Introduction
This report requests that the city Council hold a public hearing
for the confirmation of assessments for the above streets.
Background
streetlight petitions from residents of the above streets were
accepted by the city Council on January 14, 1986, and a public
hearing was set for February 25, 1986. The public hearing was
held and the Council ordered the project to proceed. Staff
designed the project and a contract to construct the streetlights
was awarded on September 9, 1986.
The work is complete and assessments are due. In accordance with
state law, a public hearing must be held to confirm the
assessments and on April 28, 1987 Council set the public hearing
for May 26, 1987. A Notice of Public Hearing with the amount of
assessment was sent to each property owner 15 days in advance.

Also, the notice was published in the Evening Outlook for two
consecutive days 15 days in advance of the pUblic hearing.
Budget/Financial Impact
The total cost of the project is $282,960. The city's cost
is $155,321.15 and $127,638.55 will be assessed to property
owners. $195,576 is presently encumbered at Account No.
01-770-453-000-905 for the city's share. Unused funds will be
returned to the account balance for other streetlight projects.
These figures include 31st street from Ocean Park to Pearl street
which is part of the streetlight district. However, due to an
error on staff's part, 31st Street assessments were omitted from
the staff report and resolution which set this public hearing. A
public hearing for 31st Street will be held on June 23, 1987.
A detailed assessment report will be presented at the public
hearing.
Recommendation
It is recommended that the City Council:
1. Open the public hearing;
2. Close the pUblic hearing; and
3. Acknowledge a~ protests and adopt the attached
Resolutions confirming the assessments.

The installation of streetlights on the above named street has
been completed and the cost of your assessment is shown above.
Pursuant to the Improvement Act of 1911 of the California Streets
and Highways Code, this letter is notification that the City
Council, pursuant to Resolution of Intention No. 7141 (CCS)
adopted on January 14, 1986, has scheduled a hearing to hear and
pass upon the report of the Superintendent of Streets of the cost
of the installation, in connection with the above-described
project, together with any objections and protests, if any, which
may be raised by any property owner liable to be assessed for the
cost of such streetlighting installtion and any other interested
persons.

Any protests or objections must be in writing and must be filed
with the city Clerk on or before the time set for the hearinq.

Upon confirmation of the report of the Superintendent of Streets,
as provided for in Improvement Act of 1911 of the California
Streets and Highways Code, the cost of the streetlight
installation will be assessed against your property and you will
notified of the manner of payment. Please contact Jean Stanley
at the above address at 458-8721 if you have any questions
regarding this assessment district, your assessment or these .
proceedings.
The City will provide financial assistance for low-to-moderate
income persons. If your income is less than $16,900 for a faimly
of one person, $19,300 for two persons, $21,750 for three persons
or $24,150 for four persons, call Rey Espana at 458-8701 for
information on this program.
Property owners will also be receiving information from Rent
Control regarding pass through of costs to tenants.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA APPROVING THE ASSESSMENT
DIAGRAM AND CONFIRMING AN ASSESSMENT FOR HILL
STREET BETWEEN 23rd AND 25th STREETS; YALE AND
HARVARD STREETS BETWEEN COLORADO AND SANTA
MONICA BOULEVARDS; 9th, l2th AND PRINCETON
STREETS BETWEEN WILSHIRE BOULEVARD AND SANTA
MONICA BOULEVARD; AND FRANKLIN STREET FROM
WILSHIRE BOULEVARD TO APPROXIMATELY 1800'
NORTHWESTERLY
WHEREAS, the City of Santa Monica, pursuant to Section
5100 et seq. of the Streets and Highways Code, commenced
proceedings to construct streetlighting and appurtenant work on:
Hill Street between 23rd and 25th streets
Yale and Harvard streets between Colorado and Santa
Monica Boulevards
9th, 12th and Princeton streets between Wilshire
Boulevard and Santa Monica Boulevard
Franklin Street from Wilshire Boulevard to
approximately 1800' Northwesterly
WHEREAS, the proceeding is more fully described in the
Resolution of Intention adopted by the City Council on January
14, 1986, being Resolution Number 7171 (CCS) ; and
WHEREAS, the contract for the above-described work has

been fulfille~ to the satisfaction of the Superintendent of
Streets; and
WHEREAS, the Superintendent of Streets has made an
assessment to cover the sum due for the work performed and

specified in the contract; and
WHEREAS, the assessment has been filed with the City
Clerk; and

WHEREAS, the City Clerk gave the notice required by
sections 5362 and 5363 of the streets and Highways Code; and
WHEREAS, upon the day and hour fixed for hearing by the
city Clerk, the city council of the City of Santa Monica heard
and passed upon any and all objections, appeals, and protests,
NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That all objections, appeals, and protests
of every kind and nature be and the same hereby are overruled and
denied.
SECTION 2. That the diagram of property affected and
benefited by the construction of a high-pressure sodium street
lighting system and appurtenant work on:
Hill street between 23rd and 25th streets
Yale and Harvard streets between Colorado and Santa
Monica Boulevards
9th, 12th and Princeton Streets between Wilshire
Boulevard and Santa Monica Boulevard
Franklin Street from Wilshire Boulevard to
approximately 1800' Northwesterly
in the city of Santa Mo~ica, as more fully described in
Resolution 7141 (CCS) and therein declared to be the property to
be assessed to pay the expense of the improvements, is approved
and the city Clerk is directed to execute the certificate on the
diagram certifying such approval and to deliver the diagram to

the Superintendent of Streets.

SECTION 3. That the assessment for the replacement of
the streetlight system and appurtenant work on:
Hill street between 23rd and 25th streets
Yale and Harvard streets between Colorado and Santa
Monica Boulevards
9th, 12th and Princeton streets between Wilshire
Boulevard and Santa Monica Boulevard
Franklin street from Wilshire Boulevard to
approximately 1800' Northwesterly
as more fully described in Resolution Number 7141 (CCS) , be, and
the same hereby is, confirmed and approved.
SECTION 4. That the Superintendent of streets shall
forthwith attach a warrant to said assessment bearing the date of
this confirmation.
SECTION 5. That the assessment roll, warrant and
diagram shall be recorded in the Office of the Superintendent of
streets, and immediately thereafter the City Clerk shall file a
copy of the assessment diagram in the Office of the County
Recorder, and thereafter shall record in said Office of the
County Recorder a Notice of Assessment, all in the manner and
form as prescribed by Section 3114 of the streets and Highways
Code of the state of California.

SECTION 6. That the City Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter the
same shall be in full force and effect.
