Introduction
This report requests that the city Council hold a public hearing
to determine the convenience and necessity of streetlights and to
order the work on:
5th, Wilshire to washington
Stanford, Wilshire to washington
Marguerita, 4th street to First court
Background
On May 12, 1987, staff presented to City council streetlight
petitions for the above streets. The petitions were approved by
Rent Control and contained the required number of residents'
signatures. The City Council accepted the petitions and adopted
Resolution No. 7429 (CCS) setting a public hearing for the
purpose of determining whether public convenience and necessity
require the construction of streetlighting and declaring its
intention to construct streetlighting and appurtenant work.
The resolution set a public hearing for June 9, 1987, at which
time any interested party may address the city council regarding
the proposed work or improvements. Notices of Public Hearing
were mailed to each property owner and tenant, and posted on each
street on May 22, 1987, in the manner prescribed by state law. A

list of property owners will be available for review in the
council Chambers at the time of the public hearing.
BUdget/Financial Impact
The estimated cost for this streetlight district is $175,700.
The City's portion is approximately $87,850. Appropriation
authority in the amount of $108,144.14 is available in Account
Nos. 01-770-453-000-903 and 01-770-453-000-905. This district
will be combined with the district approved on April 28, 1987.
Recommendation
It is recommended that the city Council:
1. Open the public hearing on the convenience and
necessity of the Resolution of Intention~
2. Close the pUblic hearing;
3. Acknowledge any protests and adopt the attached
resolution finding that the public convenience and
necessity require the construction and ordering the
work.

This letter is legal notice as required by the 1911 Improvement
Act proceedings under which streetlights are to be constructed on
5th, from Wilshire to Washington, stanford from Wilshire to
Washington and Marguerita from 4th street to First Court.
You are hereby notified that the city Council of the City of
Santa Monica, california, adopted Resolution No. 7429 (CCS) on
May 12, 1987, declaring its intention to construct street
lighting and appurtenant work in the above named area,
determining that bonds be issued to represent the cost therefore,
declaring the work to be of more than local ordinary public
benefit, and that the expense thereof shall be assessed upon a
district.
A public hearing regarding the proposed improvement will be held
at 7:30 pm, June 9, 1987, in the Council Chambers, city Hall,
1685 Main street, Santa Monica. All protests regarding this
matter must be filed in writing in the Office of the City Clerk
before said time, and all protests so filed will be considered by
the City Council at that time. Each protest must contain a
description of the property in which each signer thereof is
interested.
The total project cost is estimated to be approximately $214,700.
The amount to be assessed upon the district for this improvement
is approximately $107,350. Records available indicate you own
property in the above district. Requests for copies of the
Resolution of Intention which contain further particulars on this
assessment and all questions regarding the proposed improvement
may be directed to Jean Stanley in the Office of General Services
at 458-8721.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA FINDING THAT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE
CONSTRUCTION OF STREETLIGHTING AND ORDERING
WORK ON 5TH STREET BETWEEN WILSHIRE AND
WASHINGTON, STANFORD BETWEEN WILSHIRE AND
WASHINGTON, AND MARGUERITA FROM 4TH STREET TO
FIRST COURT AS SET FORTH IN RESOLUTION OF
INTENTION NO. 7429 (CITY COUNCIL SERIES)
WHEREAS, the City council of the City of santa Monica,
on the 12th day of May, 19B7, passed and adopted its Resolution
of Intention, being Resolution No. 7429 (CCS), declaring its
intention to order the work described therein to be done, which
said Resolution of Intention duly and legally was published as
required by law and notice of said improvement has been given in
the manner required by law and all written objections and
protests to the proposed work or the extent of the district to be
assessed were heard and considered by the City Council; and
WHEREAS, a public hearing has been held duly and
regularly pursuant to Resolution No. 7429 (CCS) and the laws and
Constitution of the state of California on the proposed
construction of street lighting and appurtenant work thereto, as
described in the Resolution of Intention No. 7429 (CCS), on:
5th, Wilshire to washington
Stanford, Wilshire to Washington
~ Marguerita, 4th street to First Court

WHEREAS, said improvement has been considered fully,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:

SECTION 1. The pUblic interest and convenience require,

and the City council of the city of Santa Monica hereby orders,
the work described in said Resolution of Intention to be done on:
5th, wilshire to washington
stanford, Wilshire to Washington
Marguerita, 4th street to First Court
all within the City of Santa Monica.
Any and all of said protests and objections of every
kind and nature to the proposed work or to the extent of the
district to be assessed be and the same hereby are overruled and
denied.
SECTION 2. The city Council hereby finds and determines
further that .'Special Assessment Investigation, Limitation and
Majority Protest Act of 193111 shall not apply to the making of
said improvements.
SECTION 3. The improvements shall be conducted under the
Improvement Act of 1911, which is Division 7 of the streets and
Highway Code of the state of California, and the Superintendent
of streets and the City Attorney presented to the City council
the Resolution of Intention required by Improvement Act of 1911
to initiate the proceedings for said improvements.
SECTION 4. The city Clerk hereby is directed to post a
notice for five days on or near the door of the Council Chambers

of the City Hall inviting sealed proposals or bids for doing the
work ordered and referring to the specifications on file and to
publish a notice inviting such proposals for two days in the

Evening Outlook, publ ished and circulated . said

City.
SECTION 5. Reference hereby is made to said Resolution
of Intention for a description of the work, the assessment
district, the bonds to be issued and for further particulars.
SECTION 6. The city Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.

Attached is a request from three res~dents who orig~nally signed
the petitlon to install streetllghts, but have s~nce changed thelr
minds, and want their names removed from the pet~tlon.
If the f~nal count of signatures on the petltlon was 38, the removal
of these three names should result in less than 60% support. However,
I am most concerned with the block of Stanford Street between Lipton
and ~ashington, and would be satlsfied if that block was removed
from the project. ( See attachment B - letter and petltion)

Re. Resolution No. 7429 (CCS) - Installation of streetlights
As the attached petitlon indicates, the majority of resldents, on
Stanford Street between Washlngton and Lipton, does not want
streetlights installed. I spoke wlth Jean Stanley ln the City of
Santa Monicats General Services Department, and she indlcated that
if I could demonstrate this fact, the project could be ammemded to
exclude the 1000 block of Stanford Street (between ~ashlngton and
Liuton). Since the strongest support for streetlights has come from
the residents of Stanford between Wllshlre and Llpton, this aDproach
of separating the two blocks would sat~sfy the desires of the
majority of the resldents of both blocks.
I have assumed that thlS change would require a 60% majority.
There are 13 residences involved; I have obtained 8 signatures
supporting the removal of the 1000 block from the project.
If anvthing addltlonal is requlred, please advise me in advance of
the June 9, 1987, publlC hearing If posslble. I can be reached at

Re: Proposed Street Lighting Construction on Stanford Street/ Wilshire

The purpose of my letter is to protest the construction of street
lighting on Stanford Street from Wl1shire Blved to Washlnqton Street.
I feel the llghting on Stanford from Llpton to Washlnqton is adequate.
My lot is the corner lot (S/W) on Stanford and Washington. The frontage
on Stanford is the length of my lot, mean1ng the cost to me wlll be
three tlmes that of any other residence owner in the area for this
. project.
There is a street 11ght on the corner of Washington and Stanford
and another directly across the street. This lights our area adequately.
I protest the fact that my cost will be three t1mes that of anyone
else to light up the lower end of Stanford at Wilshlre.
