THE CITY OF SANTA MONICA
WHEREAS, the City Council of the City of Santa Monica, on
the 8th day of December, 1987, adopted Resolution No. 7529 (CCS)
setting a pUblic hearing; and
WHEREAS, wri tten notices of said improvements have been
given in the manner required by law; and
WHEREAS, any and all written obj ections and protests to
the work or the extent of the district to be assessed were heard
and considered by the city council,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The public convenience and necessity requires
the construction of concrete gutters and street resurfacing
along:
20th street - from pico Boulevard to Santa Monica Freeway;
centinela Avenue - from Wilshire Boulevard to Montana Avenue;
Harvard street - from Santa Monica Boulevard to Wilshire
Boulevard; and
Pacific Street - from Lincoln Boulevard to 6th Street,
all within the city of Santa Monica.

SECTION 2. All protests and objections of every kind and
nature to the construction of concrete gutters and the street
resurfacing along:
20th street from Pico Boulevard to Olympic Boulevard;
Centinela Avenue from wilshire Boulevard to Montana Avenue;
Harvard street - from Santa Monica Boulevard to Wilshire
Boulevard; and
Pacific street - from Lincoln Boulevard to 6th Street,
as described in Section 1, all within the city of Santa Monica,
be, and the same and are hereby, overruled and denied.
SECTION 3. Pursuant to streets and Highways Code Section
5880, the Street superintendent is directed to commence the
construction of concrete gutters and street resurfacing above-
described after a sixty (60) -day period wherever the property
owners have not started the gutter construction and street
resurfacing themselves.
SECTION 4. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.

SUBJECT: Recommendation to Hold Public Hearing for the
Confirmation of Gutter Construction and street
Resurfacing Assessments on Various city streets
Introduction
This report recommends that the City Council hold a public
hearing to hear protests regarding the work and to confirm the
assessments for gutter construction and street resurfacing on
various streets as listed below.
Background
On December 9, 1986, the City Council approved the formation of
an assessment district and set a public hearing for gutter and
street resurfacing in conjunction with the 1986-87 street
Resurfacing Program for:
7th street, Wilshire to San vicente Boulevard
Boulevards
22nd street, Michigan Avenue to Pennsylvania Avenue
Princeton street, Santa Monica to Wilshire Boulevards
Yale street, Santa Monica to Wilshire Boulevards
18th street, Wilshire Boulevard to Montana Avenue
In accordance with long-standing City policy, commercial and
industrial property owners will be assessed for a portion of the
work. The recommended assessments are $9.50 per linear foot for
gutters and $7.50 per linear foot for resurfacing.
Property
owners were notified in accordance with state law and the public
hearing was held on January 13, 1987. After closing the public
hearing, the Council ordered the work to commence.

The work has been completed and commercial and industrial
property owner assessments are now due.
A public hearing to
confirm the assessments must be held pursuant to section 5882 of
the california streets and Highways Code. On November 24, 1987,
the city council set the public hearing for January 12, 1988.
Notices of pUblic hearing were sent to commercial and industrial
property owners on December 28, 1987. A list of property owners
and assessments will be available to Council at the time of the
public hearing.
BUdget/Financial Impact
Approximately $40,000 will be generated from property owner
assessments.
Revenue will be deposited
in Account No.
OI-906-124-000-000
during this
fiscal
year.
Any unpaid
assessments will be put on the 1988-89 property tax rolls by Los
Angeles County Assessor's office.
Recommendation
It is recommended that the City Council:
I. Open the public hearing;
2. Close the public hearing, and;
3. Acknowledge any protests and adopt the attached
resolution confirming the assessments.

The street resurfacing and installation of gutters on the above named
streets has been completed and the cost of your assessment is as shown

Pursuant to the Improvement Act of 1911 of the California Streets and
Highways Code, this letter is notification that the City Council, pursuant
to Resolution of Intention No. 7341(CCS) adopted December 9, 1986f has
scheduled a hearing to hear and pass upon the report of the Superintendent
of streets of the cost of the installation, in connection with the
above-described project, together with any objections and protests, if any,
which may be raised by any property owner liable to be assessed for the
cost of such street resurfacing and gutter installation and any other
interested persons. Pursuant to Resolution No. 7518 (CCS) adopted by the
city Council on November 24, 1987, a public hearing to confirm assessments

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA APPROVING THE ASSESSMENT
DIAGRAM AND CONFIRMING ASSESSMENTS FOR STREET
RESURFACING AND GUTTER CONSTRUCTION ON VARIOUS
CITY STREETS
WHEREAS, the City of Santa Monica, pursuant to Section
5100 et seq. of the Streets and Highways Code, commenced
proceedings to resurface streets and install gutters on:
7th Street, from wilshire Boulevard to San Vicente
Boulevard;
22nd street, from Michigan Avenue to Pennsylvania
Avenue;
Princeton street, from Santa Monica to Wilshire
Boulevards;
Yale street, from Santa Monica Boulevard to Wilshire
Boulevards; and
18th Street, from Wilshire Boulevard to Montana Avenue.
WHEREAS, the proceeding is more fully described in the
Resolution of Intention adopted by the city Council on December
9, 1986, being Resolution Number 7341 (CCS); and
WHEREAS, the contract for the above-described work has
been fulfilled to the satisfaction of the Superintendent of
Streets; and
WHEREAS, the Superintendent of streets has made an
assessment to cover the sum due for the work performed and
specified in the contract, and:
WHEREAS, the assessment has been filed with the city
Clerk; and
WHEREAS, the City Clerk gave the notice required by
Section 5362 and 5363 of the Streets and Highways Code; and

WHEREAS, upon the day and hour fixed for hearing by the
city Clerk, the city Council of the City of Santa Monica heard
and passed upon any and all objections, appeals, and protests,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. All objections, appeals, and protests of
every kind and nature be, and the same are hereby, overruled and
denied.
SECTION 2. The diagram of property, affected and
benefited by the street resurfacing and gutter construction on:
7th street, from wilshire Boulevard to San Vicente
Boulevard;
22nd Street, from MiChigan Avenue to Pennsylvania
Avenue;
Princeton Street, from Santa Monica to Wilshire
Boulevards:
Yale Street, from Santa Monica to Wilshire Boulevards;
18th Street, from Wilshire Boulevard to Montana Avenue,
in the City of Santa Monica, as more fully described in
Resolution 7341 (CCS) and therein declared to be the property to
be assessed to pay the expense of the improvements, is approved
and the City Clerk is directed to execute the certificate on the
diagram certifying such approval and to deliver the diagram to
the Superintendent of Streets.
SECTION 3. The assessment for the street resurfacing
and gutter construction on:
7th Street, from wilshire Boulevard to San vicente
Boulevard;
22nd street, from MiChigan Avenue to Pennsylvania
Avenue;
Princeton Street, from Santa Monica to Wilshire
Boulevards;
Yale str~, from Santa Monica to w1Ithire Boulevards;
lath street, from Wilshire Boulevard to Montana Avenue,
as more fully described in Resolution Number 7341 (CCS), be, and
the same hereby is, confirmed and approved.
SECTION 4. The Superintendent of streets shall
forthwith attach a warrant to said assessment bearing the date of
this confirmation.
SECTION 5. The assessment roll, warrant, and diagram
shall be recorded in the Office of the Superintendent of streets,
and immediately thereafter the city Clerk shall file a copy of
the assessment diagram in the Office of the County Recorder, and
thereafter shall record in said Office of the County Recorder a
Notice of Assessment, all in the manner and form prescribed by
section 3114 of the streets and Highways Code of the state of
California.
SECTION 6. Assessments not paid to the City within the
specified time shall be sent to the Los Angeles County Assessor
to collect such assessments upon the tax roll which general taxes
are collected.
SECTION 7. The city Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter the
same shall be in full force and effect.

Introduction
This report requests t~at the city Council set a public hearing
for January 9, 1990, to hear protests regarding the work and
confirm the assessments of the cost to repair damaged sidewalks,
driveways and curbs.
Background
On October 9, 1979, the city council approved a sidewalk repair
program which provided for property owner participation in the
cost of repairing damaged sidewalks. Residential property owner
participation is 50% of the cost of the repairs if the damage is
related to tree roots; the City pays the remaining 50% of the
repair cost. Property owners are assessed IOO% of the cost if
the damage is not related to tree roots and commercial property
owners are assessed 100% of the cost regardless of the cause of
the damage.

THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION I. The Superintendent of streets will file a
report of repair pursuant to section 5617 of the streets and
Highways Code of the state of California, relating to the
construction of certain improvements to sidewalks and driveways

Resolution to all persons owning real property affected by the
sidewalk assessment repair program, whose names and addresses
appear on the last equalized assessment roll for the City taxes
or as known to the City Clerk.
SECTION 5. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.

Introduction
This report requests that the city Council hold a public hearing for
the assessment of costs to repair damaged side\valks, driveways and
curbs at various locations within the city.
It is recommended that
the city council adopt the attached Resolution confirming the
assessment of costs.
Background
On November 14, 1989, the City Council set a public hearing for
December 12, 1989, on the assessment of costs to repair damaged
sidewalks, driveways and curbs within the city of Santa Monica.
Notices \Vere sent on December I, 1989 to property owners informing
them of the public hearing in accordance with the legal requirements
of Chapter 22 of the Improvement Act of 1911.
BUdget/Financial Impact
This assessment district will generate revenues to the City over the
next two years in the amount of $10,917.25. Any unpaid assessments
will be placed on the 1990-1991 property tax bill.

OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAPTER 22, SECTIONS 5600 TO 5630, OF THE STREETS AND HIGffivAYS
CODE OF THE STATE OF CALIFORNIA (SR-89-152/153)
Pursuant to the provisions of Division 7, Chapter 22, Sections
5600 to 5630, of the streets and Highways Code of the State of
California, the following work was caused to be done by the Street
Superintendent:
The removal and replacement of 1325 square feet of sidewalk at
$6.00 per square foot;
The reMoval and replacement of 1250 square feet sidewalk at
$4.00 per square foot;
The removal and replacement of 39 linear feet of curbing at
$10.50 per linear foot;
The removal and replacement of 90 square feet of driveway
apron at $7.50 per square foot.
The total cost of the above work was $14,034.50.
The total proposed assessment for the above sidewalk and curb
damage is $7, 017. 25 or 50 percent of the total cost.
The other 50
percent of the cost is being paid by the city as the above repairs
were caused by tree root damage.
The removal and replacement of 100 square feet of sidewalk in
$6.00 per square foot.
The removal and replacement of 278 square feet of driveway
apron at $7.50 per square foot;
The removal and replacement of 130 square feet of sidewalk in
driveway at $7.50 per square foot;
The removal (only) of 20 square feet of parkway apron at $3.00
per square foot;
The removal and replacement of 30 square feet of sidewalk in
parkway area at $6.00 per square foot.

The total cost of the above work was $3,900.00.
The total proposed assessment of the above sidewalk and curb
damage is $3,900.00 or 100 percent of the total cost of the above
repairs were not caused by tree root damage.

Sidewalks, Driveways and Curbs (SR-89-150/151)
Introduction
This report requests that the City council hold a public hearing for
the assessment of costs to repair damaged sidewalks, driveways and
curbs at various locations within the city.
It is recommended that
the City Council adopt the attached Resolution confirming the
assessment of costs.
Background
On October IO, 1989, the City Council set a public hearing for
November 14, 1989, on the assessment of costs to repair damaged
sidewalks, driveways and curbs within the City of Santa Monica.
Notices were sent on November 3, 1989 to property owners informing
them of the public hearing in accordance with the legal requirements
of Chapter 22 of the Improvement Act of 1911.
Budget/Financial Impact
This assessment district will generate revenues to the City over the
next two years in the amount of $14,774.75. Any unpaid assessments
will be placed on the 1990-1991 property tax bill.

WHEREAS,' sixty days after said order was served, the work had not
been com~leted by the owners or persons in possession of the affected

section 5616 of the streets and Highways Code; and

WHEREAS, the Superintendent of Streets did file with the ci ty
council of the City of Santa Monica a report of repairs and costs as
required by section 5617 of the streets and Highways Code; and
WHEREAS, upon the day and hour fixed for hearing by Resolution
Number 7922 (CCS), the City council of the City of Santa Monica heard
and passed upon the report of the Superintendent of streets together
with all Objections and protests as required by section 5618 of the
Streets and Highway Code,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION I. The report of the Superintendent of Streets heretofore
filed and above-described be, and the same hereby is, confirmed.
SECTION 2. All protests and objections of every kind and nature
to the report of the Superintendent of streets be and the same hereby
are, overruled and denied.
SECTION 3. The cost of the repairs, as set forth in the report of
the Superintendent of Streets, shall be assessed against the
properties therein described, which properties front the sidewalk upon
which the repairs were made.
SECTION 4. If such assessment is not paid within the time
perroi tted by law, the same shall constitute a special assessment
against and lien on the properties therein described in the amount set
forth in the report of the Superintendent of streets, which lien shall
continue until the assessment and all interest thereon is paid or
until it is discharged of record.

SECTION 5.
If the assessment is not paid within the time
permitted by law, the Superintendent of streets, in accordance with
Section 5628 of the streets and Highway Code, shall deliver a Notice
of Lien, prepared in the manner required by Section 5626 of the
streets and Highways Code, to the County Auditor who shall collect the
assessment together with all other taxes against the property.
SECTION 6. The City Clerk shall certify to the adoption of this
ReSOlution, and thenceforth and thereafter the same shall be in full
force and effect.

OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAPTER 22, SECTIONS 5600 TO 5630, OF THE STREETS AND HIGHWAYS
CODE OF THE STATE OF CALIFORNIA (SR-89-IS0/1S1)
Pursuant to the provisions of Division 7, Chapter 22, Sections

5600 to 5630, of the streets and Highways Code of the State of
california, the following work was caused to be done by the street
Superintendent:
The removal and replacement of 215 square feet of sidewalk in
driveway at $7.50 per square foot.
The removal and replacement of l480 square feet of sidewalk at
$4.00 per square foot;
The removal and replacement of 2188 square feet sidewalk at
$6.00 per square foot;
The removal and replacement of 220 square feet of driveway
apron at $5.00 per square foot:
The removal and replacement of 14 linear feet of curbing at
$10.00 per linear foot;
The removal and replacement of 56 linear feet of curb at
$10.50 per linear foot.
The removal (only) of 105 square feet of parkway at $3.00 per
square foot;
The removal and replacement of 60 square feet of driveway
apron at $7.50 per square foot.
The total cost of the above work was $23,253.50.
The total proposed assessment for the above sidewalk and curb
damage is $11,626.75 or 50 percent of the total cost. The other 50
percent of the cost is being paid by the City as the above repairs
were caused by tree root damage.
The removal and replacement of 787 square feet of sidewalk at
$4.00 per square foot.

The total cost of the above work was $3,148.00.
The total proposed assessment of the above sidewalk and curb
damage is $3,148.00 or 100 percent of the total cost of the above
repairs were not caused by tree root damage.

Introduction
This report requests that the City Council hold a public hearing for
the assessment of costs to repair damaged sidewalks, driveways and
curbs at various locations within the City.
It is recommended that
the City Council adopt the attached Resolution confirming the
assessment of costs.
Background
On October 10, 1989, the city council set a public hearing for
November 14, 1989, on the assessment of costs to repair damaged
sidewalks, driveways and curbs within the City of Santa Monica.
Notices were sent on November 3, 1989 to property owners informing
them of the public hearing in accordance with the legal requirements
of Chapter 22 of the Improvement Act of 1911.
BUdget/Financial Impact
This assessment district will generate revenues to the City over the
next two years in the amount of $12,874.75. Any unpaid assessments
will be placed on the 1990-1991 property tax bill.

Recommendation
It is recommended the City Council:
I. Open the public hearing;
2. Close the public hearing;
3. Acknowledge any protests and adopt the attached Resolution
confirming the assessments.

REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS AND/OR REMOVAL
OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAPTER 22, SECTIONS 5600 TO 5630, OF THE STREETS AND HIGHWAYS
CODE OF THE STATE OF CALIFORNIA (SR-89-150/151)
Pursuant to the provisions of Division 7, Chapter 22, Sections
5600 to 5630, of the Streets and Highways Code of the State of
california I the following work was caused to be done by the Street
superintendent:
The removal and replacement of 215 square feet of sidewalk in
driveway at $7.50 per square foot.
The removal and replacement of 1430 square feet of sidewalk at
$4.00 per square foot;
The removal and replacement of 2188 square feet sidewalk at
$6.00 per square foot;
The removal and replacement of 220 square feet of driveway
apron at $5.00 per square foot;
The removal and replacement of 14 linear feet of curbing at
$10.00 per linear foot;
The removal and replacement of 56 linear feet of curb at
$10.50 per linear foot.
The removal (only) of 105 square feet of parkway at $3.00 per
square foot;
The removal and replacement of 60 square feet of driveway
apron at $7.50 per square foot.
The total cost of the above work was $23,053.50.
The total proposed assessment for the above sidewalk and curb
damage is $11,526.75 or 50 percent of the total cost. The other 50
percent of the cost is being paid by the city as the above repairs
were caused by tree root damage.
The removal and replacement of 337 square feet of sidewalk at
$4.00 per square foot.

The total cost of the above work was $1,348.00.
The total proposed assessment of the above sidewalk and curb
damage is $1,348.00 or 100 percent of the total cost of the above
repairs were not caused by tree root damage.
